I used CIEE for my internship- I was approved for 12 months under the "recent graduate" category. The company I worked with did not pay any costs, I did. Also, I was the one who contacted them and offered to intern for free and you know they can't turn anything down with "free" attached to it,

You knew they made a mistake and you still didn't get off the couch and went through all the hassle with the I-751 and paying the money instead of grabbing the phone and making an infopass appointment? Are you serious?
That's like being accused of murder, then going to jail for a few years without saying anything and when the DNA evidence later causes the case to be reopened to say: "crazy . . . I always wondered why they locked me up; after all I didn't do it."
Wow, that's a bit harsh, don't you think?
Not to mention just plain rude... -
I will be meeting a lawyer this afternoon to discuss my case. I hope everything will be ok. I'm really nervous. I also hope someone in a similar situation or is knowledgeable about cases like this read my post and provide insight.

In your original post, you stated the "Bafog" was a student loan/grant...which is it, because that could make a world of difference. A loan is repayable and a grant is not, though technically, either could be considered government funding. Keep in mind, this is not the only thing that makes you subject to the HRR; if your area of training is on your country's skill list, then even if you did not receive government funding, you would still be subject. Why not check with your consulate? They should be able to confirm. Though everything seems to indicate you aren't subject to the HRR, I completely understand your concern. USCIS is a beast!

Hello everyone, I hope someone can help me. :-)
My fiancé and I are getting married this month and we're just starting on our research on what we have to do in order to get the AOS going.
I am currently here on a J-1 visa and am completing an internship. According to my visa and the DS-2019 I am not subject to the 2 year home residence requirement. That makes sense to me - I am not receiving any government funding.
My big worry is my previous J-1 visa. I studied at a university here in the States and I received a student loan/ grant from my home country Germany (Bafög, if anyone knows what I'm talking about.. :-)).
Even on that visa and DS-2019 there was no remark regarding any 2 year rule. I am still worried I may be subject to it though.. Does anyone have experience with that? I read that the entry on the Visa (or DS-2019) may be inaccurate and the USCIS investigates the whole subject a little more thoroughly than the Embassy employees that issue the J-1 visas.
I tried researching if Bafög is considered government funding or not and couldn't find any information..
I am despereate for some information regarding my worries and who knows, maybe someone who received Bafög and applied for AOS while here on a J-1 visa will read this. ;-)
You do have the option of checking with the Dept of State to see if the requirement applies to you, since you are unsure. You can request an advisory opinion. Use this link for further info:

AOS can be done, but to add to what the PP said, you would have to prove without a doubt that you did not intend to get married when you applied for the J-1 visa and entered the U.S. I don't know what the specifics of your situation are, so if you want, feel free to PM me and I'll help in any way I can.

In Florida a SSN is needed to sit the exam...not sure how it is in other states, but he can do the classes at any time. As long as the SSA where you are gives him the SSN, as I know some tend to be wary of giving them to K visa holders, even though they are entitled to them. Good luck and yay for furthering his education!

He may be able to apply for AOS if:
A. His visa does not have the 2 yr. residency requirement, OR
B. His visa does have the 2 yr. residency requirement, but he is eligible to have it waived, which requires the permission of his home country, depends on what was the purpose of the J-1 Visa and the permission of the U.S. Dept. of State.

Yes we are both excited about the trip, we are driving down there, its about 4.5hrs one way and I do hope it wont be such a pain in the you know what when we remove the conditions and citzenship stage. Do you guys have a email address or yahoo messenger that I can keep in touch with you or even through here, whatever works for the both of you? In 2 days we are heading off to Canada so I will let you guys know how it went when we come back.
