  1. My wife's CR1 visa was approved in Mumbai on 27th Jan. The process took almost all day. She was in 7:30 am and out at 4 pm. I was waiting outside

    the building all this time and was not allowed inside as I had thought earlier. No communications , as no mobile phones were allowed inside.

    Here I try to summarize the interview and hope it will help those waiting for CR1 interview especially in Mumbai:

    - Fingerprinting done and then asked to wait in the immigrant visa section row

    - Who is the petitioner?

    - Date of marriage?

    About 40 minutes later second interview:

    - Husband's name? Job nature? Present company? Previous job? (they were helpful though, when she could not remember my previous company name..)

    - Why not married in India last time? (our k1 visa attempt was unsuccessful last year)

    Then asked for the family photo album. They just took a look at the bulky telephone calls folder but never looked inside. They did not go through the

    snail mails/ greeting cards bunch either. However they went through the couple of emails that we had exchanged.

    There were extensive questions on the family photo album though. She was asked to point and tell the names. Asked to point out the different ceremony pictures in the wedding section ( kanyadan, phere etc, ours was Arya samaj wedding). Looked at the honeymoon pictures and were satisfied.

    They however did not consider the hotel receipt as evidence which had only my name on it. So, please remember to include both yours and your spouse's name on any hotel receipts. The travel tickets with both our names on them , were helpful.

    She was asked to go back and wait again. After about 40 minutes she was called back and was told that her visa was approved. I was told, she

    could not hear anything what they said after this since she was screaming and jumping.... :) .

    They sent the passport by blue dart courier which reached the destination within 24 hours with the much awaited visa (a real one !) stamped in it.

  2. 1. Besides the NVC letter, the consulate also sends a letter to your address. If you have not received it, you can email them to send you a PDF copy

    and you can print it.

    2. The VFS asks us to do as the packet 4 says, which is to submit the evidence to the VFS. However, I see postings here where VFS told them to carry the evidence to the interview.

    3. As far as I know, No.

  3. I heard Mumbai consulate does allow you to get inside the building. They may or may not interview you,but I do hope it creates positive

    impression in favor of your fiancee. Not sure about Delhi embassy if they let you in. I got similar terse letter of denial saying 'expiration of validity'

    period. However I did not wait for the letter.Once I knew the petition was sent back for revocation, I went back and got married and now going CR1

    route. Hope everything works out well in your case. I would say, do give it a thought about going back, getting married and filing a new petition vs

    waiting for them to reaffirm the old one. Good luck.

  4. As far as I know, they do not respond anything other than the inquiries on the interview schedules.

    They never responded to my queries as well when we got the 221g on our K1 petition. Could not get anyone to talk to

    on that line either. Even though we provided all the documents mentioned in 221g, the case was sent back for

    revocation. I hope that does not happen in your case. Still, do provide them with all the documents they want at your

    earliest and try your best to keep your application there in the Consulate.

  5. I recieved the Packet-4 appointment letter from NVC last week in mail, but my wife didn't recieve anything in mail yet.

    We both recieved the appontment letter in email though.

    Question:

    Can she print the appointment letter and show it for the medical or does she need the letter that comes in mail?

    Isn't email and the snail mail have same appointment letter?

    When can she expect to get the appointment letter in mail?

    Inzango, I emailed the same question to the Mumbai embassy and their response was my wife can print the

    letter and can go ahead for scheduling the medicals herself. I do not think there will be any snail mail appointment letter

    once we received the same in email. Here it is:

    ---

    You may proceed for your medical examination to the listed panel physicians, with the appointment letter you received from NVC. You may also submit all your documents to VFS as per the instructions with the same letter. If you have already submitted the originals to NVC, then you may submit Xerox copies of all documents to VFS.

  6. No, I did not wait for NOD before communicating. I tried getting my Congressman involved to hold the petition right there in Mumbai after the 221(g) was

    issued. However that did not work out. NVC/USCIS/DOS still have not told me any reason. The Embassy sends the same email everytime to contact the

    USCIS and USCIS/DOS ask me to contact the Embassy. I do not think I will ever get the answer. However I feel the official reason might be the 'lack of

    evidence' as they usually do in such cases. Hopefully our getting married and filing CR1 this time will overcome their suspicion.

    Here is the email I got from CO on 6/3 :

    " We are in the process of returning your petition I-129F to the U.S. Citizenship and Immigration Services (USCIS), for review and possible revocation.

    If an officer develops information at the interview that was not available to the adjudicating immigration officer at the time of petition approval, the

    petition may be returned to t he USCIS for re-examination. "

    and the NOD was mailed on 8/17. Since the CO had already decided to send the case back and the Congressman was not able to stop it either, I

    simply waited for the letter.As you see there is hardly anything to respond in the letter. In my opinion, re-affirmation of K1 may take same or even longer

    time than the whole CR1 process. Kaushalia is right, CR1 does not expire like K1 and carries more weight. So, following the CR1 route would not be a bad

    idea. Just remember to respond if you do get any NOID (letter with reason for denial).

  7. In my case, the K1 was not issued and a 221(g) was handed over to her. The consulate returned the case to USCIS despite our submitting all the

    documents mentioned in 221(g). Then I made another trip, got married and filed CR1. Almost the same time, the USCIS sends NOD (Notice of

    decision) to me about K1, telling the case is concluded since the validation period of 4 months expired.

    ( ...."The petition has been returned to USCIS with a finding that the beneficiary was not issued the requested K1 visa.Since the period of validity has now expired the petition will not be revalidated Therefore in accordance with 8 CFR 214.2(k)(5), all USCIS action on this petition is concluded

    as of the date of this notice. However the petitioner may choose to file a new Form 129 F ....." )

    There was no reason for denial and the word 'denial' itself is not mentioned anywhere. I was not asked to respond either. I communicated with the

    embassy, USCIS and DOS but no one could give any reason why the file was returned or what were the CO's comment on it.

    I understand it may raise a red flag when you do not overcome the reason for denial and file a CR1. However, when the K1 case is simply concluded, I see no reason why one should not get married immediately and file CR1.

  8. That makes sense, imaisha. The Mumbai embassy confrmed in email what you said, that is if they receive both the K3 and CR1 then they will only schedule the CR1 interview. I just called the NVC and I am assigned a case# for K3 , however no case# assigned for the CR1 yet. So I guess probably the K3 interview will take place ahead of the CR1 interview if the CR1 is still at NVC by that time. If not then maybe I will be able to switch the K3 interview date for the CR1.
