  1. Ok, Nick+heather I'm just telling here what people said to me today, so just calm down and don't play the bad cop. And the stamp on my I-94 is not valid longer than my visa, they both ended the same day.

    I decided to go to LA and get a appointment so we will see what they say.

    I know that the K1 is not a work visa, I read about the acceptable work authorization evidence. When I was on the phone with USCIS I said that the stamp that I have on my I-94 is not listed on the column A, it is when he asked me to wait, then he asked to his co-workers and said : "Madame, I am positive, you can work if you have this stamp on your I-94 until the date written".

    I read several posts here about this "magic" stamp.

    I arrived at the end of february on a K1 visa. I got married in Vegas at the beginning of march so 2 months ago.

    I have my SS card saying that I can work with DHS authorization. I have a stamp on my I-94 saying "work authorized until 16 august 2009 (which is the end of my K1 visa validity).

    An employer wants to hire me as soon as possible. I read a couple times that now, with this new I-9 the magic stamp is not longer accepted.

    So, I went to the SS office this morning and I asked, and they said "We are 100% positive that you can work".

    Then, I called the USCIS to be 200% sure. I explained everything, and I said that I read the I-9 handbook and that I didn't find the JFK stamp on I-94 on the list of "official authorized documents accepted". The guy checked and said "Madame I'm positive, you can work if you got this stamp even if you didn't receive the EAD yet".

    So, I hope that this post can be helpful for you guys who are in the same situation.

  4. Yeah, it is good to be busy cuz it means that I make money, and euros which is good to spend in the US !

    My husband's boss wants also to hire me for a part time job, I think that I will say yes cuz' even if the job is not very sexy by itself it is the best way for me to go back to France when I want (I told him that I want a month off every 4 months).

    So everything is ok so far, I miss my parents and my friends and I can't believe that I won't see them before september...

    If he has his medical whenthe drug is not in his system anymore he will reply "NO" to this question of course !!!

    If they can't proove it why do you want him to reply something which will put him and his mum in trouble ?

  8. 2008 taxes don't have to be filed until April 17th, so 2007, 2006 and 2005 are sufficient. I won't be filing at all this year since I haven't worked and my cosponsor hasn't filed her 2008 taxes yet, so that's the most current information. That's my understanding, at least!

    Jamie just filed his 2008 taxes so we will send 2008, 2007 and 2006 to be sure...

  9. For those of you beginning or thinking about AOS, here is our cover letter as a reference. This is everything we sent in. We filed for the EAD and AOS at the same time but decided not to apply for AP.

    Nature of the submission: I-485 and I-765 ORIGINAL SUBMISSION

    To Whom It May Concern:

    The following documents are enclosed for my I-485, Application to Register Permanent Residence or Adjust Status and my I-765 Application for Employment Authorization.

    I-485- Application to Register Permanent Residence or Adjust Status

    Contents include:

    -Payment in the amount of $1010

    -I-485 form

    -Copy of U.K. birth certificate

    -Copy of passport page with K-1 nonimmigrant visa

    -Two 2” x 2” passport photographs of applicant

    -Vaccination form DS3025 from UK medical

    -G-325A form

    -Form I-864, Affidavit of Support, completed by spouse

    -Copy of spouse's U.S. birth certificate

    -Copy of spouse/sponsor's tax transcripts for 2007, 2006, 2005

    As mentioned earlier, we did not complete the I863 vaccination form but are having it, along with the TB test results, available in case of an RFE. Neither of us have been married or convicted of any crimes, so if you have been, you may have to submit stuff pertaining to that.

  10. USCIS Update:

    The man on the phone said it's all up to the discretion of the person reviewing our file. He said lately many people have been asked to require the I863 and many have not. Same with the tuberculosis test. He said not to mail anything at all in unless we get a request for it, as it will likely never make it with our case.

    So we'll wait and see!

    For the I-693 stuff. For what I understood, the USCIS has our complete medical file, or is supposed to have it. My doctor in France and the girl at the embassy in Paris told me the same thing : You won't have to do medical in the US because you just did everything that they need. You just have to know that USCIS lose a lot of medical files, so be sure to have all your medical document (Chest Xray + Syphillis results + AIDS results + vaccins record) so you can get a new medical (I think the I-693) in case of.

    So I think that as K1 holder we are not supposed to do the I-693 cuz' they have it in our medical folder, the one we carried in the brown envelope.

    I will put a copy of my vaccins record and a copy of my Tuberculosis and blood results. If I get lucky it is cool, if I'm not I will do the I-693.

  12. Well I kinda gave up on the I-693. I will send a copy of my vaccins form, the one my french doctor gave me. If they still have my medical folder at the USCIS I will be fine. If they want more I will bring this I-693 at the interview. I have to give 1010$ for the AOS so I will wait for the 110$ for the civil surgeon...

    The USCIS website seems pretty clear that the I-693 is needed. Us July filers are likely the first people to suffer from the new requirements they set forth, so even though we've only seen a few RFE's for not having it, it seems like we'll be seeing more. I'll let you know how I get on with Dr. Arnold- $30 isn't bad at all for peace of mind and not risking delays!

    We gave up and mailed everything but the I-693 this evening. We just want to get the EAD asap. We sent in the DS vaccination form from the UK medical in place of the I-693 but we'll be mailing the I-693 separately.

    What did you do about tuberculosis stuff, Juliette?

    I did the chest xray in France as the embassy required for tuberculosis. So I have my Xray here and the sheet which goes with it sayin' "Tuberculosis clear". It is not enough anymore ?

  13. Well, we just got the run around by ANOTHER civil surgeon, and coincidentally the last one in our city. They tried arguing with us that we had to do the full medical exam, even though we showed them the I-693 instructions and specially highlighted the K-1 visa portion. We contested and asked why they'd refuse to operate the way USCIS mandates they do, and the physician said, "We do things our way around here. Go elsewhere." and walked away. We were like, "It's fine. We'll just pay the extra fees and get this over with" but they refused to see us. Needless to say, we're both furious and reported him to the USCIS.

    I highly recommend you guys start reporting these physicians who are refusing to do I-863 the way the government mandates. I think if enough of us started making calls, we'd see more action on this front.

    Anyhow, question for those of you who used Dr. Arnold. Did you have a TB test done? Was it done by a different civil surgeon or just another physician? Did Dr. Arnold transcribe the TB test results, or did you just send in a copy that another physician completed with your AOS forms? We're not sure how TB fits into this.

    I thought AOS was supposed to be easy, but it's quickly turned into a nightmare for us. I'm a full time student and absolutely cannot take a day off of class to drive 3 hours away to try our luck with the other nearest civil surgeons. We're considering mailing off our application without the I-863 (just using the DS form he got in London) and mailing the I-863 later on once we get it back from Dr. Arnold. Does this sound reasonable?

    Sorry for the rant...I'm still shaking with anger.

  14. Ours was good :thumbs: Low key, Nick's fighting off a killer cold. I'm just waiting to catch it... ick! How's everyone else? Any fun-ness besides getting ready for more immigration stuff?

    I'm filing the forms for AOS and Advance parole and work authorization and blablabla... I'm lost and I REALLY don't like to deal with the immigration ! Too scared to make a mistake...

    I'm filing the forms for the AOS. Everything seem to be ok but I have a couple questions :

    I-131 : Part 4 Information about your proposed travel

    Do I have to fil this part as an Advance parole applicant ?

    I-485 : Part 3 Nonimmigrant Visa number

    Is it the number on my K1 visa on the top right "Control number"

    Or is it the red one bottom right
