  1. Since I got 2 appt letters with 2 different dates, (12/23 and 12/30), I called USCIS and they said they can only FOUND 1 appointment date and time for me - which is 12/27!!! what!?!?!?! If I hadnt called, I wouldnt even know that date. They said they will send me the 12/27 appt letter, and ask me to go in. So I will have 3 letters on hand. Should I even try to go earlier than 12/23? I actually couldnt make it to 12/23 as I will be at another state. Any advise???

  2. So If stay out of the US for 10-12months and 10-12months in the us i should be fine for this green card revalidation?

    If you stay out of US (leave the US), and re-enter, then apply AOS, they will think that your intention of coming to the US is to get married, and they will not grant you a green card.

    However, if you apply for the AOS and AP (advance parole I-131 - travel document after filing adjustment of status), you can leave the country and come back no problem while AOS is in process

  3. I am currently on an F-1 Student Visa and still in status and attending university. My bf and I have been dating for 2 1/2 years and want to get married. How does this work? Do I need to apply for AOS before my F-1 expires, if so..how far in advance? What AOS am I applying for? I don't understand if the K-1 involves me or not! A little, ok a lot lost!!

    I was a F-1 student too~~

    1) Since you are still in school, I'm sure your F-1 visa is still valid, and you won't have any problem renewing it as if you are/will enroll as full time student. When will your F-1 visa expired?

    2) You can only adjust status (AOS) after you both got married, and get the marriage certificate. Normally you get 1 free copy for yourself, you will need 1-2 copies while filing for AOS, so when you go to pay for the certified copies, request for more for future use, save $ and time too .

    3) You have nothing to do with K-1

    4) If you both get married now, and your visa is still valid, you can file AOS, when you get your green card, you no longer need your F-1 visa and you can probably pay for local resident tuition too! Make sure you don't leave the country before you apply for AOS and while it is in process.

    Just came across to your posting! Recall what have happened to 2 years ago....check out my timeline below and you will have a better understanding of how long this process would take.

    And yes, please do not leave the country, once you leave, it gets so much complicated and you will regret for the rest of your life - seriously. The most important thing is when you first and last US entry, your intention was not to get a green card.

    Read all the information/comments/tips from this website, and you should be able to file your AOS easily. It normally takes 4-6 months, if everything goes smoothly, you can get the card in less than 4 months! Provide as much proof as you can, make a copy of everything you will submit as well.

  5. This is what we have together: Joint bank accounts. joint auto insurance. utility bills and lease. We do have some letters to this address. We have a letter from his bank saying I am in his accout but we have no cancelled checks. We did not get the checkbook changed to both our names. I am not on his car title. I am really worried. Do you guys think all this is enough? I do have lots of pics together.

    I think the documents you have should be fine! when I filed mine, I only have joint bank accounts statements, credit card statements, and lots of pictures with both of us and family photos. we never live together before we get married, so we do not have any joint bills. Luckily, my process was smooth.

  6. When filling out the I-485 for the family name do I put my original last name or do I put my husbands last name? I am not sure if my last name automatically changes to his last name or do we have to do something in order to officially change it. Also what box in Part 2 do I check if I came here on a tourist visa and decided to get married?

    when u both get married, what name did u sign? and did u change yr name the day u get married? if u did, then put yr new last name, if u didn't change, then u cannot change it during the AOS filing. best thing to check is to look at yr marriage certificate. good luck!

    pacificleye is right! whether or not the sister is overstaying has no affect with the 2 of you! Based on my experience and other VJ member interview experience, the immigration officer (if they ask sth related to siblings) would probably ask u or yr wife "if she has any siblings? what is her name?" .............and they wont ask much details abt the siblings.....

    i would say u both just focus on understanding more abt both of u....habits, work titles, food that u like to eat, parents name and siblings name, favorite colors...............etc...those questions!

    remember to bring copies of documents and extra evidence just in case! GOOD LUCK!!!

  8. ohhh....I didn't see that on VJ earlier....Ok, I see what it says and am relieved I won't have to pay $50-$75 for this...but now, another possibly dumb question. If my fiance is fluent, and can translate it, would it be unthinkable/bad idea for HIM to translate his own birth certificate and just fill out the little "I am capable of translating..." certification thing at the end??? Even as I ask the question, it seems a little weird....Just wondering if it's ever been done.. :whistle:

    you don't need to pay a translation service if someone can do it for you. Definitly not required by USCIS... just get it done and follow the translator certificate that this site spells out

    I asked the university language professor to translate for me, signed and dated professionally. (only paid $20 for 2 copies)

    I didn't take the risk of translating myself, I'm just too chicken to do so... coz I'm not 100% sure if I am allow to do it myself.

  9. 1. NO, only caps on LAST NAME.

    2. I put "Chicago, Illinois"

    3. I'm not too sure if it is necessary, but I still put my foreign home address (which I have not lived for 6 years) However, I think she should put since she is originally came from that foreign country.

    4. I do not have an expiration date too, so I put "None".

    5. I have never join any clubs in US, so I just simply put "None".

    6. The Nonimmigrant Visa number is the "RED number" located on the right bottom corner of the Visa page inside the passport. Alien Number is the A# which "not everyone" have it. I got mine since I got a EAD (work permit) before, the A# was on the card. If your wife doesn't have one, just put "None".
