  1. income needs to be 125% or above, it is the W2 total earnings for the year that counts. If you are going to use assets such as savings etc.. they must be liquid assets firstly (i.e. a car is not an asset) and there are certain restrictions (i.e. 5x the amount needed or something).

    In short you would be better with a co-sponsor if his income does not meet the requirements

    Minor correction, Liquid asset just need to be 3 times the amount needed, not 5.

  2. My wife is in US on F1 student visa, and I am a US citizen. We just filed for her adjustment of status thru marriage. Now we are waiting to hear back from USCIS. Does anyone know how the process works from this point?

    1- My wife's student EAD is good unitl May '09. But since we filed the adjustment of status packet in Feb '09, can she continue to work with her old EAD? Or does she need to quit work until her new EAD arrives thru adjustment process?

    2- If she does quit working now, does her status expire? When is she considered "OK" to stay here in the US legally - after they cash our checks, or do we need to wait for her new EAD or some other notification.

    3- Is there anything she should or should not do while we are waiting for this whole process?

    4- How long does it take to hear back from USCIS after initial filing of adjustment packet? Can we check online?

    IANAL but yes, she will be able to work with her old EAD until the expiration date. As soon as they send you a "notice of action" acknowledging your AOS paperwork (I-130/I-485), she is no longer a nonimmigrant, her status changes to "AOS pending". It took me good three weeks to hear anything from USCIS after the filing and I was able to check my status fews days after that. BTW, the online system is not that accurate so don't rely on it so much. The only thing that she should not be doing is working after the EAD expires until she gets a new one based on your AOS. Finally, Good luck, this process can be long and frustrating, enjoy your new life or be prepared to lose some hair :)

  3. Where in the filing instructions on any of the forms does it say to provide with I-20 form? Evidence of your F1 status is your I-94 not necessarily I-20.

    Yes it is, on the instructions it says to provide EVERY single documents ever issued to you by USCIS. The I-20 was issued by USCIS.

    What form does it say to provide every single document issued to you by USCIS, relevant or not?

  4. Hey guys how are you? I had my AOS interview on Feb 3 2009 in Cleveland, OH, and since then, I have not heard any info about my decision, is this normal and has anyone experienced this before? All I was told at the end of the interview was "If we need anything from you, we will notify you by mail. I was not given a verbal approval or anything, nor was my EAD card taken away from me. I have no clue what to think and I am frustrated like hell not knowing the decision?

    Any thoughts or opinions on this matter?

    Give it ten more days and make an infopass appointment to get an update.

  5. Don't waste your money into these professional service. Just have somebody fluent in spanish (I assume) and English translate the document and make sure he/she signs it saying they're fluent in both.

    Several documents I had translated by a friend fluent in my language was taken by USCIS without any reservations. Good luck!

    I used that too. I think there's should be a little addition that mentions sending in the I-20 form(s) as well.

    I was kind of lost with all the K1 stuff on here.

    We're getting ready to file AOS. and I'm confused. I know we need to prove we're living together, but what exactly should I be sending with the AOS packet to prove this?

    how much is needed? should I include pictures? wedding pictures?

    I am assuming this is for I-130. I sent in last two months' financial statement with the understanding that if they needed more, they'd request for initial evidence. As far as wedding pictures go, I s'pose one or two shouldn't harm, however, in the interest of paperwork and their time, I wouldn't send the whole album.

    Firstly, that AOS guide HERE is a wonderfully helpful resource.

    Item #7 of the I-130 portion of the guide says copy of the intending imigrant's passport. Does this mean a copy of all of the pages of the passport, or just theinside back cover which is the identification portion of the passport?

    I submitted copies of the ID page and the most recent visa used to enter the country. My passport has about 64 pages of blank pages, I think it would be waste of time and money to turn every single page in.

  8. I am adjusting my status from F-1, i send everything that USCIS ever issued to me. Didn't get any RFE, it can't hurt if you do.

    Why volunteer information they didn't ask? If you follow the AOS guide here and/or the filing instructions for the several forms, nowhere does it state that you need to send I-20. I took my I-20 to the interview, just in case they asked me questions regarding dates but nowhere doing the approval the I-20 was mentioned.

    You are not eligible to adjust your status if you have been employed in the United States without authorization from the USCIS, unless you are eligible under Section 245(i). This rule does not apply to you if you are the immediate relative of a U.S. citizen (parent, spouse, or unmarried child under 21 years old). It also does not apply to certain foreign medical graduates, international organization employees and their family members.

    Marriage to a US citizen usually forgives any illegal employment prior to filing the AOS. However, few exceptions that might hurt you if you provided a fake or used somebody else' SSN or claimed to be a US citizen on the I-9 form.

  10. Hi Everyone,

    My wife and I currently reside with my parents in California. Because they qualify as household members, they are filling out an I-864a so they can use their income to help us meet the requirements of the I-864. However, they always file their income taxes jointly, so I can't tell what my Dad's Income is and what my Mom's income is. It's just one combined number for the both of them.

    There is no way on the I-864a to list two people in one form, so what should I do?

    You can look what they made individually by looking at the w-2, 1099 forms etc.

  11. Back in Oct 14, the CRIS updates on my I-485 saying "Notice Returned as Undeliverable". The same day I put in a service request for change of address to my current address (again) at that time. Then after about four weeks, I had to move out of state because of job transfer, so I updated my address again on Nov 15.

    I was curious about the content of that original notice, so I took an infopass appointment and the ISO tells me that the file was most likely transferred to the local office in the original state. Now I received a notice sent in response to my original service request for change of address due to undeliverable notice saying that they need to do additional review. What's going on in this convoluted mess? Is the field office officer at the local office accurate or are the bureaucrats at the NBC?
