    When I filled out the I-130 petition for my brother the USCIS did not ask me any question about the reason why I am petitioning my brother. It is his application for C1/D visa (visa for seaman) that asked him the question the reason why I am petitioning him. It is the US Embassy from the Philippines required him to do, not on my part. Thanks for your reply. I really appreciate it.

  2. Thank you very much, Milimelo, for your response. The thing is, his company/agency, wants him to put in his application why I am petitioning him. It is a pain in the butt. As I have said, this is his agency/company's first time to encounter this type of situation. What is your suggestion a reason why I am petitioning him? It seems like it is not enough reason that he is my brother/family. At the time I submitted my petition for him, the form I-130 did not ask me for a reason why I am petitioning him.

  3. Hello Everyone,

    I need your input/information based from your own experience, friend's experience, family's experience. I submitted I-130 petition last year for my brother who lives in the Philippines, but work as a seaman abroad. I am already a U.S. citizen. He is now back in the Philippines and his agency is applying for a C1/D visa. Apparently, it is the first time for his agency to encounter this type of situation that my brother has (a pending I-130 and the same time applying for C1/D). My questions are:

    1) Would it be a problem that he has a pending I-130 petition and his agency/company is applying a C1/D visa for him?

    2) What will be the best reason to put in his application, as his sister, the reason why I petitioned him?

    3) Isn't enough that he is my brother/family the reason why I want him here in the U.S.?

    4) My brother is in the process for submitting his C1/D visa application, but his agency/company needs a good, valid reason why I am petitioning him. What is/are your suggestion(s)? Reason(s) why should I petition a family?

    5) My brother's agency/company is afraid/not sure if they submit his C1/D visa application, U.S. Embassy in the Philippines will deny it because of my pending I-130 petition. Do you think this will be a problem?

    I really appreciate for everyone's advice, suggestions, comment, ideas.

  4. You're fine. Staying out of the Country for more than 6 months breaks the continuous residence stance. You were only outside for 3 weeks, so it will be counted towards your continuous residence and you will have no problems applying for citizenship.

    Also, you aren't naturalized yet. When you got your 10 year GC, you became an unconditional permanent resident. When you get your citizenship that is when you will be naturalized.

    That is correct, 90 days prior to having your GC for 3 years, you can apply for naturalization.

  5. I arrived in United States in November 2008 with a fiancee visa which a month after, we got married with my husband, who is a U.S. citizen. I read somewhere in USCIS that I can apply for a U.S. citizen when I continuously living in the United States for three years or more. Now, this is my situation, I was out of country for three weeks vacation (2 weeks my home country & 1 week Mexico). Is this going to be a problem? Is a vacation counted as living abroad? I really appreciate for all of your response. Thank you! :)

    Additional: I got my 2year temporary greencard in June 2009 and was naturalized/got my 10year greencard in June 2010, and I was advised that I can start applying for my citizenship 90 or 60 days before my three years (June 2012) living in the United States.

  6. I am planning to apply my aunt a Tourist Visa for U.S., what forms should I use from the USCIS website? The I-130 is for the immediate relative e.g. parents and minor children (I am 10 year greencard holder). What documents do I need to submit to support my Aunt for her application? Can I apply here in the U.S.? or does she needs to submit her application at our country? I really appreciate everybody's input. Thank you soo much!

  7. The LPR child will be fine. Do not worry. It's fine for your son to come back in May 2012.

    The LPR child would only run into trouble if the CBP officer makes a preliminary determination that he abandoned his LPR status. With an LPR parent maintaining a US resident, it's a uphill battle for the CBP to make that determination.

    Furthermore, children cannot make the legal decision as to where they will live. That decision belongs with the parents. Does your 13 years old have the legal right to determine his resident??? NO. It's the parents' decision.

    Be careful with travel outside the US. You've done the right thing by coming here for advice.

    Even if the CBP officer determines your son has abandoned his LPR status, he does not have the authority to revoke the green card. At the least an immigration judge has to make that determination. Why go through this when the minor child's parent send him temporarily out of the country?????

  8. I agree with the "you may run into trouble" but I doubt they'd deny entry for a minor LPR on the first absence of less than a year when their LPR parent maintained residence in the US and the child was attending school in their home country.

    I would agree that if the child will continue to go to school abroad then they should obtain a re-entry permit every time they will be out for more than 6 months to avoid future problems.

    THANK YOU ^O^ very much for your positive response. This is the first time my son went to the Philippines, I just stayed in the Philippines for three (3) weeks. I left my son to stay their to let him remember our dialect and appreciate the things he has and to stay grounded and to NOT forget our native language. Again, thank you very much and good luck to you and Anna! By the way, my husband and I met also in the internet :)

  9. Actually I disagree!

    Many people wrongly believe that to keep your green card all you need to do is enter the U.S. at least once a year. The fact is that if you ever leave the U.S. with the intention of making some other country your permanent home, you give up your U.S. residency when you go. The border officials will look at your behavior for signals that your real place of residence is not the United States.

    As a general rule, if you have a green card and leave the United States for more than one year, you may have difficulty reentering the country. That is because the U.S. government feels that an absence of longer than one year indicates a possible abandonment of U.S. residence. Even if you do return before one year, you may run into trouble. To avoid a full-scale inspection, return within six months.

    On the other hand, remaining outside the U.S. for more than one year does not mean you automatically lose your green card. If your absence was intended from the start to be only temporary -- for example, you left for vacation, but had a head injury and forget who you were for a year -- you may be able to argue to keep your permanent resident status. However, you may no longer use your green card as a U.S. entry document. You must have what is known as a reentry permit, or you must apply at a U.S. consulate for a special immigrant visa as a returning resident.

    Your son will most likely be okay if this is the first time but if you repeat this pattern then you can expect that at some point CBP may determine that he isn't maintaining his residence in the US which would become a problem.

  10. Last July 2011, I went with my 12 year old son to the Philippines. Both of us are already 10 year greencard holder. I left my son in the Philippines to go to school there and he will be coming back to the U.S. by May 2012 and at that time he will be 13 years old. My question is: Is there any problem for him coming back in the US? He is only less than a year (11 months) out from the U.S. and I did not apply him a re-entry permit. Now, I am planning to have a my friend bring him back here which she is also a greencard holder. Does anybody here has the same situation? I will be giving my friend who will travel with my son an authorization letter notarized, what other papers do I need to give her? Is the Immigration in the Philippines will stop my son for travelling abroad because he is more than six (6) months staying in the Philippines?

    I badly need your advice, my brother is a marine engineer who has been working abroad for ten years. He is currently in the Philippines right now and is deciding to apply for a U.S. Visa. My question is: Is it advantage that he will inform the U.S. Embassy that his sister (me) is living in the United States and married to a U.S. Citizen? I badly need all your advice.   12. First things first. If she runs into ICE officials she CAN be detained and he'll need to pay the legal feels for all of that, tens of thousands of dollars. She won't be deported but they will say she needs to AOS asap.

    Now that it's been so long she will need to file the I-130 and the I-485 at the same time. She will also need a new FULL medical and that will cost a few hundred dollars. The up side is she'll get a 10 year GC.

    She will also have needed a SSN to file taxes, unless she has an ITIN, because he will have needed to file taxes as married and provided her details.

    His laziness has taken the fee that WOULD have been $1010 (less than that because it was several years ago and MUCH cheaper then) to $1070 for the I-485, $420 for the I-130 and around $200+ for the medical. That's over $600 more than it WAS back when she first arrived. In 3 years he could have put away $10 a week that's $1560... he couldn't even afford that??

    He needs to file the AOS for her soon. True there is no "due date" but it isn't fair at all to her... She could have applied for US citizenship by now :S

    How Does Your Alien Fiancé(e) Obtain Permanent Resident Status?

    Your alien fiancé(e) may apply for conditional permanent resident status after you have entered into a valid marriage to each other within 90 days of your fiancé(e)'s entry into the United States. Your alien spouse should then apply promptly to USCIS for adjustment of status to conditional permanent resident, using Form I-485, Application to Register or Adjust Status.

    How Does Your Spouse Become a Permanent Resident Without Conditions?

    Both you and your conditional permanent resident spouse are required to file a petition, Form I-751, Petition to Remove the Conditions on Residence, during the 90-day period immediately before the second anniversary of the date your alien spouse was granted conditional permanent residence. Children who were admitted as conditional permanent residents with your spouse may be included in the joint petition to remove the conditions.

    The rights, privileges, responsibilities and duties that apply to all other permanent residents apply equally to a conditional permanent resident to file petitions on behalf of qualifying relatives, or to reside permanently in the United States as an immigrant in accordance with the immigration laws.

    Notice

    Failure to file Form I-751, Petition to Remove the Conditions on Residence, will result in termination of permanent residence status and initiation of removal proceedings.

  13. A friend of mine got married before 90 days her K1 Visa will expire BUT they failed to file an Adjustment of Status, what will happen to her? Is she going to be deported? It has been almost three years since she arrived in United States, her husband's reason was that they do not have money yet to pay for the "fees". Until now, my friend does not have a Social Security and because of that she cannot apply for a job. Your answers are very appreciated! Thank you very much!

    Rei, pls update my status. I received my visa last November 24 around 9am. My fiance booked a flight for me November 27 (Thursday) for Las Vegas and I am already here at the same day with my son. My port of entry is Las Vegas, I was checked by the Immigration and let me stay in a room with others who were waiting also. I was even ready for all the questions that they are going to ask about me and my fiance but alas, they did not ask any questions. They took my documents (packet) that I received together with the passport with visas for me and my son. At the time the lady finished checking my dox she called my name and she just gave me the passports without any questions. She just told me that I should get married before 25th of February so I will not be deported :wacko::whistle: At the time I arrived in the McCaran Airport with my son when we got out from the Exit Area there my fiance with his daughter waiting for me with each of them holding a bouqet of flowers.. :blush: :blush: :blush::luv::luv: Right now I am starting with my life with the man I truly loved..

    With regards all of those who are still waiting it is really sure that before this year ends you will have all your visas talaga. Remember what Lorraine/Grace said that they are not anymore accepting appointments / interview this December. God bless to all of you!     16. Then, there is a sewing accessories shop called Bids And Pises - [translation: Beads and Pieces --or-- Bits and Pieces] There are also many signs with either badly chosen or misspelled words but they are usually so entertaining that it would be a mistake to 'correct' them like.......

    17. In a restaurant in Baguio City, the 'summer capital' of the Philippines : ? Wanted: Boy Waitress?

    18. On a highway in Pampanga: ?We Make Modern Antique Furniture?

    19. On the window of a photography shop in Cabanatuan : ?We Shoot You While You Wait?

    20. And on the glass front of a cafe in Panay Avenue in Manila : ?Wanted: Waiter, Cashier, Washier?.

    Some of the notices can even give a wrong impression such as:

    21. A shoe store in Pangasinan which has a sign saying: ?We Sell Imported Robber Shoes? (these could be the 'sneakiest' sneakers);

    22. A rental property sign in Jaro reads: ?House For Rent, Fully Furnaced? (it must really be hot inside)!

    23. Occasionally, one could come across signs that are truly unique - if not altogether odd. City in southern Philippines which said: ? Adults: 1 peso; Child: 50 centavos; Cadavers: fare subject to negotiation? .

    24. European tourists may also be intrigued to discover two competing shops selling hopia (a Chinese pastry) called Holland Hopia and Poland Hopia - which are owned and operated by two local Chinese entrepreneurs, Mr. Ho and Mr. Po respectively - (believe it or not)!

    25. Some folks also 'creatively' redesign English to be more efficient.? The creative confusion between language and culture leads to more than just simple unintentional errors in syntax, but in the adoption of new words, ?says reader Robert Goodfellow who came across a sign ..... House Fersallarend' (house for sale or rent). Why use five words when two will do?

    26. According to Manila businessman, Tonyboy Ongsiako, there is so much wit in the Philippines because? We are a country where a good sense of humor is needed to survive?. We have a 24-hour comedy show here called the government and a huge reserve of comedians made up mostly of politicians and bad actors.

    thank you sooo much minang :) Heyyy malapit na ding sayo and Im very sure of that coz US Embassy are not anymore accepting any appointments and interviews this December. The reason for this is that they will finish all the backlogs and give visas to those who are still pending.
