  1. The N600 document is confusing and hopefully we can get a FAQ added to the visajourney about it, however here is what the n-600insr say.

     

    You can file Form N-600 at any time if you became a U.S. citizen at birth or after birth, but before you turned 18 years of age.  Filing this application is NOT a request to become a U.S. citizen.  Filing this application is ONLY a request to obtain a Certificate of Citizenship which recognizes that you became a citizen on a particular date.
     

    The confusion for most people is the "after birth, but before you turned 18 years of age" where the before you turn 18 years of age applies to the after birth not the "can file Form N-600" at the beginning of the sentence.  In many cases people prefer to obtain the Certificate of Citizenship since it doesn't expire like the passport can.

  2. Im not sure on the timeline for biometrics, but if you got your NOA1 then i wouldnt worry about address changing.. If you are worried you could fill out the change of address form on the USCIS website. I did.

    I was in the same situation, but i already got my biometrics letter. You should have it soon.

    Well that is good and I noticed on other posts that sometimes the biometrics letter will come over 8 weeks later. I just noticed that my daughter's I485 is in Initial Review status while my wife's I485 is still in Accepted status even though I filed them together. The difference is that my daughter doesn't require biometrics. I would have expected them to stay together and have the same status while everything is happening.

  3. After my wife got her K1 Visa and prior to her arriving in the US, I moved to a new house. When I filed the I485 we used the new address on all the documentation however the old K1 documentation would have still show the old address. Is there any reason to file a change of address form if I filed the I-485 with the new address?

    I'm only concerned because it has been over a month and I haven't received anything except the NOA1 for the I485. Website still says accepted, but I was expecting a Biometrics appointment by now.

  4. My friend is at it again wanting to bring his fiancee from Turkey. The first time he started filling out the paperwork he had a court date set for an assault charge by one of his employees. His employee said he consistently pushed her around and hit her when she was working for him. Originally I told him to continue to file because since there was no conviction he could say no on the I-129F Part C #2. However he got cold feet and decided to cancel. The Court convicted him of Third Degree Assault with No Sexual Contact. We are still waiting on his lawyer to let us know what answer he should put in is I-129F, but I wanted to know if anyone else had experience with this. Has anyone had experience with saying yes and still allowed to bring their fiancee over?

  5. When coming over on a K1 visa your best option is to get short term insurance which basically covers for accidents, but not preexisting conditions. After you are married the best option is to get onto your spouses insurance however since your spouse is a student and won't have coverage through work your only option is to get an individual health insurance policy. These have a range to them depending how sick you are, how high your deductible is, and what you want covered. Currently individual health insurance companies will not cover for preexisting conditions and might deny coverage based on living in the USA less than a year. I have seen this happen where the husband owned their own business and their wife couldn't get coverage in an individual plan based the length of time they have lived in the USA.

  6. An Individual Taxpayer Identification Number (ITIN) is a tax processing number issued by the Internal Revenue Service. It is a nine-digit number that always begins with the number 9 and has a range of 70-88 in the fourth and fifth digit, example 9XX-70-XXXX.

    Check your SSN or ITIN to see what the number range is. More than likely it is a SSN and the system hasn't been updated.

  7. Best thing to do is have someone travel with her if you can. Airport does not provide translators.

    Also, how do you guys communicate if she does not speak English?

    Like I said the international flight she is taking typically is 80% Turkish speaking and might meet someone that can help with the customs agent.

    I would travel with her, but I don't have that luxury at this time. I just got back from Turkey at the beginning of the year. I have been told that typically there isn't an issue even non-English speaking people. Which is why I would like to know what people have experienced when being non-English speaking. I haven't heard of anyone being grilled with a K1 visa, but plenty of visitor visa grillings.

    I speak a decent amount of Turkish and we can communicate with the help of communication aids.

  8. So now my mom is flipping out saying that my fiancée is going to get stuck in customs at O'Hare because she doesn't know English. Then even if she does get out she won't know how to get to the next airplane and that no one will help her. Granted I believe that she will find friends on the airplane and get where she needs to be, especially since the flight attendants will be speaking in her language, but just in case I have a question.

    Does anyone have experience of being a non-English speaking person going through O'Hare on a K1 and having to catch a connecting flight? I hear customs is easy, but this doesn't mean a non-English speaking person will have the same experience.

  9. In Colorado the marriage license form has a SSN section however their documentation says if you don't have a SSN you can sign a waver. My recommendation is to get the SSN anyways because you will need it later on for opening joint banking accounts and doing your taxes. There is a great guide on how to get the SSN for K1 visas.

  10. his wife family are trying to kick him out of the house and take the car from him and somehow want him to leave and go back to where he belongs

    I wonder if they are blaming him for her death. This is where a lawyer is going to be important. I don't expect my parents to ever do this to my fiancee, so I would think the relationship between his wife and her family was already troubled.

    Yes, there were a bunch of outside issues causing problems, however I'm happy that our interview is in Ankara. Everyone that I have talked to said that the interviews there are easy. Maybe 1 or 2 questions. I have visited 3 times and she has lots of pictures. I also have 3 reams of paper worth of MSN chats. My last visit was for New Years and we have bus tickets and hotel receipts along with pictures.

    I must be a special case or something, but once the documents left my hands (in April 2009) everything got messed up. My fiancee talked with a friend that was going to help her file everything and they must have decided to walk the papers to the consulate office and drop them off instead of using UPS like I told them. After waiting 3 months for my fiancee to decide something was wrong, I then had her mail everything (including originals) back to me, so I could finish the process and get them mailed in. Documents took 3 months to arrive, the package had been opened, and half of it was missing. New originals had to be created along with new translations. However finally in December I had regathered all the information, had my fiancee send me the documents that were required, and I sent the documents directly to the consulate.

    Oh well, I got to fly to Turkey over New Years. We have more pictures for the consulate.

  13. Is your daughter in the USA? I thought minor children get citizenship along with their parent. or if one parent is a USC then they are USC from birth.

    No, she's in Canada with my wife. As I explained in my post she was born before I became a citizen, which means she wasn't a US citizen at birth. This is why we're going the IR-2 track. But she will become a US citizen automatically upon arrival in the US.

    Then yes you need to complete a DS-230 for her.

    So How do you get her to sign in? It won't be official until it is signed. There isn't a section in that form for parental signature which in the case of a minor they can't be legally bound, so usually there is a parental signature. My fiancee has a 7 year old, who is able to sign, but are the parents supposed to sign for the children?

    I have already checked the website for the interview, but our case number isn't on there. Which is why I believe that the person who was helping didn't do what she said she did. I'm not sure how they sent the documents, but I do understand that the instructions said to use UPS. If you understand Turks then you will understand why they would go to the consulate and drop it off even though the documentation says not to do that. Many times the family has tried to game the system to make things go faster. At this point it has only caused more problems.

    I will be making a phone call to the consulate at 1:30am tonight, so I can get an extention on the Approval Notice stating that the documentation must have been lost and I am working on getting them another set. If this is the case then I will have to just resubmit it with a co-sponsor and DO IT ALL MYSELF.

  15. I had been very happy to see that my visa process was going faster than expected and that the consulate received my documents at the end of March even though I had filed in January. I sent the consulate documents to my fiancee in April after my taxes were filed and I returned from a trip to Turkey. My fiancee was supposed to fill out her 3 forms and put everything together to send to the consulate. This is where everything took a turn.

    My expectation was that my fiance could read and understand the consulate documentation that was in her native language and once she received everything it would be sent via UPS to the consulate. However what happened was a friend of her aunt said that she needed to do other stuff. Then the friend said that they sent the documents. After that she said the interview is next week and said that for 4 weeks while I was trying to convence my fiancee that something was wrong especially when this friend also said that they were waiting for the doctor to call them back to schedule a doctors appointment.

    Anyways, now we are many months later with an NOA2 that says it is only valid until July 10th and I was layed off at the end of May. The consulate said that they will get back to me in 5 days to let me know if they have received my documentation however the last time they wanted the UPS tracking number. Since this friend was the one that sent the documentation in I'm not sure if they used UPS or if they even sent the documentation in.

    My questions are:

    1) Does the NOA2 actually expire, or is that just the expiration before it makes it to the NVC?

    2) If the NOA2 expires does the consulate care?

    3) If the consulate cares that the NOA2 expired how do I extend my time?

    4) Is there a need to worry about a co-sponsor, or will the consulate just believe the documentation I sent? I had a notorized letter from the owner of the company saying I worked there.

    Needless to say this is why I usually do everything myself, but during my trip in March my fiancee convenced me that she understood everything and it wouldn't be a problem. If we get an interview date I expect it to be sometime in October.

  16. Some of you are way out of line. A scammer wouldn't have given as much personal information as I have on her including bank account information especially for only $5,000. A scammer wants to get in and out as quick as possible, take as much money as possible, and leave no trace of who they are. Large scams in excess of $100,000 might have fake IDs, housing, and bank accounts involved, but all of that costs money to setup. Someone like that would loose money trying to scam $5,000 if they did all that prep work.

    This is definitly a case of mis-understanding by the consulate and my fiancee. That is exactly why I first posted here and double checked my other sources to find out why the consulate would have told her that. The consulate was right on what they requested if you were getting a different visa, but for a K1/K3 it isn't neccisary. It is possible that she went to the consulate without an appointment and ended up talking to someone who's whole purpose was to deter people from filing a visa. This would be a simple way to do it.

  17. When I received my 1st letter from Emassy for K3 it says on the DS-2000 (Evidence which may be presented to meet the public charge provisions of the law.

    In the section about Affidavit of support -

    6. An expression of willingness to deposit a bond, if necessary, with the immigration and naturalization service to guarantee that the applicant will not become a public charge.

    DS-2000 is not required by the Turkish consulate. Only the I-134 and I have sufficient information to guarantee that the applicant will not become a public charge. Nothing else on the instructions talk about money except for the $131 processing fee (per person). So since she has a child she will need to deposit $262 into the consulate bank before the interview.

    The only thing that this could possibly be is a mis-understanding.

  18. Find out if she went to the consulate or the embassy.

    US Ankara Consulate is what she said, and probably was whatever was listed on the paperwork which is the Embassy. I won't talk with her again until later this afternoon. She is working and probably crying at the same time.

    There is nothing I can do about it now. I gave her everything I had and she is supposed to take care of the stuff she needs per the documentation on the Embassy website. She just needs to submit it and get an interview date.

  19. So I just got a message from my fiancee and she visited the consultate in Turkey. They told her she needed $5000 in her bank account as a guarantee to get the visa otherwise they won't give one. I don't understand this especially since she is coming here to live off of what I make not off what she has in the bank. Has anyone run into this before?

    Something is NOT right about this. I would find out the name of the official that told her this and verify the information. Then proceed to report that individual to the USCIS. Unless there is something I am unaware of, there has never been that kind of requirement.

    Maybe the consulate was thinking of a different visa and not a K1/K3 visa. It makes sense if you are trying to come to America on a different visa.

  20. I remember seeing a post about someone who tried to come to visit and was denied. The border control told them that the documentation they had didn't matter once they believed they were not planning on leaving. This has more to do with first impressions at the border control. However there are things that will change someones good first impressions into a bad one.

    Return ticket shows intent. If you don't have one then you don't have the intent to go home therefor you intend to stay.

    Remember each border control person is different and will react differently to what you say and some might allow you in without a return ticket. They only need to believe that what she is saying is true and that she intends to leave. If they don't believe her or that she is being deceptive in some way then they will deny her. Timid and shy people will get turned away more often than those who are outgoing.
