  2. Today I went in for an infopass appointment to verify that my online change of address was successful. Turns out the online form worked exactly as expected and that they had my new address on file.

    I also had the bonus news that as of yesterday (2/28), my case was actually being reviewed by someone and that I should expect the decision in the mail within 30 days. The gentlemen behind the counter also informed me that moving during the lifting conditions process often results in a slight delay in processing. He didn't suggest a service request or anything like that, but simply to wait for the decision or make another infopass appointment if I didn't get anything in the mail next month.

    The moral of the story is -- making an infopass appointment is painless and very much worthwhile if you can go. You don't have to stay on the line on hold to talk to someone and all you have to do is show up at the appointed time. I definitely felt that it gave me peace of mind to talk to someone in person.

  4. What an awesome start for my weekend! I just got my approval letter. I had moved at the beginning of my application and had changed my address with all the forms online and by mail( my husband did the same) but apparently it was never changed because my approval letter came to my old address. Fortunately, my mail was forwarded to my current address and I got the letter. I just got off the phone with an immigration representative, changed my address again and they confirmed they will be sending my card to my current address! I can now rest and fully enjoy my weekend! Good luck to those still waiting! Your turn will come very soon!

    I am in the exact same position (moved and updated address online), except I haven't received the approval yet. Great to hear that it can be forwarded, because I do have that setup with the post office. At any rate, I also have an infopass appointment later this month if I don't receive anything beforehand. Thanks for sharing.

    You can send a copy of the I-94 front and back. Hang onto your original (as it should be stapled into your passport).

  5. I'm the OP posting a follow-up on our situation:

    We ended up filing for 2006 and 2007 using Form 2555-EZ to negate her Canadian income for those years. It only took a few minutes at our IRS office and the guy who processed the claims said that we did the right thing. He mentioned that the IRS probably won't send any summary to her since the adjusted gross income was $0 for those years. After that we were able to complete the I-864 and only attached the 2008 transcript.

  6. grr just posting a follow-up here 'cause I just called Chase's international collection hotline for some clarification.

    The thing that tripped my deposit up was the fact that it was over $5000 USD in value. Apparently that's the condition to trigger a different type of processing...

    So the lesson here is don't try to deposit a check/draft over $5k if you can avoid it. Unfortunately for me there is nothing to do but wait now.

  7. I have an update for the this thread: I recently opened a Chase checking account and tried to deposit a US-Dollar Cheque from TD Canada Trust. A day later I saw that the cheque did not clear (even though there was more than enough money in the TD account) and that I was charged a $25 insufficient funds fee.

    Suffice to say I was steaming mad when I saw this. I called the branch and they looked into it, finally telling me that it will take 2-3 weeks for the international cheque to clear and that they will reverse the fee at that time. So now my money is in limbo for weeks and I have no access to it. They can't recall the cheque since it's been sent collection and it will cost me money on both sides if I make a stop payment.

    The only reason I chose Chase was because it was a few minutes from my place... we'll be pulling our money out and moving all of our money to Bank of America after 90 days (so Chase can't charge us another $25 for trying to close an account within 90 days of opening).

    I also called Chase to verify the Branch's story and they also told me that international cheques take 2-3 weeks to clear. I asked why BoA was able to clear the same cheques in 2-3 DAYS and they did not have an answer for me. So yea, avoid Chase if you can.

  8. Did you get the Bordeless Plan from TD? If so you are entitled to complimentary checks. Just FYI, when you order them you can ask to leave your address off the checks so it only shows your name (in case you haven't updated to your US address before ordering checks). My checks specifically state "US Dollar Account" and "U.S. Funds". They take about 3 days to clear with BoA.

    That's good to know. We also opened a US account with TD Canada Trust. I'm going to go see if Chase will accept a US cheque from a Canadian Bank.
  9. You can also get a USD account with your Canadian bank.

    If you use online banking, it's easy to move money from your Canadian checking/savings accounts to your USD account... with my bank (TD CanadaTrust) I even get a slightly better exchange rate this way.

    I've had no problems depositing US Dollar checks drawn from a Canadian US Dollar account at Bank of America (for paying rent to my Fiancee).

  10. Just a heads up -- while this is technically a question about the Affidavit of Support, it is really about US tax return eligibility.

    The question is about to my primary sponsor's (USC Fiancee) Affidavit of Support. Part 25 asks whether she filed tax returns for the past 3 tax years (2006, 2007, 2008).

    2008 is not an issue because that's when she moved back to the US. We therefore have her IRS transcript for 2008, which will be submitted with the affidavit.

    The real meat of the question is whether she was required to file US tax returns for 2006 and 2007, or if we can simply state that she was exempt.

    Here's what we know for the tax years of 2006 and 2007:

    --She was a bona fide resident of Canada

    --She earned all of her money in Canada for a Canadian company

    --She did not work or earn money in the USA

    --She did not file a tax return in the USA

    --All of the money she earned qualifies for Foreign Earned Income Exclusion (under ~$87k)

    So, can we check part 25 and attach a sheet that states she did not file for 2006 and 2007 because her earnings for those years were exclusively Foreign Earned and wholly qualify for Foreign Earned Income Exclusion?

    Additional notes:

    Just as a little background, the net effect of filling out a 1040 for each of those years would be to list her foreign income on line 7, then credit all of that income on line 21 as per Form 2555-EZ--which brings her total income for each year to $0.

    This might be over thinking the primary sponsor's affidavit because my she can't meet the poverty guidelines anyway, so we have a joint sponsor who earns way over the poverty guideline on income alone. I just don't want us to get tripped up on the technicalities of part 25 because in the instructions it states that you must explain why you did not file for a previous year if that is the case.

  11. I am in the US on my K-1 but I have not been married yet--that'll be sometime in May (i.e., no EAD). My ex-boss in Canada wants me to take on some contract work remotely.

    I asked the guy who processed me at the border crossing and he didn't give me a straight answer on whether I can work remotely for a Canadian company... does anyone have any input regarding this?

  12. Turns out the border crossing was (like the interview) one of the easiest steps of the visa process...

    We decided to go to Queenston-Lewiston because we just wanted to get the crossing done ASAP. Buffalo was an extra 30 min away and the wait times were listed as none for both crossings at 7am (last Friday Apr 24).

    When I got to the booth, I told the officer that I wanted to "activate my K-1 visa". This prompted him to give me a quizzical look at he responded by asking me (in a sarcastic tone) how one went about "activating" a visa. I don't think he was trying to give me a hard time. It's possible that the verbiage we use on the forum is not 100% what the customs officers use.

    Anyway, we exchanged a few words and chuckles (I was not letting anything get me down on this important day) and finally asked him what the correct term would be. He said that what I am really doing is "applying" for entry with my visa. At the end of the day this was purely semantics so I didn't pursue the point. He told me to hang onto my visa envelope and directed us to enter the processing area to the left of the booths. At that point he hadn't given me back my passports. Later we realized that he had sent them via vacuum tubes to the processing building. He handed me a ticket that I needed to enter the parking lot.

    We were admitted to the processing parking lot by 2 fellows standing by a parked cruiser. They seemed to be in good spirits and were joking around when we pulled up. I explained that I was here to get processed for immigration. He asked if I knew where I was going, and I answered no. He said to pull into any parking spot on the left and then head left from the parked car to the building -- where my name would be called eventually. He then peeked into our back seat and exclaimed something along the lines of "geez, what do you guys have in there?" (bear in mind the car was completely packed to the gills). I just smiled and said "I'm MOVING!". That seemed to placate him and we headed to the parking spot. I think the key here is to remember that they are not really out to make your life hard. Just tell the truth and stay upbeat.

    We pulled into the lot and noticed that there were only a handful of cars there. I figured we wouldn't be waiting too long. Inside the processing center there were only 2 groups ahead of us. Those groups were processed and out within a few minutes and I was called up to the desk. I handed over my visa envelope (from the consulate) and asked to update my destination address. The guy processing my work seemed to be a little low on energy but he actually got me processed in about 10 minutes with very few words exchanged. In fact, the only things he asked me were why I was changing my destination address and who I was travelling with. He also asked if I knew how the K-1 visa worked and I said yes, so he actually skipped the entire explanation. Then he stapled the I-94A to my passport (next to my visa) and stamped both with my entry date. He handed back the passport and said that was it! Total time elapsed from entering the building - 15 minutes.

    On the way out of the building, one of the guys guarding the parking lot walked over and took my stamped ticket. Then we just exited the parking lot onto the I-190.

    Some key notes:

    -Maybe 'activating' the visa is not the correct term?

    -They did not search my car nor did they even ask what I was bringing with me

    -Don't bother asking for your passport back at the booth if the crossing has vacuum tubes

    -Stay upbeat and cheerful... even if the officer is being difficult it will soon rub off and all will be well

    -Try to go early (before 8am) to a land crossing to reduce wait time (and obviously avoid long weekends if possible)

  13. Thanks for all your advice. I'll plan for the Peace Bridge and divert to Queenston if the wait times are too long. I doubt that will happen but we have a blackberry to check their website.

    carrieandadrian: from what I read in the POE reviews, they do not go through your personal belongings. I'll post my POE experience next weekend after I've settled into my new place!

  14. Does anyone have input on which border crossing to use for the smoothest K-1 activation?

    Choices:

    -Queenston-Lewiston

    -Niagara Falls (Rainbow Bridge)

    -Ft.Erie-Buffalo (Peace Bridge)

    Details:

    -We plan to arrive at the border around 5:30-6:00 AM.

    -I'll be traveling in my Father's car but he is driving it back to Toronto afterward so no paperwork required for the vehicle.

    -I will have my personal belongings (a few suitcases and boxes) in the car.

    It seems like most people activated at the Peace Bridge between Fort Erie and Buffalo. I have the most crossing experience using the Queenston-Lewiston Bridge, but I have never been to secondary there.

    Also, if you can think of any special considerations because my Father is accompanying me with his car, please let me know. He'll have his passport, work ID, and business cards with him.

  15. Ok so I had a minor panic attack yesterday trying to figure out how to move my stuff.

    The original plan was to fly to Queens with my luggage allowance plus extra bags. I'd have 2-3 other boxes that would either be mailed by UPS or brought over in 6 months by relatives when they attend the wedding.

    I've now convinced my father to drive with me to NYC if I pay for gas, lodging, and parking. It would probably cost the same as a one-way flight with extra bags anyway... and I can move all my stuff in one shot. Being a great dad he agreed so we're going to drive on the weekend of April 25. No unaccompanied duty-free hassles and i never have to move my stuff again (never say never)!

  17. ^^ You're technically not allowed to send anything in advance of yourself.

    But if all you're sending is that 1 box, and you send to to your fiance and label it as :used" - I can't see you getting any charges. Most of the time, it is Canada that adds on a customs charge, not the US.

    Where did you read up on this stuff? (i.e., how did you know it is not technically allowed?) I've been digging around all evening trying to find out how to use parcel mail to move some of my personal belongings... it has been pretty confusing so far.

  18. Has anyone tried sending smaller parcels through Canada Post?

    I was thinking of sending my computer case ahead of time... it would be empty (total value only $90).

    Anyway, I popped the specs (dimensions and weight) into the Canada Post Calculator and this is what I got back:

    That's way cheaper than buying a new case (the heaviest part) when I get there. I am just curious if anyone has experience with customs declarations when mailing your own stuff to your state-side destination? Are there going to be extra fees?

  20. Does anyone have an opinion on whether there is a tangible difference with a pre-clearance POE like Toronto Pearson or a state-side POE like Newark Liberty? I have to get to New York City by air so here are my choices.

    Pearson to LaGuardia:

    I'm leaning toward LaGuardia because it is very close (15 minutes) from where I'll be living. But it means processing in Toronto.

    --or--

    Toronto Island to Newark:

    On the other hand, if I fly with Porter to Newark I will be processed state-side. I'm thinking that processing in the states may improve the speed that I get registered in the SAVE-ASVI system for my SSN and also reduce the possibility that they'd lose my paperwork (the POE is geographically next to my final destination and local USCIS office). The only problem is that I'd then have to trek from New Jersey to Queens with 3 suitcases.

  21. So in the interview letter, they did not specify what to bring at the interview except for pictures, visa, express post envelope, DS-156, DS-160, 131$ US in cash and such. So my question is ... What documents do I need to bring at the interview and which ones need to be notarized ????

    Nothing needs to be notarized per se. If you use the new I-134 form from the USCIS website, it does not require notarization. The long-form birth certificate needs to be a certified copy with photocopy duplicates... but they give that back to you anyway and you automatically get a certified copy from the province if you order one (costs about $40). Honestly I don't know why people go to such great troubles to get things notarized (must be due to the rigorous VJ instructions). I didn't have a single thing notarized when I went to the interview.

    To figure out what you need to bring, read over the packet 3 checklist and the interview appointment letter. The checklist pretty much covers 90% of the stuff. Just make sure everything listed in the checklist is photocopied twice.

    The appointment letter mentions the DS-160 and the DS-156. Both need to be completed (though the DS-160 should have been done at the time you sent back packet 3). FYI they took one copy of my DS-160 (confirmation page and answers), and 2 copies of my DS-156. The appointment letter also says to bring the $131 USD cash or Canadian equivalent (you can pay in Canadian at the cashier if you have enough money... they do an daily exchange rate). Simpler to get the US money in my opinion. Oh, and the updated Fiance(e) letter of intent.

    The only other thing that isn't really noted -- make sure you bring the DS-156k that came in your packet 3 because it's signed in front of the interviewing officer, and make a photocopy of your biographic page of the passport because they'll ask you for it.

    ps-it helps to read consulate reviews within this thread to get an idea of what to bring.

  22. I agree, We're almost scared to actually sit down and figure out how much this whole process has cost so far with the running around to get things, the costs and fees for everything. Today I called about my emission standards letter to bring my car across the border and that's going to cost me $85 dollars. When will it end! No wonder there are so many illegals living in the US.

    Yea I'm just starting to accept the costs myself. From I-129F to the interview I've easily spent over $1000 CDN--and that was before Dr. Seiden raised the medical price. I just found out a few weeks ago that AOS costs $1010 USD.

    So I paid around 1k for the right to enter the states for marriage without getting turned back... and another 1k to stay, live, and work.
