In my opinion, if you do respond to NVC regarding CR1, you may have both the options available. If K3 is approved first, your spouse can get here quicker and then go back for the I 130 interview again. You may end up spending some money on airfare, however you save on AOS.

I would say if you get your K3 approved first then go for it.
What if the I-130 is actually disapproved or they ask for more evidence? Now you have a delay. If K3 is denied, you still have the I-130 pending. A couple days delay in 'getting back in line' is still better than getting stuck in AR/AP later.

I received exactly the same NOD from USCIS when my I129F was returned for revocation. They never told us any reason for denial. The embassy even lost the mail and so we never received
the original documents back that were submitted at the time of interview.
Now, after getting married recently I am starting the process all over again. Filed I 130, K3 and now keeping my fingers crossed!

Hi everyone,
I am following the steps mentioned here in the I130 and the K3 guides on VJ for my petitions. The NOA1s received for both the I130 and K3 recently.
My spouse lives outside the US. We failed our K1 attempt this year and now we got married and going I 130/ K3 route.
However, I am a little confused about the next stages:
I do not see the two guides saying anything about the following forms and yet I see people mentioning these stages in their I130 process timelines:
Form DS3032:
Online AOS fee:
Packet IV bill fee
Form DS 230
I am a little confused. Am I missing somehting? Please suggest.

I agree with Master5. I did the same mistake(?) and found out on the forums that the column was supposed to be left blank if you are not applying for AOS and the beneficiary is not in the US.

since Section C Question 22 ask to "Complete the information if your relative is in the United States and will apply for adjustment of status", I did not fill anything in this as my spouse is outside US. Subsection of this ask for "If your relative is not eligible for adjustment of status, consular post". I did not fill this either.
Anyone else who got approved and did not answer Q22 share your experience?
1) Did your case got transferred to NVC or
2) you got RFE to answer this question or
3) your case was approved and retained to adjust status requesting to file I-824 to send to NVC?

I did the same, I left whole question 22 blank for both my cases and I believe this is the correct way to do it if the relative is outside of US and no AOS will be done. Both cases are at NVC right now.

I applied for the I-130 a couple of days ago and I just realized that I left the column 22 (name of
consulate city, country) blank. How do I fix the mistake now? Please let me know.

So do I have to wait till I get NOID or NOIR before filing for K3 or CR1? That may take months.
I was hoping I can file K3/CR1 now and respond to the denial when I get the letter. Just to save some time.

Thanks all for your thoughts on this. I am trying my best to hold the petition there at the consulate. Trying it through
the congressman and also sending them direct emails. I see no response yet and I am not very hopeful.
I am thinking of going back sometime soon and then applying for K3. Hope that gives them ample 'evidence of relationship'...

Okay, I guess I have not been as lucky as most of the folks here.
My fiancee was first given a 221(g) 2 months ago. We provided the documents promptly.
Now the Mumbai consulate emails me saying that my petition is being sent back to the USCIS
for re-examination and for possible revocation. I checked with some attorneys and looks like
I have no other option but to start the process all over again.
Checked with the DOS a couple days back and they did confirm that it was being sent
back. However, when I called back again today, I am told the case is in 'Admin Processing'.
So, I am not sure what to make out of it. Will appreciate if anybody has any idea..?

K3 NOA1 8/13/09 . Both the petitions approved (NOA2) yesterday 9/22/09 at CSC.
