  1. Just curious...

You may have already read that I need to get a co-sponsor. (Mumbai K1) That is so totally wrong because I should have qualified with my assets and the overwhelming evidence I provided. My income covers 2 people: thing is its generated from my assets. Problem? Maybe. I have 3 children and I have more than enough to cover them too. (Asset wise)

I am sure that when we do AOS here in the US they will have no problems with my asset-based affidavit. With my former husband it was no problem at all and I had less than I do now. It will be easier just to give them what they want than to try to do anything about it (if that were possible). You'd think they would say 'wow, despite the economy that's great.' Bleh- anyway It's not right and I'm not happy about it.

Otherwise my fiance had no problems, they said his information was well organized, and we have a strong case. For whatever reason he was interviewed by 3 officers. I can give you more detail when I talk to him in depth about it.

  2. I have a quick question... I keep seeing people talk about the last 3 years of tax returns with the I-134... The only thing i found in the USCIS instructions about tax returns were if a person was self employed. Then they needed to submit tax returns... and even then it only asked for the last years return. Am I reading this wrong, or is this stuff asked for somewhere else?

    As of now I have:

    1. The letter from my employer

    2. By Friday I will have the information from my bank

Since I am not self employed do I have to have the tax returns? If I do have to have the tax returns my next question is can I just get a copy of the last 3 years taxes from my accountant and have them notarized or do I have to get the transcripts from the IRS?

It won't be of help to you now, but in case someone else has this question- when my fiance did his interview they were more interested in my tax returns than anything else, and I am not self employed. Since it will vary from consulate to consulate its better to have them.

  3. Briefly, my fiance completed his interview yesterday in Mumbai and all was fine. They did however decide that I need a co-sponsor because despite my assets being more than adequate, even with all the proper evidence, they were not satisfied.

    Now the questions:

1)Do they need me to resubmit the I-134 and supporting docs again along with my co-sponsor?

2)In the box for "relationship to sponsor" what is the best answer when my co-sponsor will be my former husband? Could "none" or "friend" work in this case?

    Thanks.

  4. There's something in there about not using your house if that's your primary residence. They are looking at assets that can be converted into liquid cash at a short notice. Plus, with the housing market tanking, prices of home properties have declined. And the thinking behind is quite reasonable -- I mean you aren't going to be able to sell your house off at a moment's notice to prevent your SO from becoming a burden on the state.

From what I understand, there must be $56,000 in a bank account in the USC's name for it to work. Simple enough if you got the cash.

Find a co-sponsor ASAP and send them the documents they want. Good luck.

What other questions was he asked, if you don't mind sharing? This was in Mumbai, right?

I have well over 5x not counting my house all liquid, that wasn't acceptable. I'll be working on the co-sponsor in the morning, well in a few hours when other people are actually awake.

Yes, it was in Mumbai. They asked him what he planned to do when he got here, how soon we would get married & when & where, they asked several times if we were already married (probably because I lived in India from Oct, 2008 thru July), they asked about my work history. The interview was pretty simple.

  5. Well... I had thought that if you have 3-5x the poverty level @ 125% in assets that was good enough. I have well over 5x plus I own my property and home outright, zero debt. And they still want me to get a co-sponsor. Just what I needed, more time tacked on to this case. If anyone's got any advice or pieces of wisdom I welcome them.

  6. My fiance submitted his documents this week and he felt they were somewhat disorganized. He had to ask at least three times for them to include one of his documents in those that they collected. They also got confused about his BMB number because it was transfered from New Delhi, and misquoted his interview time. On the positive side, they did inform him that he needs to get his passport related PCC. It's good to know what to expect when you go so you can be sure that things get done. Good luck on your upcoming interview!

  7. My fiance was just informed yesterday by email (also the day his interview letter is dated), that his interview will be on Dec. 9th. The soonest he could get a medical appoinment is Monday. This hardly gives him time to get the documents in before 7-10 days. If you don't count Thanksgiving and the weekend (working days) then Then Wednesday (tommorrow!) is day 10 and Monday is day 7.

Regardless of exactly "when" he should submit them it's a little close! So what do you do if you can't submit everything "in time?"

  8. It doesn't matter who your co-sponsor is- related or unrelated as long as they qualify to be one!

In a sort of spin-off of your question I DO wonder what they will think if I use my ex-husband as a co-sponsor. He is now a USC (thanks to me) but he was already here in the U.S. when we married. He's the only person I know who would qualify if it came down to having to get one.

Anyone with an opinion on that?
