Great News and a Happy Anniversary to us!!!

We had a really good interview, and it went really smooth. But the best news of the day was that the decision was not made today, but will be made tomorrow. The agent was nice enough to look into this matter for us and we are thankful for it. Do you want to know why? Well its a long story and we will keep it short. But we may be helpful to a lot of people in the process later on.

Take a close look at our timeline, if you notice that my wife entered the U.S. on March 21, 2009. And the key here is, that we got married on June 17, 2009. That means that tomorrow is our anniversary. And we got a good anniversary present today. After my wife arrived, I was laid off from a very good job. We were ready to file AOS but we delayed the process until now due to we did not know if we would be able to pass the income requirements. I did not get back to a good income like I had before until August 2010. We thought that there would be penalties for waiting so long to file the AOS. We married within the 90 days after my wife's arrival though. This was important in todays interview, because the agent did inform us that her decision would most likely be approved, but that she would allow her decision to be made tomorrow so that she would have no conditions on her status.

Anyway other than that the interview went smooth.

We had our interview at the local office in San Jose, CA on Monterey Rd. It is about 7 minutes drive from our home. We arrived at 9:55a, our appt was at 10:15a. We went as a family (my wife, 18 yr old daughter, 15 month old son and myself) so this took us a while to get in through the security (like an airport). Not many people were around. No long lines, and most of the waiting rooms were empty. We went upstairs to the 2nd floor, by elevator, and went to RM. 200 and put our interview letter in a window labeled "Appointment Letters". Minutes later we could see someone grabbing our letter. Then at about 10:15a a lady agent comes out and calls one applicant (who was with her husband) who is also a member here on VJ (my wife and her have been talking), and the lady agent also called my wife's name as well. The agent escorted all of us to another room (RM 219), and asked my wife and I to have a seat, and she then took the other couple in for their interview. They came out (with smiles of course ) at about 10:45a. At 10:50a we were called by the same agent. We were immediately sworn in. Then she asked some basic questions to check off on her sheet. She asked for some original documents like the my son's birth certificate, our marriage certificate, my wife's birth certificate, and her late husbands death certificate. This is when she asked told us that she would consider making her decision tomorrow rather than today so that there would be no conditions.

After we discussed that she asked my wife if there were any health issues. She then asked a range of legal questions (about 10-12 questions). Have you committed a crime?...Are you a part of a communist party??...Do you want to blow up America...etc. As my wife said no to all, the agent checked off her form. She then asked "Is there any other evidence you have for me?" We handed her many things:

1. Bank Statements

2. Car Insurance

3. Health Insurance

4. Lease Agreement

5. Costco Membership

6. Photos

7. I mentioned we own a car together

Then we looked at the agent and she looked like this So we slowed down, but we had much more to pile up on her desk if she needed it. She then looked through our pics. She smiled and said my son looks like me. She then asked if she could keep some of our pics, and we gave her the ones she wanted plus ones that we picked out for her....lol. She then said she would make her decision and we should hear something soon. We thanked her more than once, and we were on our way at 11:15a. Our appointment took about 25 minutes. And it was easy. There were no problems or anything to be concerned about, and we are happy to be able to skip a step. All and all, its been a great Anniversary present.

Well tomorrow is our big day...we will be sure to come online and provide all the details of our interview tomorrow morning.

Received EAD card in the mail today...wow..more and more great news! This process is so much more fun than the K1 process...

We have received many emails the last few days on the I-765 and I131. They are both approved. But the big one is that we received our appt letter yesterday and our interview is on June 16. Our anniversary is June 17. Then we received a touch on the I-485 today updated to 05/17/2011. Things seem to be moving along for everybody.

Got an email and text this morning that the I131 (Travel Document) was approved and the I765 (Employment Authorization) ordered production of my new card. This is all great news, but both of these rely on an approved I485 with the green card. :thumbs:

Biometric is 05/04/2011

We received 2 things today:

First of all this morning we called USCIS to get the receipt # for the I-130 Petition we filed. The check was cashed on Friday but we did not get any text or email so we checked on it and was able to get the receipt #.

Then the biometric appt letter came in the mail today...the appt is on May 25th but we will do a walk-in this week anyway.

So things seem to be moving right along.

We just noticed today that our check was cashed for our son's petition (I-130. He is 13 yrs old, so everything is moving right along for us now. I assume almost every week we will see some changes. :yes:

We just recieved an email for our NOA. 3 NOA's. Thanks God!!! :dance:

Thanks!! What about the govt shutdown? Will this affect our applications?

My husband called USCIS this morning they said that they will be there working during the shutdown, so thats a relief it means everything is moving yet we need to be patience:)

Lol....thanks beppo....needed the laugh when I saw that....and you just might be onto something there...maybe those who work in the office even dread this time of the year and we all did not know better.....now the hard part is not to spend all that extra money we still see sitting in our bank account waiting on them to pick up the files.....

Our packet was send overnight on 03/10/2011 and so it arrived on 03/11/2011 and nothing yet on our part!

Crossing our fingers for some news this week.

I did run to another member who send her packet on 02/28/2011 and did not receive any news until 03/22/2011. I'm hoping that is not our case but keeps pointing to that direction...

Well everyone should not feel alone out there, we have not heard anything yet either. But we will be sure to come here to VJ and let everyone know when we do. I think the good news for us is that no one has received their packet back in the mail yet.

Just trying to get a straight answer on a debate on an other forum.

I came over on an approved K1, married within 90 days but only now AOS 2 years later since we married,I'm I classed as here illegaly, on an overstay or out of status?

For financial reasons we didn't get round to AOS after we married. We were going to send all the paper work about 2-3 months ago but was advised by some VJ member to hold of untill we were 2 years married then file the I-485 and I-130 (to get the 10 years green card)

I have also just been told today by a VJ member not to send in the 1-130 travel document as I can't travel until my green card is approved. Is this correct?

You can send in your I-130, and I-765 with your I-485. But you should not travel with the AP until you have your GC...I think people are thinking you will travel without your GC? Were you planning on traveling before you got your GC? I did not see you say that...What I see you asking is that you want to know if its ok to file all of these documents concurrently. Correct?

The answer to that is yes. But you should not travel until you get your GC.

What? No-one said they wouldn't be approved... I think the issue is you think the I-131 and I-130 are the same thing... the I-131 is the travel document and she is can't use it because of her overstay. Her overstay is forgiven when her AOS is approved (based on marriage to a USC). She is perfectly eligible to adjust status and given any unforeseen issues she shouldn't have any issues. No-one said she would.. with her AOS that is, but everyone else here except for you knows that we were talking about the I-131, not the I-130.

I have not said anything about an I-130, I just filed one for my stepson...what is y our problem??? Why would anyone attempt to do an I-131 when they know they need to do the AOS first or concurrently???

She can file, as I am right now, file the I-130, I-131 and the I-765 concurrently with the I-485.

Mykuls Merry Ann, Please refrain from posting this incorrect information. Your posts are incorrect, not entirely, just misinterpretation, and could cause severe issues for many people.

You are obviously incredibly confused about the terms of the K1, and the I-94 and AOS.

1. Someone who DOESN'T marry in the 90 days and instead returns home, would, in YOUR definition, be violating the terms of her visa. This is incorrect. The K1 visa permits you the enter the US for the purposes of marrying their USC petitioner. If you don't, it's not a problem.

2. As soon as you arrive in the US on the K1, the K1 is dead. Your ENTRY status was k1, but your period of authorised stay is determined by the I-94, which expires 90 days after entry. Using your example, someone who enters on a work visa isn't violating the terms of their visa by continuing to work after it expires (after all their visa allowed them to work). This of course is ridiculous and incorrect.

3. The terms of the K1 do NOT include marrying in 90 days, in order to AOS BASED on the K1 you need to marry in the 90 days, this is an AOS requirement, not K1 requirement. You can STILL marry AFTER the 90 days however you would need to file an I-130. If we use your definition the person marrying AFTER 90 days has violated the terms of their visa. That's incorrect.

4. The terms of the K1 include ONLY marrying the petitioner and the petitioner only. If someone entered on a K1 and married someone else other than their petitioner they would not be permitted to AOS. They would need to leave the country and file for a new visa (CR-1 or IR-1 depending on the length of the marriage).

The OP did NOT violate the terms of her visa (because she married her USC petitioner), but she DID overstay and she is now out-of-status. She is NOT illegal because she did NOT enter illegally. She is an overstay. She can still be detained by ICE officials however the Immigration Judge would tell her to immediately file AOS... this isn't because of her K1, it's because as the spouse of a USC she is given the benefit to AOS if she can. However my previous caveat re original petitioner of course matters.

In short though - the OP is deportable because she is out of status BUT because she is married to a USC she will typically (it isn't a given, but it happens usually) be given the chance to AOS. While many people have AOSed after the I-94 expired (myself being one of them) you ARE out of status. You ARE able to be locked up in detention and you ARE able to get the many thousands of dollars in legal fees etc. Please do not go around saying "it's no big deal" because it very well can be and HAS been for a few people on here who've been unlucky enough to be caught by ICE.
