  1. Okay, I was just reading some topics about the SSC and came to find out that you don't have to wait till you receive your EAD to apply for one? Or am I wrong?

    I entered the country as visitor on the VWP, I overstayed and got married, I will send out my AOS and I-130 this week. Can I apply for a SSC with only my passport and the NOA I will receive? But I won't be able to work just yet, right? I'm a little confused.. I thought I had to wait till I would get my EAD to apply for a SSC?

  2. No, they don't deny it just on these things alone but if they ask you have to say yes on the form because they can track you by the SSN anyway and find out themselves.

    Ok, thanks, yea I definitely don't want to lie, but is the question about ME, or my husband and I together? I wasn't sure if WIC and medical assistance would fall under that category. The foodstamps and cash assistance are on my husband's name.

  3. You say, it's about household size, but why is the question "persons NOT sponsored in this affidavit", then it asks you, "if you are married, write 1." Well obviously we are married, but he will be sponsoring me (well his mom will). So what do I put in that box?

    Plus the question above it asks the number of people you are sponsoring, it will only be me, so that is a one. Then at the bottom of that question, you are supposed to count the whole household (not counting anyone twice), so that would be a total of 3. But if I fill in a 1 for the spouse line, then it would be 4, which is incorrect. You see, what I'm saying? Why do they make it so complicated?!

  4. They fill out separate I864s. So you'll submit 2 forms. Pick the first option in the forms.

    It's about your household. For poverty guidelines you need to count everyone in your household and dependent children (whether they live with you or not). So put a 1 next to everyone in you household on your husbands form and add them up. On your mother in law's form put everyone in her house hold and the person immigrating (you) and add them up.

    Get a job letter from his company, it should spell out everything and would be great since you don't have many w2s and his tax returns would be a little low.

    What exactly is it supposed to spell out? An estimate of the annual income or the fact that he will get paid in tips?

    Question 2: Have you received public assistance in the US from any source.......

    I have been on WIC and receive financial medical assistance, and my husband JUST NOW started receiving Foodstamps and Cash Assistance because he was unemployed and did not have an income. We only received it once, and I will have to stop it pretty soon, because he just found a new job (has not been paid yet). So do I put YES? Will that be a reason for denial???? Didn't someone mention that WIC and foodstamps and all that is accepted because it is our right to receive it?

  6. My husband has had a very irregular work history, therefor I will be relying on my MIL's income. I have understood that both my husband and my MIL file the I-864?

    I was just going through this form, and I'm super confused.

    Part 1 Basis for filling out affadavit of support. What do both my MIL and Hubby have to fill out for this question?? Like I said, we will be relyin on my MIL's income, so....

    Part 5, question 21. Persons NOT sponsored in this affidavit How does he have to fill this on, and what does my mil have to write here? I will be the only one immigrating. So do they put zero's in all the boxes, and a one for our son and himself? And leave the spouse part open?

    Like I said his work history has been very irregular, he has changed to many jobs, and was unemployed for a while, now he recently just started working, but he has not been paid yet. Right now he is in training and getting a regular income, once he starts working, he will be getting paid a server salary and will be paid on commission. So how can we calculate his annual income???? Just based on the training salary? Or should I just put that he is unemployed?

    Thanks so much for your help! This form makes me want to hire a lawyer, Im so scared to fill out the wrong thing and get denied, unfortunately I cannot afford the fees of a lawyer.

    The reason why I mention the child certificate is, on the instructions it says that if there are mutual children we should attach the birth certificates as proof of our marriage. Our son doesn't need a visa, he was born in the US. What about my husband's birth certificate, does that need to be a certified copy, or just a handmade copy?

    As for the fee, I came to $1435, because of the $70 fee for the affidavit of support? I saw you didn't mention that?

    A few notes: You may want to carfully consider adjustment of status, USCIS will have a BIG QUESTIONS about your intent when using VWP. VWP is NOT intended for IMMIGRATIONS, being married to a US citizen BEFORE entering on VWP is CLEAR intent to immigrate, they can DENY adjustment of status on the grounds of visa fraud.

    If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US.

    The above conditions are serious and can result in the separation of families for many years if not taken seriously.

    The $70 fee is collected by NVC in IMMIGRANT visa cases (CR-1, IR-1 visas) NOT USCIS when adjusting status, processing I-864 is part of the I-485.

    We were not married before the VWP. We got married AFTERWARDS, almost 1,5 years later. We do have a child from before we got married though, but I did not come with the intention to stay and to get married. Marriage took place in the US.

    3) Pro NOT needed:

    About translations, the translator doe not need to be a professional, just someone fluent in English and foreign language, they simply signe the translation "Certifying" it.

    Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

    The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

    5) Upper right expiration date so NOT the form's expiration date. It is the date when USCIS has to complete a survey from Office of Management and Budget to satisfy the paperwork reduction act. Compare the date at the bottom of the form with the acceptable versions noted on USCIS site.

    I am new to this forum.

    I'm from Belgium, the hubby is American. After months and months of obstacles and saving for the fees I am finally ready to send out my package. I just want to make sure I am doing everything the right way. I have a few questions...

    We will be filing:

    I-485

    I-765

    I-864 (twice: one for my husband and one for his mom who will be our joint sponsor)

    I-864A (by my mother-in-law)

    G-325

    I-130

    I-693 (completed by a certified medical doctor)

    1. We have a mutual child (and one on the way), as proof for the I-130, can I send a copy of his birth certificate or does it have to be a certified copy? Someone told me I could just send in a homemade copy and bring the original to the interview. Is that correct?

    2. We have hundreds of photos together as a couple and family, do I have to send them in with this package, or just bring them in on the day of the interview?

    3. I have an annulment of a previous marriage. I have the proof in my foreign language. I assume that it needs to be translated? I read on a couple of websites that I could have someone do it, who is fluent in English, but is not necessary a professional translator. Is this correct?

    4. My MIL will be our joint sponsor, even though we don't live together. Does she have to file both the I-864 and I-864A or only the I-864? And my husband will have to file the I-864 as well, right?

    5. The forms I have printed and filled out, some of them have an expired date in the right top corner, but they are the current forms available online at the official website, is that normal or what do I have to do to get the current ones?

    6. Of all the forms mentioned above, I have a total amount of $1435. Is this correct?
