  1. I have a question: Do both of us, my husband and me need to fill up form G325a? What other forms does he need to provide aside from affidavit of support. We are in the process of compiling all the forms and hopefully we can submit the forms by 2nd week of November.

    Another question, does the affidavit of support need to be notarized?

    No, I don't remember sending both G325A for me and my wife. I submitted mine (i.e. the applicant's G325A) only. Regarding the forms, look very carefully at the instructions of each 'main' form and see which supplemental forms and supporting documents they need. If you decide to file for EAD and/or AP include all desired information as if you're filing them seperately. However, you do not need to submit evidence of concurrent filing and just one check of $1010 is required.

    These are the main ones:

    1) I-485 + I864 (AOS + sponsor)

    2) I-765 (EAD) recommended but not permitted

    3) I-131 (AP) recommended but not permitted

  2. Hi good luck toyou. This is the site of USCIS where you can update your cases. https://egov.uscis.gov/cris/caseStatusSearchDisplay.do Just type in your case number without the dashes. ANd if you want to receive email updates you can register there you'll see it on the left side and register. Aside from receiving email updates you will also be able to see if they TOUCHED your case meaning they updated it and you'll see the date change even without the status of your case being change.     Once you receive your NOA1 that they will send to you in a few days or weeks. You will be able to see your Case number per form that you submitted. SO if you submitted AOS, EAD and AP, there will be different case number assigned to each and that is what you will input in the site. :thumbs:

    Do keep in mind that USCIS has trouble putting their cases online, meaning you might receive an error message while adding your case to your portfolio. Lot of people experience this and usualy it is no problem but can be very nerve wrecking. Keep in mind that as long as you notice USCIS is processing your case (i.e. sending NOA's and FP appointment), you're fine.

    I hope I am one of "those" people who got their EAD and AP after 65th day of NOA1. I've been wishing and hoping everyday for my EAD. maybe on monday if nothing happens, we will be calling them. My hubby's friend who work in NBC told him to contact his congressman if he think the wait is too long. we can still wait one more week. :(

    Indeed strange, your case has similar time line as mine and I got approvals for EAD/AP on Oct 18, received AP on 22th and EAD on 27th. Since you had NOA and FP (i.e. even at the same office in KC) at the same day, you should have gotten it by now. Well, as said before MCI does a terrible job on updating cases online so you might get the white envelopes ijn mail pretty soon.

  4. I sent off my AOS on 25th August, the NOA1 says 26th August. My EAD and I-130 were both touched on 09/04/08.

    I received an RFE for my I-485 on 09/20/08 which i sent back immediately, case was resumed on 10/02/08. No touches since then...

    Should i look at scheduling an infopass appointment in November for the EAD or am i being hasty for it?

    If you don't have it by the VJ predicted date then I would make an Infopass.

    That's mid-December. Damn :(

  5. USCIS hotline does have reps you just have to hit numbers until you get one. Like others have said if you don't have a re-entry permit you have a SERIOUS problem. You should return ASAP and pray you don't get stopped at customs. If they do your green card may be taken away and you sent back to were you where.

    I think you should contact your US embassy/consulate about this. They might find a way for you to reenter the US without problems. Be prepared you might have to apply for a VISA again. (K3 perhaps). If they can't do anything for you, you should return to the US. The sooner the better. There you can try few things. Either be honest and be interogated at the airport or use the VWP. The last option is not preferable as you're not eligible for WVP and officers probably catch you.

    First option worked for me. I was to reenter the country with expired J1 visa. I was eligible to stay in the US as I got a visa extension document. However, I didn't realize I should have gotten a new VISA for reentry. So at the point of entry I had to explain all this and the IO issued me a special waiver so I could enter the US without any consequences and resume my status. It had cost me about 260 dollars, though.

  6. I need someones help with this. my husbands visa expires on Nov. 6th and his AOS w/ EAD was returned with the following letter.......

    B) Your I-485 Application to Register Permanent Resident or Adjust Status is being returned because it must be accompanied by an approval notice for one of the follwing: -A form I-485 Adjustment of Status at least one year after being admitted; as a refugee, granted status as an asylee, or derivative asylum status as the spouse or child of a person granted asylum and eligible to adjust.

    He is here on a K3 visa from England....I dont understand and i dont have time to research this. what did we do wrong and what do i need to do???? please help we are running out of time!!!!!!!![/size]

    Sounds silly, but have you submitted the I-485 form with the packet. Looks like they didn't get it. Also, you need to provide copies of I-94 stating his current status. If you have digital copies of your I-485 check if you filled it out correctly. You might have filled out that he is an asylum seeker.

  7. MCI updates are not reliable!!!:

    Guys, now I'm absolutely certain of something I actually knew before. Because of strange LUD's I had seen before I kind of figured that MCI is messing with updates. I know there were problems before with adding cases to the portfolio but even afterwards, things were strange. On the website the LUD on my EAD case is 09/09/08 with case status pending. Guess what I received in mail today, yes indeed my EAD. So, I would say, if you are after 60 days from filing it is definitely worth checking your mailbox even if you haven't received updates on the USCIS website.

    Received AP in the mail today. Finally registered our info into the USCIS system. Figured it wasn't worth it til now. Didn't want to freak out and check it every damn day. No touch on EAD since 9/5/08! WHAT??? Our AOS was touched more recently, 10/2. Ugh! Hopefully soon.

    They definetely can. I did it too 2 years ago. My passport was about to expire and it was inconvenient time to fly to Europe at the time so contacted nearest Dutch consulate. Drove there, filled out a form and could pick it up a week later. The requirements might be different for Canadian consulate but you should be able to renew it. If you don't get your passport in time, you should at least give it a try is what I guess. Maybe they'll interview you and allow you to come back later when you have your new passport. Call USCIS and try to convince them you're totally surprised by your discovery.

  10. I was just about to start the process but lost my job, I will be getting unemployment, should i still file? or will it be rejected? What should i do?? Im worried it will take to long to find another job, and i feel its wasting time that the forms could be filed, if they check my bank account its still ok? Do they actually call your employer to verify??

    Well, if you haven't filed your application yet, you cannot clame that you have the job you're mentioning on your fincancial support form. So, you have to revise your paperwork. I would recommend you to wait filing till you have found either a new job or sponsor(s) who can sponsor the applicant. If you already have sponsor(s) meeting the income requirement, you can eliminate your share. That is I think the only way that allows you to send immidiately.

  11. hello everyone! i am so happy that i am able to see my AP online and is moving... the EAD sais "card production ordered" wait for 30 days for your card to be mailed to you... oh my God i can't believe it! After almost 2 months of waiting and seeing it always as "case received and pending" til yesterday... When i checked again today, it got touched and the AP sais "notice approval sent"...wow! i am sooooo happy and ready to go home soon... Well, i called USCIS yesterday and request to expedite my AP, she was very polite and asked all my receipt number and then said to wait for 5 days to get it on mail... wow! that was fast! i just expedited my AP through phone and it was a SUCCESS!!! woohoo... so whoever of you their guys waiting for their AP and EAD, don't worry it will come or better yet try to call USCIS and just hope that the representative will be as nice as ours... Good luck to all August filers... 2 down and 1 to go..my AOS which hasn't touched but i understand coz i know it will take 6 months before getting an interview notice if not transferred to CSC...

    First of all, congratulations. But exactly where did you call and how did you substantiate the expedition of your case ? I filed my AOS/AP/EAD package on August 27, had an RFE in the meantime but already got transferred to CSC. However, no news on the (for me most pressuring) AP application yet. The EAD I don't really need as of now, but the AP is important since I want to visit my family as soon as possible.

    Your comments would be greatly appreciated.

    Give it another two weeks and your AP will be approved. It might take another week to get it. I estimate about 3 weeks total when you get it. EAD should just be a week later. But this is just guessing on my part. Since you had RFE things might take a little longer.

  12. Hey guys, I need some advice. I've been waiting for my work permit for about 7 month now due to my 2 R.F.E's. Finally

    my case is with National benefits center. It's been about a month with them, I really don't know how long it will take them

    to process my case. As you guys know you can't even make a drivers license or go to school with out a work permit.

    Me and my wife were wondering If we should contact our congressman in cali to speed up the process? I am on k1 visa.

    I am the petitioner and we have our interview tomorrow. Problem is, I don't have a birth certificate nor proof of citizenship. I am a US citizen through naturalization but that document was stolen/lost awhile ago. The only proof of US citizenship is my passport. will that suffice?

    Passport is the best proof of citizenship you can have. It is even internationally recognized, so yes, you're good to go.

  14. I am happy that more August filers are now approved. I hope to have some news from the USCIS too. Yesterday was my birthday, and I received a sweet and wonderful birthday gift - I found out i am pregnant! I need to find a work soon.

    Guys I got a JOB!!!!!!!!!!! at GAP. I start next week, this Wednesday I got my orientation and next week I begin. Its part time cause thats all they have right now, but at least I can take two part time jobs...(2 paychecks)

  15. We file August 08 - Still no news - waiting, waiting, waiting :)

    Same here. I have the same NOA dates as you have. I expect some updates on our AP and EAD this week.

    Correction. I tried to add my AP case to my portfoilio since it could not be added so far. Tried it once a week or so. Finally, today it was succesfully added as USCIS had updated the status today saying it was approved last Saturday. Nice!! That was the first barrier.

  16. You would think that something as important as a greencard would be sent with tracking.

    You would actually expect them to make an appointment with you to pick it up. In my home country you would never receive government ID's in mail. They call or mail you to pick it up (e.g. post office) and most importantly you have to sign for it before you get it. I can imagine that USCIS offices are not around the corner to everyone but a post office should be within reach.

  17. Suddenly I realize how lucky I was. I had my bio appointment scheduled just before leaving town. Since USCIS office is close to the airport I decided to go to USCIS on the way to airport. I thought I'd taken all the required papers with me (i.e. both NOA's, appointment letter and ID) but while waiting I found out that I-485 was not there. Fortunately, nobody cared about any paper except for the appointment letter and ID so luckely I could catch my flight in time. They didn't like me parking on the employee lot though ;)

  18. Has anyone experienced having their country of birth missing from their EAD card? if so, has it ever caused any problems? I don't want to go through the hassle of fixing such a minute thing if it has never been an issue for someone who's experienced the same...

    I don't think you should worry about it too much. It depends on what you're gonna use your EAD for but I guess you will just use it few times for job interviews. Afterall, you'll probably get your Green card within a few months.

  19. Also, my case is still at the MSC in Missouri. I was wondering which field office it would be transferred to, based on my zip code, closest to my home residence? I saw that for New York NY the processing time for I-485 goes back till OCT 17, 2007?! :wacko: :wacko: GOSH, does this mean it may take upto AN ENTIRE YEAR for this thing to go through if my case gets transfered to the NY office?? :crying:

    Most people get their processing done at MSC or, National Benefits Center as they call it too. If your following K1 route and your case is straight forward (i.e. no difficult things like overstay) it doesn't take that long. Some people get their interviews withing 4 months. In your case it might even that they send it to california (CSC), those cases go even faster and have a big chance of being approved without an interview. If MSC is gonna transfer your case it ussualy happens within the same month after biometrics. In your case it could still happen as you recently got an RFE.

    No, mostly nothing is done to the case until biometrics are done. For lot of people it also will be the first time they can look up their cases online.
