  1. Everyone in your situation has had a similar situation.... because what you are experiencing is the process...

    You pay but they will not do biometrics on the child... You will need to get the child a new card when she turns 14 and then you will pay for biometrics and then and only then will they actually do it.

    Thanks so much for yur reply. I have constantly been on edge throughout the process because I am anticipating the mistakes that I have heard about and many others here hava had to deal with. Our child did receive a notification that she has been verified as a dependent in the request for removal of conditions of the principal (mother) and this receipt alllows her to remain in the US for one year from the filing date or until a final decision has been made, whichever comes first. I am assuming she will receive a new card when her mother does, if I am understanding the one year thing, and the connection with the final decision on mother. Is the fingerprinting part of biometrics? If so, the child has had her prints taken already and it shows on the card she has now. I have not received fingerprint cards as I have read I should. Should I see this as a problem to be addressed?

    Thanks again for the time you spend here helping others.

  2. 07/09/2011 my wife received her NOA receipt for the I-751 application, and her daughter received a similar I-797C (VERIFICATION OF INCLUSION OF A DEPENDENT), and following that notice was another I-797 stating the date for my wife's biometrics. The child did not receive such notification at this time. Does the biometrics include fingerprinting for the replacement greencard? Even though the child is only eight years old now, the original card did have her fingerprint. I understand children under the age of 14 do not require biometrics, but still, I had to pay for it. UCIS money thing) Just wondering what happens if the child does not have her prints taken as before, and they discover this later.

    Anyone have a similar experience?

  3. Thanks Mari&Ryan;

    The wife is dreadfully afraid of this part going wrong. She has been terrified I think by the many people she has met through work and the eEnglish classes she takes who are also submitting documents through immigration. The last person she spoke to about this told her all their documents were returned to them stating they had not provided enough proof and they advised her to send as much as possible. I have begun assembling our documents, but it seems they are almost the same as two years ago because we h ad already been married for over a year when she received her green card. I added our childs report cards and day care papers but most is pretty much the same. I had the house already so we have not purchased a home, They alrady have my life ins docs showing her as the beneficiary, the utility bills in both names etc. Any suggestions beyond that that I can use to show someone who does not know us that we are as much a family as they are with theirs? I apreciate all your assistance. My wife does not know so much about the people here and how much a comfort and help they have been to me before she was able to arrive here, and how much they still are today. Thank you thank you thank you again. Hope all is well with you.

  4. Hello everyone;

    Sorry I have been away for so long but it has been one fire after another for me to put out. Now I am in the beginnings of the I-751 to remove conditions for the wife and daughter. Thanks to so many here I understand so much more and so much faster than talking to "those who know" he he, and I thank everyone for being here. I had a question on the charges for the both of them. I understand at least one person had money returned to them for biometrics paid for a child under 14, but my question is, do I need to send $505.00 plus $80.00 for each of them? Or $505.00 for the wife plus the biometrics fee for them both even though the daughter is only eight years old. In keeping themselves consistant, this is equally confusing. I hope you are all enjoying life as we are here in Pennsylvania. Thanks for your time.

  5. A friend has been here for four years, adjusted status, but has recently been placed out of work with a young child, and has found it very difficult to make ends meet. She left her husband because it became apparent to her that he was beginning to abuse the child. I have to believe there was at some point, an affidavit of support submitted on her behalf by her husband whom she is now making arrangements to divorce. She has no copies of any documents with the exception of being in possesion of her green card and passport. In seeing how almost destitute she is, I would like to advise her in how to receive the support her husband promised in the affidavit. However at this point I have no idea how to advise her. Does anyone have any ideas or information that i can provide her to guide her to those who can assist her and possibly enforce the I-84 if there was one? I have gone through the immigration process bringing my wife here, but we have always placed importance in maintaining our documents. Unfortunately, she had to leave with no assistance. Any information would be helpful. Thankyou.

  6. Thanks so much everyone. I always get good reliable information here and really good suggestions.

    Tania and I appreciate all the help we receive here. It has made the process a little easier to understand

    and prepare for, not to mention less frustrating. Valery is in school and loves it, Tania looks for work now

    and it seems like life in the movies. Thanks to everyone once again. Now I need to find a box.........

  7. Thanks everyone;

    The interviewer must have been just as everyone said, the drone who had to check on everything he did not know. We have received Perm res cards and EAD and received subsequent ss cards. I thought I would be done with these folks for a year and nine months, but they spelled our child's middle name wrong on her card, so I have to be back on the phone with them.

    The Vaccination Supplement was all I needed and the medical in Kiev was accepted as her medical within the las year.

    I have found the site to be helpful in every respect, especially while we were waiting. Those of you still waiting, hang on. When it finally happens, it sure is wonderful and is certainly worth waiting for.

    Those who have been through AOS I have a question for. Is there anything I should be doing in the coming year to prepare for the 751 to make the experience less frustrating and preparation before the interview less of a fire drill.

    Thanks again

  8. This time it just seemed odd to me. My former wife came on a K-1 and at the AOS interview we were told that a green card would be issued and we should have it in two weeks. It was at the house in one week and we did not have nearly the difficult time with the interviewer. The interviewer explained to my wife that the US government was oblgated to protect US citizens from those outside the country who would marry just to become a US citizen, and he explained it more than once and asked her if this was the case with her, coming dangerously close to accusing her. He seemed to lighten up as the interview went on, but obviously has not been out of the country much because he did not understand Tania's propensity to give her American address in the format she would use in Ukraine which is almost backwards, and to the one who has never seen it or heard of it, almost unintelligable. I understand that procedures change minute by minute with USCIS, but I thought it was a little strange that the interviewer was not more congenial and forthcoming with information for us. I can only wait and hope things go well

  9. Yes, she is K-3 and just received EAD and advanced parole even though she may not need it.

    There was no cost and we may take a trip to Ukraine and I thought it wouldn't hurt to have it even

    though the visa is two years. I just hpe everything goes smooth. I am at the end of my rope aleady

    and I have been down hand over hand for a year and a half now. Bless you people here. There have been

    times when I swear I wouldn't make it without the support and info I got here. Made some good friends too.

    Thanks again HH

  10. Thanks HH;

    I breathe a little easier now and I will probably sleep now, but one more thing odd. I gave him a copy of her I-94 and he wanted to see the original. He stapled the original to the copy and kept it. I did not realize what he had one because I was looking through documents but the wife told me later. Isn't she supposed to keep that in her passport?

  11. AOS interview, went and suppled all the info I could, but at the end of the interview, He told me the Civil Surgeon did not fill out the form complete. The notice of interview told me to bring a vaccination supplement if I had not already sent one, and that I did, but he said we should have had a medical done. I explained that the instructions for the 485 stated that was not needed if she had a medical done within one years time. Her medical for the K-3 visa was in March of this year. He told me that medical was not valid here. I explained it was done at the direction of the State Department and was delivered to Immigration at the POE in a sealed envelope.

    At the end of the interview, he told me we would hear from him in 4-5 weeks time. Does that sound normal to those of you who have been through this recently? I am deathly afraid of a denial for any reason and the resulting ####### I will have to go through afterwards. Just trying to feel easier about this all. If it is denied, can I handle it myself with more evidence or info? I do not knowif I am dealing with someone who actually knows his job.

  12. Gary;

    Thanks for confirming. It is as I thought, and even though I received a denial for my wife's w-7 because the embassy, when certifying her passport copy, only stated the attached document is certified so the IRS denied her ITIN because they did not identify the document attached as her passport copy. Stupid gets worse when they give me 45 days to respond, she is here in 20 days and we go to the local IRS office where they said they would overnight a certified copy of her passport to Texas. I then get a letter that began, "since you failed to respond in 45 days" so I returned to the IRS ofice. Yes, you guessed, all they could tell me is that even though they did what they said they would do, something went wrong and I would have to wait to see how badly my return was ruined and then file an ammended return. Yesterday we received in the mail her OFFICIAL ITIN. Now, I wait for the next display of ignorance. Actually the USCIS CS line was helpful the last time I spoke with them, and it is exactly as you have said before, it depends on who you speak with. Why they allow inexperienced people to give answers to questions from a menu only because they lack the experience to do otherwise though, that is thier mistake I think. It creates more problems and ill feelings toward USCIS than it helps. Thank goodness for the people here. I am told that I can get a SS number for the child being 6 years old and not anywhere near ready to work, if I bring all original documents to the local IRS office. I'll try it and se if it works.

    Thanks again for your reply.

    Joe

  13. Is it possible for my wife who is in the country with a K-3 visa and valid I-94 to have a social security number

    without first having her EAD? Everyone asks for the number she does not have from the bank to the insurance company.

    On another note, on the back of her I-94 it is stamped and hand written K-4 as well as our child. Is it not supposed to

    say K-3 on hers? Is there something I need to do about this? USCIS C/S line could not help with that one.

    I trust the people here even more after one answered my question on the C/S line in a quite sarcastic way "I don't know,

    I have never submitted a form like that before". That one caught me off guard and left me speechless.

    Thanks to all here, and Dan, I almost wish I was going to Kiev with you. My wife is with me but I still enjoyed the city.

    Good Luck.

  14. Gary

    That information comesfrom the USCIS website. I dont understand why they mention this if review by the department of state is not necessary. If I do not need this info, why do they give it to me on the USCIS site?

    I am almpst done with the AOS package and I have come across the vaccination suplement document they request. It is either that or the medical. Does she actually need another medical or are the documents she received in Kiev enough for this purpose? They told her she and our daughter have what they need. I will check that 3025 doc.

    Thanks much

    Honest guys,I wouldnt kid ya. But there is still no information I could find to define this payment and how to make it, nor when this charge began. The link takes me to the state department page ,but could not find any info on this fee. Was thinking of the CS line but haven't got out of work early enough to catch them.

    That answers my next question Brad. The 693. I had it printed and thought about sending it, but was not sure I needed it. Her medical was in April in Kiev. If I do not need it maybe it is best to minimize he paper. Seems it takes longer if there is so much to muddle through. Everyone here has been tops and I hope everyone is doing well.

    And Dan.....................wish you the best of luck.

  16. Brad

    The guides provide me with a lik that sends me back to the page that tells me "although the USCIS does not charge for this document etc etc etc, go the link at the bottom of the page and over again. That is why I posed the question.

    I don't know if you also did the I-131, but I had a question about that too. Part 1 is titled Information about you and then in part 2 that asks for the same information. Is this supposed to be my info?

    The guides have become so filled with information that it is sometimes difficult to find the answer to a question without spending the whole day to answer one line. I am sure you know how many lines there are.

    Thanks for your time

  17. I have been away for a while but my wife and our child are here with me now. It has been a busy time since April but I am trying to get through the AOS documents. Again I am back to trying to decypher the many documents required and now look at the I-485 and accompanying documents required. There is a reference to I-693 and I am not certain that I need it or what is required for additional vaccinations. Can anyone help who has been through this recently?

    Also the $70.00 charge for the State Department review of the I-864, where is that money sent? USCIS site does not tell me.

    Thanks

  18. one other thought would be that the government automtically considers any person for which an affidavit of support has been submitted, a dependant. But then there is the difference duration of the I-134 and 864 that the app does not account for in the question of dependency. If I list her as the one for whom I have signed an AOS for and also as a dependent, will they glance at the form and add the number of dependents to the number of people I have signed an AOS for in the past and over count?

  19. Thanks for the replies. In reading the 864 agaiin, it appears that she must leave the country, become a USC or die. Otherwise the affidavit is in force for 40 work quarters which equates to ten years. Just not sure she is in the country or of her status. I have heard that her green card expired some time ago, but no other info available to me. I don't want to be dishonest or tell them anything I do not know to be true. Was thinking of listing the affidavit as I filed it and noting "possible expired green card", "possiby left the US"

    Any ideas anyone?

  20. Vika says the name of the document is "Довидка про те, що батько дитини записаний зи слив матери". She also says that you can get the document at ЗАГС, the office where births, marriages, and deaths are recorded. Go to the office where her baby was registered. If they don't have the document, they will know where to get it.

    Thanks Brad and Vika. Yes this is the document she has that was obtained at Central Registration, or as everone seems to know it as the "marriage building". Everyone so far seems to be in agreement that this is the document to have and that it will be enough to show there is no father to claim parental rights. Still, you have been through the mill there with documents and I am sure you understand that one document seems to affect another and it all fits together in some way, but the KEV-1 form asks for a court decree, so I am wondering if I should check that box and have them look at this document as the court decree, or if I should leave that blank as well as the other references to parental consent and leave them wondering and searching for a document giving permission. Perhaps the interview will be easier than I envision, but I plan for the worst and hope for the best.

    Thanks again, and congratulations to you both.

  21. The embassy wants a document showing sole custody of our child. When the birth was registered, the mother was alone and made up the name of the father (Ukrainian family law act 135) and used her family name as his last name) She has a document to this effect fron Central Registration. I am not sure this document is enough because the embassy asks for a court order. All the lawyers we asked about this tell us this is not done in Ukraine. This has been going on for months. In addition the wife has a document that shows she recieves a small amount of money evey month as a single mother. Am I worried about nothing?

    Sh has made this name for the father because I am told in Ukraine the fathers name cannot be blank, even if it is ficticious.

    Thanks much to everyone
