Hello Everyone
Just a quick question, please be patient for those who know this question as been asked a million times before. Applied for 1-485 and we got a appointment for Bometics on 02/16/10 and our appointment for that is March 8, 2010. Just got an email today stating our case has been transfered to the California Servie Center for processing. We did not even have our interview (no appointment yet) and our Bometics have not been done yet?? Is this normal?

Yes, because the I-134 is not used for adjusting status. Your question indicates you have not yet studied the AOS guide or I-485 form instructions. To do so is critical to your ultimate success.
As you have stated, I have not gone through everything yet. I took my first look tonight and began to read the requirements. I understand how important it is to gain all the facts prior to filing, so don't worry. I just sat the form down from reading it and walked away with this question. Thanks for your help.

Yes you will need to fill out the I 864 as the I -134 only required 100% of poverty and the I-864 need 125%. So you will have to show more money than before . I am not sure about the details of using a child's income but I am sure someone will know. Are you back at work ? If so you should be able to argue that it was a temporary condition. You can also use assets if you have any. They must be fairly liquid to be considered.

Hey Everyone
Been a while since I have been here but its that time to prepare for our next steps in our journey. We need to get that tempory green card and I have a few questions. If someone could help it would appreciate it.
Just wanting to know something. We will be filing to get our tempoary green card which requires the I-864. Our I-134 has not expired as of yet and I was the sole sponsor. Do I have to complete the I-864 since the I-134 has not expired? I am worried because I did not work for 4 months last year due to a injury and income is lot less then I made through wages when I file the initial I-134 I filed.
If my minor children have income and I want to use this, what do I do. Both of my children are disabled and the income comes in my name for them. I have stubs but this income is not taxable so its not on my tax return.
I just want to make sure we have covered everything, just in case I need to get another sponsor.

Have question. My husband came to the US on a K-1 and we were under the impression that when he got his social security number he could work. Well, today at his job he was told he needed a EAD. Please can some help us with the process outline to get on and let us know any other helpful information you may have.

Gabriel went for his interview this morning and said everything was wonderful.I was worried because this weekend I received an e-mail from the Consulate that said that Gabriel's interview date is August 20th and it referred me to the Packet 3 attached to the e-mail and said Gabriel should contact the medical provider they listed to get his medical. Apparently, the Nigerian Consulate began a new process on July 1st in which no one is allowed to pick up their packets in person, they have to wait to receive their interview dates by e-mail. But Gabriel had picked up his packet 3 on June 16th and was given July 20th as his interview date. So when I got the e-mail, and it didn't say his interview had been "rescheduled to August 20th," I didn't know if it was just a snafu or what. So I told Gabriel to go to his scheduled interview date and to just wait and see what happens.
So Gabriel arrived at the Consulate at 5:20 a.m. At 7:00 he was let in. He first showed his interview letter and they checked to see if his name was on the list. Obviously his name was still on that list, so they then gave him a paper with a number on it, and then he went to pay his visa fee. He then had to wait a while, and then was called into cue. He waited in cue for a while and then was called by a very nice lady who collected his receipt and card, and immediately started asking him questions.
1) Who filed your petition?
2) How did you meet? (We met because I had formed a Foundation and asked a Nigerian friend of mine if he had any contacts in Nigeria who I could work with on an HIV/AIDS project. My friend said he knew someone in Delta State who had an NGO and gave me Gabriel's website address. I then contacted him.)
3) Who is this friend? What does he do for a living? When's the last time he visited Nigeria?
4) How long have Gabriel and I been talking?
5) Have I ever visited Nigeria?
6) Why have I not visited Nigeria?
7) Who is Emmanuel (Emmanuel is Gabriel's brother whose number was on my phone records.
8) What proof do you have for us? Gabriel took out pictures, cards, letters, phone records, receipts, travel documents, but she said she only wanted to see the pictures. He tried to also give the cards, but she said, no I don't need to look at that, just give me a few minutes. She took the pictures and came back shortly with a slip that says he has been approved.
He received his approval around 12:00 noon his time. Told to pick up his visa in 8 days (July 28th)

We were approved on 05/14/09 for the visa however my SO got a call from the consulate's office telling him that he needs a police report from Cassablanca Morocco were he lived for four years. They tell us they have the visa and will give it to him as soon as he brings the police report and provided that there are no issues with it. Desmond has never been in trouble for anything so there is no problem there. The problem is trying to figure out how to get the police certificate from them. Desmond lives in Nigeria now and for him to go is out of the question and we were hoping that maybe we can do it by mail or fax. Does anyone have detailed instructions on how to go about getting the report? Has anyone had to do this before??

Hello All
Just want to know if anyone can give me a little information on police reports. Yesterday Desmond was given an approval and told to come back on the 21st to get his visa. This morning he got a call from the consulates office and was asked to come back on Monday. He lived in Casablanca for four years and was an illegal there. He was not able to get a police report from them because of that. Now they asked him about the police report from Casablanca and he explained honestly about being there illegally. They have said there is no problem so I just want to know if anyone else has been in this situation and what happened. He did give them the police report from Nigeria where he has been back there since January 2009.

I sent my honeybun all the need documents for his interview that we thought would take place on April 7, 2009 however it was re-scheduled so I was wondering about the I-134. Should I do a new one and submit more recent pay stubs? Our interview is going to be on May 13, 2009 and the information will be over 30 days old.
I will be sending more verifications of phone records, emails, etc., to support our on going relationship in addition to that which I have already sent for the April 7, 2009 date.
Any helpful hints with the interview?

When they rescheduled you, did they say anything about the I129F expiring since it'll be just about 4 months? I wonder how strict they are about that.
We were told that as long as we had an appointment the consulates office will take care of an extention for us, if needed.

As long as you have an interview within the time frame you are OK.
Even if your interview fell outside the 4 month approval period the consulate would automatically extend it. So no worries about it.

Can you apply for an extention on the K-1 Visa? We have run into an issue and can not been seen at the embassy for an interview until May 14, 2009 and our Visa ends on May 16, 2009. Just want to get an extention to make sure we have enough time to make travel arrangements, etc.

Does anyone have any information???
1. I have two boys who recieve income. They are adopted and they recieved a special needs (both disabled) income which they have gotten for many years. I can get a statement from the Department of Social Services documenting the income and can produce pay stubs for at least 2 years. Will this be enough to document the income?
2. I filed my K-1 in 2008 and was approved Jan 2009. Will they use the income guidelines for 2008 or for 2009.
3. I have my taxes returns for the last three years to submit and I have two children (ages 21 & 24) that have left the home (moved together -got their own apartment)- however I claimed them for 2008 and the prior years. Do I need anything special to document that the they have left the home and I am no long supporting them.

We finally got our appointment for our interview with the Lagos Embassy on 04/07/09. We are soooooooooooooooooooooooooooo excited!!!!!!!!!! I was wondering if those whom have dealt with this embassy can give me some feed back on your personal experiences and any tips as well as answer a question for me. I was wondering how long will it take to get the VISA once we are approved at the embassy?
