  1. No one is lying or pretending to be someone, I am familiar with his entire situation for a long time, and just as a person may say "you" in a sentence, implaying any 3rd party, same here as "we met" or I referring to poster.

    I dont think this is "Hilarious" or funny, there are people here in need looking for help, support, guidance.

    You are mentioning follow I-129f , If he follow, only think he have to mention is the name and date of prior marriages, and the letter how we met, they are just looking to see if we met in the past 2 years. Well there is a big event took place. infidelity, how that supposed to be submitted or is this out of their guideline.

    While some Consulates frown on age gaps and previous marriages,

    as others have said, they don't deny people because of infidelity. They do care that he's currently married.

    He can't petition for an I-129f until he's divorced. They do care that he will need sufficient income to support you.

    They also care that you have met in the last 2 years...I think your little bundle of joy (or their birth certificate) will be pretty damned good proof that you two have "met". :D

    NOW...while things aren't going well for him at home, make sure he doesn't make things any worse while he's trying to get out of the marriage.

    He needs to get out clean. If there's any domestic violence, or orders of protection, that could be cause for petition denial.

    The USA doesn't want you coming here and getting into a dangerous situation. The USA doesn't want to help import victims.

    You'll find that most VJers are very intelligent, open minded, people who understand the complexities of life and relationships.

    We understand that ####### happens, and that beautiful unexpected things happen, like falling in love with someone in a distant country.

    We just hope and pray that after all this hard work, ####### doesn't happen to any of us, and that we can live happily ever after.

    4) No vaccinations required for K visa

    Regarding question #3 they may say she have lived most of her life in Samarkand, so, go there and get a police report. I am not sure the the US Embassy in Tashkent mentions an address for police report, I am trying to figure out if this department responsible for police report in Taskent is for Tashkent resident only or overall Uzbekitsan citizens.

  3. We all know what the law says about filing within 2 years of a prior K-1 filing. The unfortunate truth is that the USCIS is interpreting the law to read if you file two or more petitions, then you need a waiver. My advice would be to include a waiver with this application. If everything from your first application is finished and he/she has moved on, well then what have you got to lose.

    I would be very concise and truthful in your explanation with names, identification numbers and dates. It seems that those requesting waivers seem to get approval with very few denials. Sure, you technically don't need a waiver, but why risk further delay if someone at USCIS decides you need a waiver.

    Maybe initially but it appears that they are not anymore... I have two petitions and no waiver requested or required....

    However, putting in a waiver request that may not be needed doesn't harm you.

    First petition in April 2004. Second petition in November 2006. No waiver requested.

    It can be as simple as "Based on my facts, circumstances and my understanding of the law, I do not believe I am subject to the provisions contained in IMBRA as it relates to the multiple petition filing limitation. However, I hereby request a waiver of the IMBRA multiple petition filing limitation, if applicable".

    Thanks, I am doing is including the memo from Mr. Michael Aytes – IMBRA, section II B. FILLINIG LIMITATION. and briefly explained the first petition and the 2nd CURRENT petition details, and added the wording similar to your at the end.

    1. USC filled for I-129F in 2002 Beneficiary receive CR card in 2005, and Permanent card in Dec, 2007. currently unmarried

    I am planning to file I-129f for another person, DO I NEED IMBRA Waiver? I have only filed for one I-129F for the above mention person, and this would make second.

    .A July 21st, 2006 memorandum by Michael Aytes(emphasis added), states:

    "B. Filing Limitations

    IMBRA imposes limitations on the number of petitions a petitioner for a K nonimmigrant visa for an alien fiancé(e) (K-1) may file or have approved without seeking a waiver of the application of those limitations. If the petitioner has filed two or more K-1 visa petitions at any time in the past, or previously had a K-1 visa petition approved within two years prior to the filing of the current petition, the petitioner must request a waiver. These limitations do not apply to petitioners for a K nonimmigrant visa for an alien spouse (K-3)."

    For Us in Uzbekistan it has been ***. Evrything went through smooth here in US and after the embassy got out packet in Uzbekistan it has been frustrating. The Interview was scheduled and before my fiance even met the Consular something was wrong with my Documents, I sent a certified copy of my divorce to my fiance with all the proper papers , but this was not good enough, They want ORIGINAL. So I send her my original for 106 Dollars using DHL 4 day service, Well she gets the documents just in time, She goes to her appointment on Tuesday at 8AM , she said there must have been 10 other people that had the same appointment , So 3 hours later she gets called in and the 2 Lady consulars drilled her like she was a criminal. How she met me? Did she love me? Why you Love me? Why my divorce? Why I want a youger wife? Dont get me wrong, My fiance is the most beautiful russian I have every seen and is much prettier and attentive to me than any woman I have every met, The Embassy continued to ask WHY ? WHY ? WHY ? then after all of these question, The lawyer documents were not right, This lawyer writes documents all the time for Ladies that go to the embassy, The embassy thinks that my Fiance wrote the release of her child to come to the US, This document is Stamped, sealed and signed, SO now they embassy wants the father to appear in person At the embassy for PROOF!. these consulars are so wrong. I have called many hundred times, but the line is busy , I send emails but they are not answered, I send faxes and they are not replied to. This is the embassy from hell. I id not know what the embassies do but I am sure my taxe dollars could get compitent people to do the interviewing a lot better than these 2 lady consulars. The man consular from all the ladies experence say that he is great, He knows the needs and aslk all questions with respect to the people he talks to. So from July 17 2006, when I went to meet My fiance for the first time, till now has been a very long process and it appears this embassy is not going to get any kind or cordination . Just remember everything in Uzbekistan cost twice the cost here in the us for services that are free here in US.

    1. What translation service you used, do you have the phone, address and prices?and were they able to give you certification similar to this?

    The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

    Certification by Translator

    I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

    Signature_________________________________

    Date Typed Name

    Address

    2. What method US Embassy in Tashkent uses to deliver the package, DHL? And do the courier company call prior to delivering?

    3. Police Certificate 16 years and older from all place lived more than 6 months. If finance lived in Samarkand live all her life and has sister in Tashkent, and willing to live in Tashkent, so it will be easy for courier and paperwork, would that cause any problems (I guess she doesn't have to get a police report from Tashkent if she has stayed there less than 6 month prior to the interview.). Where would she go to get police report?

    US Embassy website mentions:

    Police certificate(s): from each place an alien relative lived longer than 6 months since turning 16, with a translation. Uzbek citizens should apply for a police certificate at the Information Center at the Ministry of Internal Affairs of Uzbekistan, address: #1, Radjabi Street, Tashkent. Receiving hours: Tuesday and Thursday 3-4 p.m.

    Above address is only for Tashkent or all Uzbekistan centrally located? What is the timeframe and cost?

    4, Fiance' need all immunization for interview? or at medical check up?

    5. How were the staff at Tashkent International Medical Clinic (TIMC).
