  1. It took me 10 days to get the NSO copy and get t personally over there at the main office in Quezon City. NO I didn't give 100 bucks . I gave 500 pesos ( under the table ) plus seafoods from my province . That's all. Normally it wil take 1 month to get it . If you know someone inside it's easy .

The lawyer NEVER should have promised the CENOMAR. He is completely out-of-the-loop and off-the-grid when it comes to this part of the process. Your attorney only has moderate control of the situation while the annulment is in the district court. Even then, it is preposterous that he would make any promises.

Once the court issues the decision, the OSG (Office of Solicitor General) must take possession of the case, hold it without motion for at least fifteen days, and then move forward with their own decision. Assuming all is well, the OSG returns the decision back to the district court where the court will then hold the case without motion for up to ninety days. Once complete, the court will surrender their official release of decision with other documents. The released documents must then be taken to the LCR (Local Civil Registrar) in the both the region / district where the court resides and where the marriage was officiated and recorded.

Next, the LCR (via private courier) will send their completed paperwork / annotated MC to the NSO / PSA in Manila. Prepare to wait even longer. The NSO is in no hurry to process and record your annulment. Standard waiting time is two to three months (even when expedited). Only when the NSO releases the nationally recorded annotated MC can you apply for the CENOMAR. Generally, the CENOMAR can be in your possession anywhere from three days to two weeks after the NSO process is complete.

We actually had to follow up personally with the NSO. Dyn visited the office in Manila to follow up on the case. A month later, she did the same thing again (a long trip from Bohol but worth the time). The second visit to the NSO yielded bad news. They had lost all paperwork sent to them by the LCR in Bohol and they never had any intentions of notifying Dyn. We would have waited forever had she not gone their and asked. By the grace of God, Dyn had all original documents in her possession, and she handed them over to the clerk and go a receipt. Where are we now? Annotated MC and NSO paperwork is supposed to be complete on 11 April.

If possible, ask your fiance to personally visit the NSO for a followup. Nine months is much too long to wait. PM me for additional details please.

  2. PleAse do not believe everything you hear from other people about what happened to a friend or that they heard about bla bla bla. If I have had a quarter for every time I have heard that on here or from other people I wouldn't have to work. But this is a good place to ask questions. As you know divorce is legal in Pinas only through the sharia court. The CO's know and understand this. If that person was denied then it was for something else entirely.

Thank you for the advice . I love this site that's why I came back after years of inactive membership to make sure I get the right information . All of my sis papers are ready for submission .

  3. As long as the NSO regards her former marriage as terminated, then she'll be OK. If she didn't follow the steps to get the Islamic divorce recognized by the NSO, then she's likely to have trouble. There is a process to get the Islamic divorce recognized with NSO in the Philippines, and the embassy normally will require those steps be completed.

Hello . Thanks a lot for the reply . She already have the annotated copy of divorce from the NSO. I have heard from someone that her friend was denied a visa last year in an interview due to shariah divorce . She was advised to do it through civil court since the consul didn't recognized it .

  4. This is slightly unclear- are you petitioning for your sister? Is a spouse petitioning for her? She has a previous divorce from a man she married in a church. Assuming it was a legally recognized marriage, she will need a legally recognized divorce. If their Islamic divorce is recognized in your country then she is ok, if not then she would need to complete the steps required to obtain a legal divorce.

Thanks for the urgent advice . She undergoes the Islamic divorce and it is recognized in our country. I'm not petitioning for my sister but the guy from DC will get her . I was concerned of denials due to taking the Shariah law and not the Annulment process .

  5. Hello fellow VJ's. I have a quick question regarding the USEM interview . My sister was married in a church wedding in 1998. Now, my worries are does it affect her interview that she is using shariah law (both her and the ex hubby converted to Muslim faith), instead of annulment? Do you know anybody that go through the same path and got denied by the consul? Please I need your advice regarding this issue.

Thanks a lot and God bless.

  8. Sorry guys I post it in another topic the result of my interview. It lasted for 5 minutes and the Immigration officer stamped my passport. He was so nice and no sweat or intimidated of him.. Im under K-3 visa when I enter here and been married for over 2yrs. I might get a 10yrs. GC in the mail within 10 days from my approval.

Thank you to my VJ'ers Family! I will still be around in case other members wants my help.good.gif

  9. I had my interview this morning at 8:15a.m with my husband. The Immigration Officer ( a man on his 40's) who interviewed us was so nice to me. He didn't ask for any of other supporting documents but only asked both of our passports, my parents name, where we married and the date of marriage, how long we were married , any kids, asked about health insurance and if he is still working in a company with the same position and if he owned the house or rented it. I did give him the checklist I prepared for him such as: joint bank account, health and medical insurance copy, utility bill, the 2009 Income tax Return. He really made us feel so welcome especially it's Monday and we were the first couple who were there for the interview. I was a little nervous because I read and heard on VJ some of the terrible experience they went through. VJ friends I went to the bathroom 2x 5 minutes before my scheduled interview..

My interview lasted for 5 minutes only. I was so shocked when he said " You are approved and you will get your greencard in the mail within 10 days". He stamped my passport. I couldn't believe it as it was so fast.

Thank you VJ members for helping me out , cheered me up and some advice you gave me. It worked. I will let you know when the mail comes in if it is a 10yrs. greencard. Good luck to all who are still waiting of thier receipt notice and those who are patiently waiting of thier interview date.

    God bless us all!!!kicking.gifkicking.gifkicking.gifkicking.gifkicking.gifkicking.gif

  10. Yes I been abused no doubts to the point where I told him I will report him to authorities for abuses and after that incident we don't fight at all when he was here for 2 weeks with me . He change a little bit and treating me ok unlike the last few months like a hell for me. This will be my last try of the relationship. I wish hubby is more understanding than you do I stated and even forward him the note of USCIS still insisted . I have no choice but to go try for an appointment eventhough I know it is not possible .. Cruiseship is always there and my interview is one -time.

You have posted a lot of conflicting things regarding your situation/relationship. You have stated that you have been abused by your husband, but yet you are going on a cruise with him and his children... Regardless, a cruise is NOT an emergency situation although you could always try... blink.gif Even if you didn't go on the cruise, your husband would still be required to attend the interview with you.

    Thanks Fatima and Jim.

There's a note at the bottom of the interview notice that says:

YOU MUST APPEAR FOR THIS INTERVIEW-
If an emergency, such as your own illness or a close relative's hospitalization, prevents you from appearing, call the U.S. Citizenship and Immigration Services (USCIS) National Customer Service Center at 1-800-375-5283 as soon as possible. Please be advised that rescheduling will delay processing of application/petition, and may require some steps to be repeated. It may also affect your eligibility for other immigration benefits while this application is pending.

I think that UNLESS you are rescheduling because of an emergency, you should cancel all other plans and appear for the interview appointment already scheduled for you.

    Congratulations!!! biggrin.gif

Yay!!! Congratulations! I hope your son gets his green card soon too!

    Congratulations!!!

  12. I will go to Buffalo tomorrow for an infopass appointment to know more about my situation since this is the last cruiseship of family because kids are moving out going to college next year. I talked to hubby but still wanted me to go to Buffalo to confirm to Immigration and goodness I have to work for 8hrs. tonight (night shift) and will leave immediately after work for a 3hrs. drive to Buffalo, NY. The thing is I already told him before not to set up anything if I dont have my schedule yet but of course Im always second priority aside from his kids. I wont wonder why. I stated on my application alonf with my AP that we have a family cruiseship on that specific date. Hubby wont believe me but wanted me to go for long hours drive as he is not around been on a business trip.

  13. UPDATE:

Good day to all! Just wake up here from a long hours of work last night. I opened the mail box and I got my USCIS initial interview appointment which is scheduled on April 19, 2010 at 8 a.m in Buffalo ,NY. My problem now is cruiseship schedule is already been set and paid from April 17-24 and I dont know if I can set it up at an early date like April 15th?

Any advice or suggestions will be appreciated. Thank you to my VJ members.

  14. Thanks Fatima and Congratulations!!!

QUOTE (belovedbyme @ Mar 11 2010, 02:46 PM) It has been past 2 months since I applied for AOS. Should I call USCIS and what number to call?

Maybe you can call the National Customer Service Center (NCSC): 1-800-375-5283 and try to get a supervisor? The first tier customer representatives only see the same thing we see on the online case status system so you might have better luck if you can get a supervisor on the line.

  15. It will come soon but I-485 mostly has late approval.

Did anyone else get their EAD approved and their travel doc approved later? The EAD was approved but the travel document was just touched
