  1. Is the first document not a final divorce decree??? What is the difference, why did you think the first one was final?

    I was just assuming because I'm not sure about the legal jargon in spanish and these were the papers that his lawyer provided after having meetings and custody hearings with his lawyer and ex. The first papers explain the who filed for divorce, that she accepted, alimony, custody arrangment, child support, etc.

    We haven't had much luck with Nicaraguan lawyers, so when the second paper arrived, I was not 100% convinced it was not the 'final'.

    it is very similar. and the only thing that has me concerned is that it is described as 'recorded in the books' on Aug 18, 12 days after we filed.

    does that make sense?

  2. we are in the final stages (!!!) getting ready to schedule interview, SO's medical is tomorrow, etc.

    My question is concerning divorce papers. We received what we thought, were the final papers in June 2008 (from Nicaraguan government), then when I went down to Nica in september, SO handed me another document he said were delivered to his house the week earlier. These appeared to be divorce papers, too, dated Aug 18, 2008.

    The problem is, we filed for the K-1 on Aug 6, and received NOA1 on Aug 11, 2008, and we are not sure which is the 'final document' and what, honestly, is the difference between the two.

    I was majorly freaking out the day about this the day before we got the NOA2, but now I have kind of forgotten. Is that something that would make it past the USCIS? (they have only received the first document...)

    We have both documents translated and ready to go for the interview. My lawyer said it shouldn't be a problem, just be honest and explain that we weren't aware that the first document wasnt (if it's not) the final document.

    Any input?

    If you have an approved petition, USCIS has accepted the papers as evidence he was free to marry at the time the petition was filed. The second set of papers cannot possibly help, since they are dated after the petition was filed. Using the second set would get the visa denied. You must both be free to marry on the date the petition is filed.

    ok, good. that's what I was trying to figure out. I was under the impression that if the USCIS gave us an NOA2 it was concluded that he was eligible to marry. So this shouldn't be a problem at the interview, we'll just go with along original papers and not even mention the second. I'm still frankly a little confused where the second set came from, he is too, although the same dates are mentioned as in the original. just the date it 'was recorded' in the books is after we filed...

    and just for anyone debating writing, it's easy, and I would have never thought that this particular senator or his office would be at all concerned with our puny little K-1, let alone be a proponent of immigration.

  6. On Jan 6, 2009, after 148 days since receiving our NOA1, in desperation I wrote both Senator Claire McKaskil (D) and Senator Kit Bond ®. I sent the letters, which where similar (the only difference is in that to Bond, I mentioned being from the same small Missouri town), by both fax and snail mail.

    Jan 7, 2009, I came home from teaching night school to an NOA2 email in my inbox, woohoo!! I felt a little silly for my letters to the senators and made a note to follow up concerning our new status.

    But of couse in the new world of "After NOA2 Approval," I forgot. About a week later, I got an email from McKaskil's office saying they would look into it in 30-60 days.

    On Saturday, Jan 24, 2009, I received two pieces of mail. 1) Letter from NVC and 2) Letter from Kit Bond's office.

    The letter from Bond's office stated that they were happy to inquire about our case and included was the hard copy response sent by CSC USCIS. It was dated, Jan 7, 2009, and stated that our case will be with an adjudicated in 30-45 days and Happy New Year!

    If I made this story too long and drawn out, sorry, I still find it intriguing. Not only did the senator's constituent office act, they acted FAST, within 24 hours of my fax, and as far as I'm concerned it worked!

    We were approved 149 days after our NOA1, 1 day after sending a letter to the senator's constituent offices, and the same day as Senator Bond's office contacted USCIS.

  7. he doesn't need to do 2009 tax until April 2010, he has more then 1 year to find a job....

    okay... soo if we start filing in the next 2 months, it will be okay to show the tax returns from 2008 and hopefully he gets a job and will be able to file taxes for 2009.

    but he did not make enough to reach the poverty line, so we will need a sponsor correct? and both will need to fill out the correct forms?

    if you are planning to file in the next two months you most likely wont need 2009 tax returns. as long as your interview is before April 15, 2010, you will only need 2008.

    We are getting ready for the interview right now, and are NOT using 2008 tax returns, as they are not required until interviews after April 15.

    He needs to make at least 125%* above the poverty line, not just to the poverty line.

    I was a volunteer for the majority of 2007, so I only earned about 2000$ for the year, and although I have been working full time since Jan 2008, I am using a co-sponsor to avoid problems.

    Here's where it gets interesting. I faxed Senator Bond the letter on Jan 6. His office called the USCIS on Jan 7 and received the hard copy respond which was dated Jan 7. When I got home from work on Jan 7, we were approved.

    Maybe coincidence, maybe not. Regardless, all of you still waiting, if you haven't written a letter, do it. at the minimum you feel a little productive in the midst of all the waiting ;)

    you havent passed 180 days? how come it worked? usually they say us to wait for 6 months

    i have no clue. we were at 149 days since NOA1 when I wrote. and were approved 5 months and 1 day after filing.

    I did open with a line about being from the same small town where the senator lives...maybe?

    but honestly, I'm impressed with the fact that 1)they did something, 2) they did something SO quickly and 3) it appears to have worked.

    so it's worth a shot, if you haven't already.

  10. I have a quick question (I hope).

    I just got a new job (!!yay!) and I start on Monday (umm...). Problem is, we are SMACK dab in the middle of interview papers. ie. gathering proof of income, letter from employer etc.

    My lawyer told me that I do not need a letter from current job, just from the new job. Reading previous posts....I'm nervous...Does it need to say how long I have worked at the new job? Because if we are trying to prove longevity, I dont think that will be too impressive.

    Any ideas? suggestions?

  11. This waiting sucks!!!!

    WE ARE APPROVED!!!!!! I was sad all day and then I get home tonight from work and check my box and what did I see a I-797 notice.....weird thing is....I never received any touches and it still states my status is pending.....notice date was January 15,2009........I'm speechless..........

    Congrats!!

    It's nice to finally see VSC do something for aug! maybe malicant is right and the NOA2s will now begin to flow!

  12. I thought I knew what I need as far as taxes...but now I don't....

    if we are using transcripts, which do we need:

    account transcripts

    or

    return transcripts

    and if we are using just the tax return, we need that and the W2, correct? and it needs to be notarized?

    Tomorrow isn't a federal holiday is it?

    Also, is any one else still waiting to be received by NVC? Someone said they were all on one big truck, and if you miss one load you have to get on the next...seems way to simplistic for this process :whistle: helloworld, I want my case to be seatmates with yours on your truck! ;)

    I'm actually not sure where we are. I got a letter from NVC stating that they had received the paperwork from California, and it would go to London within a week..dated the 8th. However, when I call NVC and use the ARU it says it cannot find my receipt number. Who knows... :blink:

    sorry if this is a noob question, but what is ARU?

    I should know this..I work around Call Center folks...ummm.....Automated Response Unit? Something like that.

    oh!!!

    yea, the reason the automated system can't find your number because k-1 are not entered in to the automated system, you have to speak to a live person...

    you would call 603 334-0700 then in the options, choose 1 then 5

    now, I'm getting nervous!!

    I know it's much less time (about 2 weeks), but we are still waiting too. I thought, from reading other people's timelines, that it usually happened in a couple days, a week or less. But when I called they said to expect at least 2 weeks. :(

    I know none of this really helps you with your case, but I just wanted to comment and say that I'm glad there are others out there who didn't get sent rapid fast to NVC, so that i know we aren't abnormal and our case lost somewhere...seems like a pretty constant fear throughout this whole process... :wacko:

    they told me that it would take 2 weeks and up to 90 days for them to get it, call them daily, mines arrived one week later..

    do you talk to an actual representative? or just the enter receipt number and "we have no record of your account" ?

    I've been calling daily, but I've only spoken to an actual person once.

  17. My SO is threatening to ban me from VJ again if I don't stop whining. God help me and VSC too.

    Bill said that too.. while we were waiting, I would whine about the others getting approved or about others visiting by lying at POE and getting away with it. But he should know by now that without VJ, we wouldn't have gotten this far! :P

    you said it, girls! if my SO could figure out a way to ban me from VJ, I think he would do it in a heartbeat. But well said, Gemmie. If it weren't for VJ I think I would still be waiting unproductively, intead of the much more proactive (and slightly psycho :blink: ) approach I've learned here! so thanks all :thumbs:

    And good luck to those still waiting, VSC really does need some encouragement. maybe some love letters or something?

    Thanks Amy&Aldo! And everyone else! I think this is going to shape up to be a good week. Aldready 14 from CSC and 10 from VCS. They are even pretty close!

    Just for those who like to keep the stats straight: we were 5 months and 1 day out from having sent app, 149 days from NOA1, and number 29 on Igor's.

This waiting is wearing me down, nothing from no where, i'm tired of just waiting and not be able to do anything for this visa thing, i was hoping by the end of the last year, i had such big hopes and then big disappointments, i'm tired of waking up everyday with hopes and go to bed at the end with nothing, it is not fair for these people to do this to us, its just not, we are engaged, married, we also have relationships, we need our partners and we cant be with them, i dont want to wait anymore, i have no tears left to cry or something to hope for, i have no appetite to eat or any motivation to go on, i thought i'm strong, i dont like to complain after all i choose this way, i'm trying to stay positive but some days are really dark... :(:cry::(

    you said it all, there's really nothing left for me to add. I just wanted to reply so you don't feel alone. You aren't. :thumbs:
