  1. Hi Guys: I filed my I-485 in june 2005 on marriage basis as my wife is US citizen and since to date its been hold because of name check. I got my first EAD on time but the second one they give me after a very hard time and wait for atleast 10 months to get that. My second EAD will be expire at the end of october 2008 and I already applied for the third one. Can any one please tell me that why the immigration give me that much hard time? Also in 2005 when i got my first EAD they also sent me a letter for the interview which was just after 90 days but without telling any reason they cancel my interview and since to date i never been interviewed at USCIS.

    I dont know why they are giving you a hard time, Maybe it is because your from Pakastain.

    If you been married for 3 years, I would skip that AOS and just file to become a USC.

    Thanks guys. Yes i did an appointment just a month ago and they told me that the application is on hold because of my name check. Also can you please tell me which form i fill to apply for the citizen ship. I dont know that i can apply directly even i didnt get my GC?

    You can't apply directly for citizenship, I think he/she's just yanking your chain.

  2. MSC/NBC has my documents since May 9. I had biometrics apoointment on June 4. However, I have discovered today that the person who did our application did not include I-864 affidavit of support with it. MSC still did not notify me that it missing.I am ready to send it tomorrow with proper tax documents. I was wondering should I send it to Chicago lockbox and will they accept it now? I submitted I-130, I-131, I-765 and I-485 all together. I am worrying that they will misplace my I-864 if I sent it separately? Did anybody have I-864 requested as an additional evidence and in that case, was their I-131 (advance parole) delayed?

  3. I'm filling out the EAD now and I don't really know what category I do fall in for the Elligibility:

    K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2Dependent--(a)(6). File your EAD application if you arefiling within 90 days from the date of entry. This EAD cannotbe renewed. Any EAD application other than for areplacement must be based on your pending application forfamily-based adjustment under ©(9).

    OR

    Family-based adjustment applicant --©(9). File yourEAD application with a copy of the receipt notice or otherevidence that your Form I-485, application for permanentresidence, is pending. You may file Form I-765 together withyour Form I-485.

    I have a feeling I fall in the C9 category. I did come in as a K1 but I am already married so, I guess I'm part of the family now right?

    Now there are like three spaces to write in... Like this:

    Eligibility under 8 CRF 27a.12

    ( ) ( ) ( )

    Am I supposed to put in three possibilities of eligibility?

    You use c 9 if you're filing I-485.

  4. Hello! I am from Kaua'i Hawaii,We already filed my AOS last May 29. 2008 and we sent it through UPSP as a priority mail to Chicago IL. Package deliver June 2008, they already check cashed, so now its almost a month we haven't got a NOA1 for AOS+EAD on mail, I am kinda worried.. Hope you can advice me.. Thanks..

    If it's a personal check, you can get the noa numbers from the back of the check.

  5. Hello!

    On the form I-765 App. for Employment Authorization, on questions 16, it say to go to part 2 of the instructions to find the correct eligibility category. We looked through them but weren't exactly sure. Which category and abbreviation would we be? My husband entered on a K-1 visa and we are now married and filing for an AOS and filing the employment auth. with the AOS.
