    actually, I cut off the "to whom it may concern" by a mistake in this letter. The actual letter has it.

    We are just gonna add the dates, and I never thought about what we like to do together - I have pictures of my friend (who wrote the letter) playin pool with my husband, us in a park, during a family gathering :) i must include these pictures.

    The only downfall when attaching pictures with this letter is the fact that USCIS uses G-325-A to identify who people are, thus they have no way of identifying who your friends are. Your parents provide the best support letters because it also allows the IO to concur that your parents have accepted your relationship.

    Yes, almost any Canadian can get a visa to come into the USA. Canadian citizen's are not considered a high risk to the United States because your poverty and income standards are quiet similar to ours here in the USA. You should have a visa application interview within a week tops. If you are a Canadian student it is very easy to come into the USA as well.

  3. He qualifies for a passport depending in how long ago he was charged. Usually, after 10 years if it was a felony you can qualify for a passport. As far as the visa or pass to come here: the tourist visa is the only thing he could apply for. It could take weeks, and the criminal background could delay your wish to bring him here. A wedding is not considered an emergency or special circumstance thus you will not be granted an expedited case.

    Treasury Department Form No. 3299 (Declaration for Free Entry of Articles Not Accompanying a Resident or Non-Resident.) In addition, a supplemental declaration providing additional information relative to the owner of the property is also required.

    As to the definition of Used Household Goods and Personal Effects, the U.S. Government provides the following:

    Household Effects and Tools of Trade or Occupation which you take out of the United States are duty free at the time you return if properly declared and entered.

    All furniture, carpets, paintings, tableware, linens, and similar household furnishings acquired abroad may be imported free of duty, if:

    * They are not imported for another person or for sale.

    * They have been used abroad by you for not less than one year or were available for use in a household in which you were a resident member for one year. This privilege does not include articles placed in storage outside the home. The year of use need not be continuous nor does it need to be the year immediately preceding the date of importation into the United States. Shipping time may not be included in the computation of the one year in use.

    Items such as wearing apparel, jewelry, photographic equipment, tape recorders, stereo components, vehicles, consumable articles, etc., cannot be passed free of duty as household effects.

    Non-residents entering the United States are subject to the same basic principles as a returning resident, specifically as applies to the one year of possession of articles prior to entry.

  5. Copies of these listed documents are acceptable to BKK embassy. You will also need tax transcripts rather than the returns you indicate. The transcripts are free thru the IRS. Contact them by phone or on line to request the docs. Same for your joint sponsor.

    You can have copies of everything except birth certificates. It specifically says copies and not originals unless stated. Make sure your copies are notarized so they can certify they are true copies of the originals.

  6. If you have all of your documents together you may call and reschedule your appointment. The US Embassy in Kiev is pretty good about handling these situations. In some cases, you must present to the IO what you have done to support her situation. How do I know? I have friends that work at that embassy.

  7. Your country is part of the visa waiver program, use this and file for an extension or adjust your status. Pregnancy USCIS expedition is highly unlikely unless there is a medical emergency where your consent is required. You will get 3 months, but I would save it for near your spouses full-term.

    What do I need to enter the United States under the VWP?

  8. If you have already applied, I would not change anything. When you go to your interview for your i485 you may give the immigration officer your new employment information and they will accept it. They only thing they care about is your tax returns/w-2's as far as income. Making changes while your case is pending could further delay your case because they might automatically send you a Request for Evidence letter. How do I know? It happened to me.

  9. Your income tax returns are never optional. They are the only way to provide that you can truly support your spouse. Unless you have a secondary support affidavit. Being a student is insufficient for reason of no income. Remember you must maintain at least 125% above the national poverty level. I suggest i864 from a parent or guardian. As a note usually a school will send you a tuition W-2. Not all schools, but most schools do provide a student with a W-2. You should submit your parent or guardians income.

    I have received an E-mail from NVC about a checklist for I-864 , documents either missing or incomplete it stated,

    1).It appears that there is no proof of current employment ( i.e a job letter etc.)

    2). The listed income tax documents/IRS statements for the years missing

    - W-2 forms are missing [X} 2009

    3). You have not enclosed an explanation of why you were not required to file income taxes for the recent three years

    Currently I am working on that package, The beneficiary`s country is taking a long time on giving Her passport and Police Clearance as soon as I receive the package I will send it in as soon as possible.

  10. Hello, we have just been notified online of Approval of AP, and EAD Approved and sent. When we receive the AP paper/ certificate, do we have to do anything specific before we go? My wife was J1 and we have been married for almost a year and a half now, we have a baby boy whom is 7 months now. She over stayed her visa when we met. I have done all the proper paper work to get her legal here in the US. I-130- approved, i-485 pending, i-765 approved, i 131- approved. We haven't had an interview yet for greencard but I think it will be soon. I want to make sure that we have done everything we can to return all as a family. Does customs give people a hard time with this i-131 documents? Do they always let you back in? I just want to make sure before I make a huge family mistake.

    If you have ever left the US with AP, and you held a J1 visa prior, and you returned safe to the US please let us know. Thank you to who ever could help us.

    We are trying to leave the US and goto Ukraine on July 29 - August 25.

  11. Are you wanting to apply for an immigrant visa for your MIL and FIL? Only a USC can file for parents, so they would have to wait until your wife became a USC and then she would file the I-130 for them.

    I am a USC, could they just open a visa to come here as tourist or any other way? I just want to know if its best for them to open Visa up there or somebody open visa for them here? Is it complicated for couples/parents to come here from Ukraine? From what I understand its complicated for old people to come here from Ukraine or Russia. I wish someone knew what was best. Thank you!
