  1. My mother and father inlaw are permanent residents on a 10 year green card here in the usa.

    They have been here in the usa 2 years now.

    They would like to file i130 for the son who will be 21 on October of 2019.

    At what age does uscis determine if he is under 21?

    At the time uscis received the application for i130 or when and if the i130 is approved which will probably be after the sons 21 birthday in October?

    If after age 21 does that mean their son will be on the 15 year waiting list?

  2. Yes the mothers birth certificate was submitted for passport but they require proof of custody from the father but he lives in another country and we are unable to contact him to get a notorized statement from him.

    We are aware that the child became a citizen when her mother was naturalized so we are hopeing that the child no longer need a green card since she is also a citizen automaticly.

  3. My wife became a naturalized citizen in 2015. We would like to file a n600 for her daughter 9 years old but her green card expied 2013. 

    Can her daughter still get a n600 with a expired green card?

    We would like to avoid having to pay almost $600 in fees for i90 and then have to pay $1200 for the n600 and also the wait time for both.

    We cant get a passport because the daughter has a differant father and we are unable to contact him because he lives in another country the passport office was requesting a dna test to prove my wife is the mother and has custody but the dna test is almost $1000.

The parents already passed the interview and have the visa in hand from n2 go carrier service but they can't find any indication of a alien number or DOS case ID number for us to pay the $165 fee for each person online. It says these numbers can be found in the first two rows of the Immigrant Date Summary but they can't find any type of paperwork like that. Is this something we can find online?

    Also does anyone know of a travel fee to pay from Manila international airport of 1600 peso?

    We know there is a airport fee of 550 pesos but never heard of a travel fee as well.

  5. My wife and I are trying to get her parents here on a IR5. Good news is the mom passed the interview but the father has been delayed because he needs to provide a Brunei police clearance for the time he worked there but the problem is we have been waiting 2 months now for the Brunei embassy to obtain the police clearance.

    Since the mom has already passed the interview we called the Visa Center several times in order to release her passport so at least the mom can come ahead while we wait for the father to complete his requirements, at first the Visa center said the mothers passport will be on the way in 1 week and its been 2 months now and we still can't get the mothers passport. Everytime we call they say it's still in process.

    We are so frustrated with the system. We are so close but without any way of telling when the mother can get her passport released.

    So as a last resort we are hoping an attorney in the philippines with knowledge of the IR5 process can expedite or at least speak with the US Embassy staff to get a resolution.

    Also we would like to get the CFO done but not sure if they would need the passport and visa stamp in order to take the CFO. Not sure if they even need a CFO because none of the staff at the interview said anything about it.

    It's been such a long process more that 1 year and so frustrating. The time is ticking on complete this since we only have one year from the time they pass the interview to get the visa to travel to the USA.

    So if any members have any suggestion or can refer us to a attorney in the philippines that can assist us.

  6. My wife is petitioning both her parents for a IR 5 from Manila Embassy to travel to USA. The mom passed the interview along with her dad on Dec. 4,2015. But before the embassy would approve the visa they are asking the dad to provide a 6 year police clearance from Brunei which he traveled to years before to work. So after the interview the dad went to the Brunei Embassy in Manila to try to obtain a police clearance but they said they require a official document from the US Embassy before they would process the request. So the following day the dad went back to the US Embassy to ask for a official document to present but the US Embassy told him they could not give him any paper and to go online ( and gave him a website to call or request a official document. He did call the phone number on the website and they did put in a request to email a document to him but until now almost 3 weeks later there's still no update or email.

    The only information I could find didn't mention of needing any type of official documents.

    We are so frustrated and on the very last step to complete the process to bring her parents here to the USA. It's only me and my wife here to take care of both young children with no other family support so it would be such a huge relief to have her parents here to help incase one of us gets sick.

  7. Thanks for the reply and info. I actually called the USCIS customer service number to ask this question and they are totally useless, they told me that they don't have acess to my file and I need to make a info pass appointment to get the answer. Which would mean I would have to take off work and drive 50 miles to ask a simple question. They seem to only have a very basic scripted list to go by and can't answer this question.

  8. Can somebody tell me which date to go by to file n400. The form ask when my wife became permanate resident and the GC states Resident Since 12/21/2011 but she arrived May 2010 and we got married within the 90 day period in 2010.

    Also she went back to Philippines on vacation for 3 months so are those 3 months subtracted from the Resident Since date which would push the date to March 2012?

  9. Thats my biggist concern is the 1 yr old wont no the birth parents cuz grand parents take care of them. I really need advice from someone who has actually sent the kids to phil. Im sure its happen b4. Or anyone know if its possible to bring the grandma on tourist visa to usa n help us or try a family visa if my wife bcum citizen n usa?

  10. Me and my wife may need to send both our kids a 1 yr. old and 5 yr. old to Philippines to live with my wifes parents for at least 2 yrs or more. We can not make it with my only income and the stress of the kids is taking a emotional toll on both of us. My wife is unable to get a job to help because then we need to pay child care for 2 children. We have NO family here to help us. Me and my wife fight and argue and the stress on my wife is enormous to handle 2 kids on her own. Anyone have or been thru this and what happened in your case?

    the 5 yr old is hers and the 1 yr is thru our marriage. im heart broken of the idea of sending either one of the kids but the stress on my wife being alone to take care of the kids, there has been several times were my wife was so sick could barely get out of bed and i took off from work, im out of sick leave now. the living cost for the kids would be 1/3 of what it cost to raise the kids in usa. my wife is on the verge of nervious, emotional break down. we want to try to get her mom here to usa on touist visa but that seems difficult to obtain for a poor family.

  13. My fiancee..now wife and married on K1 Visa from the Philippines, we also brought her 2 year old daughter on K2 Visa they both recently applied for AOS and awaiting response from USCIS.

    The question is how can I change the last name of my step daughter to follow my last name since I am NOT the birth father and the child does not follow the last name of the mother also.

    For example:

    Mary E. Lee (mother)K1 Visa.

    David Lee (husband) and petitioner.

    Lisa Villano (stepchild) K2 Visa.

    Its quite a difficult situation since the child has a differant last name from both the mother and myself.

    Im thinking ahead in case of schooling and hospitalation and legal documents needed for ID.

    Any help or info is greatly appreciated..Im lost as to which way to go with this.

  14. Great posting. Perhaps it coiuld be pinned so others have a guide to the process. I wasn't aware that we could get a SSN before we marry and get a marriage certificate so that's my next thing to take care of. It's so true that the journey never ends...along with the paper work and forms and fee's we still need to arrange to get a wedding ring, wedding dress, civil wedding, SSN, AOS, medical, etc.

    The guide is very helpful to plan each step as we go long.

  15. My fiancee arrived here in US a month ago with her 2 yo daughter on K1/K2 and I was wondering if I need to apply to adopt the child after my fiancee and I get married? The mother was never married to the father but the child does follow the last name of the father on her birth certificate. If I do need to adopt what government agency do I go to the USA or the Phil government?

    My fiancee and her daugther 2 yo arrived in USA 2 weeks ago on K-1/K2 visa but she told me that the immigration officer kept all the documents in the sealed envelope.

    So we dont have any vacination records or X-Rays to show for a follow up medical for the AOS later.

    From reading the past thread this seem NOT the standard proceedure?

    What can we do now at this point?

    Should we go back to the airport and inquire with the immigration officials?

    It seems were cursed with problem after problem..nothing is going smoothly with our case.

  19. My fiancee and her 2 yo daugther just arrived on K1-K2 a few days ago. Problem now is even I told her to get serveral copies of the NSO authenticated birth certificate for both her and her daugther she arrived without those needed documents in hand. Guess she figured that the packet recieved form 2go and submitted to the custom upon entry would be given back with the required documents inside.

    So here the issue now cuz we can't get married without her birth cerificate and she wont be able to get a SS # also, is it possible to have her father get the authenticated copies from NSO and have them sent to me in the USA?

    The second issue is the child was born out of wedd lock so doesn't carry the mothers last name only the fathers but the mothers name is spelled in the middle part.

    Im praying all turns out well for us and we can get the required documents in time.

    Mostly for the 2 yo cuz she has separation issues and feelings of sadness n lonelyness cuz in the Phil she can walk outside and play with many kids and neighbors at all hours of the day, she feels lonely cuz her extended family is not her, grandma and grand papa.

    We are in the Antioch, CA area and would love to meet anyone within a 60 mile area to hangout with and chaton the phone, if you got young kids that would be a bonus.
