You need to fill in a W-7. That way you can get an ITIN.

Hi guys - are any of you in the states already?
My husband and I got married last year and I submitted my I-130 earlier this month. I just got a notice of receipt. I'm getting nervous though because it sounds like I should have filed the I-485 at the same time? I thought the step was to file the I-130 first and then file the I-485 once that went through. I'm a USC but my husband is F-1. I just don't want to have to deal with him having to leave the US as I'm pregnant and it would be a huge stress on our family. Any words of wisdom would be helpful. Thanks!
Since you s.o. is already in the States on a F1 you are in a totally different position than normal CR-I filer.
All y'all need is Adjustment of Status. Sorry, since I am doing the CR-I from the beginning, I don't know anything about adjusting the status. Maybe you can use the search and can get some useful information.

If it only took 4-5 months I think they did the DCF. Otherwise it already takes about 3 months till you get the NOA2

Thank you, yohino. It worked for me, too. I deleted the wrong number and typed in the right one :-)

it only goves ma an internal error when i try to go to my portfolio, though.

OMG, somehow I signed up for online/cellphone updates with the wrong case number. After I got it from my husband (he doesnt have fast internet), I signed up online. Somehow I must have put an 8 instead of a 4. Today, we got a message and wanted to check online and recognized I put in the wrong number. As soon as I recognized this happened, I tried to go to the uscis site and logged in. In my portfolio I wanted to get rid of the old WAC number and put in the right one. But it always says internal error. What can I do? I didnt do this on purpose!!! Any suggestions?

Thanks for your fast reply!

We didnt receive the NOA1 hardcopie yet. Is there still a way to see which our service center is? We got the receipt number from the check and can log into the website.

@Just Bob. I dont need help on the decision. Thanks for your 2 cents though
You dont know our life and dont know our plans about work etc.
We can live without his income so it wont be a disaster and it is not stupid.

Wow, thank you! THey really hold on to it for a year? Can't believe it! I will doublecheck with them. Just to understand clearly: NVC is after the NOA2, right?
Thank you so much for your ideas!

Hey!
We started the CR-I process this months.
Now, my husband decided to give up his job and come to Germany for a year. I dont want to stopp the process right now because I am afraid something will happen and he wont stay for 6 months so that we can do the DCF instead.
If he really found an awesome job I could see him staying here for longer than a year (maybe 2 years?). Would it be possible to fly to the States when I get the visa in the end and then get a reentry permit?
What would you recommend?
There is so much I have to get ready right now so I would really be happy about any help I can get!!!
Thanks in advance!

Are you going to file it as a DCF? How long have you been in Mexico?
-
What do you mean by Philly? Philadelphia? If she is here on a student visa you dont need a CR-I you can just adjust the status of her visa.
-
No prob. This one is fine :-)
@Caro: You just needed to send I-130, 2x G325A; Marriage Certificate, his birth certificate, 2 pictures, and proof of bonafide marriage (if he is USC from birth and both have never been married). Look into the guides. You can also send me a personal message if you want to.

You dont have to do the medical etc till shortly before the interview. Or am I misunderstanding your question?
-
That's what scared me. I got everything ready in Germany but we actually only had time to go over it together once since his internet wasnt working properly. So I just hope hope hope that everything is fine...but I am trying to think positive. How long do y'all think the process will take? I always heard about 12 months but have seen some people being done faster than that!

If you think you know everything there is no need for us to tell you anything about illegal and so on.
It just makes me mad because of those people entering the States on VWP and then staying after the wedding illegally it is so hard for me to visit my husband and I get asked a lot of questions.Just my 2 cents.
Good luck!

Congrats! That is sooo awesome! How long did it take y'all?

Hey!
I had already started one, too. But we can take this one ;-)

Hello,
I originally posted this on K-3 forum but from previous feedback it seems the best way to go is just with the I-130. I'm a US citizen (originally born in Lima Peru) living in the NY area and I'm marrying my fiancee next week (Jan 15th 2010) in Lima Peru. I wanted to get feedback on what I'm looking at in terms whats the process like and more importantly how long it takes before she's able to come to the US. I've not seek legal counsel yet but its an option I'm considering.
I figure my case its pretty standard, both of us are in our 30's and have never been married or have any children. We have a clean criminal/immigration record. But after going through the I-130 guide website I see some issues with "Evidence" of marriage. We don't have any kids together and we haven't lived or co-mingle our finances yet since we're living apart. All I can think of is generating affidavits from relatives attesting to of our engagement and our marital intentions. Any advise would be greatly appreciated. Thanks again and best of luck to all.

Maybe she can also put you on her bank account when you are in Lima. That's what my husband and I did. We have a joint bank account in the States and in Germany. Plus pictures, affidavits etc as said before.

Hey!
I was wondering if there are already any I-130 January filers, here. We sent out our application this morning.
-
she'll need a seperate I-130 (yer 16 year old lass )
You can make ONE filled out form , one page, for the G-325A, NOT SIGN IT, then make copies, sign the 4 copies in blue ink .
Good Luck !
I am confused, now. My husband is about to send out the package, today and last month I asked if I really needed four copies of the G325A. There, it said I didnt need four copies and that just one would be enough!!! Also, I couldnt find anything about four copies on the uscis site. Does anyone know?
-
I asked the same question in this forum before and I was told you dont have to send four copies of it. The form got changed so now, you only need one copie of it.

Thank you for your post! That is a lot faster than we thought. I always heard about 12 months.
We have been reading through everything very carefully and I hope we will be as fast as y'all!
Address change question
in IR-1 / CR-1 Spouse Visa Process & Procedures
Posted
I have a similar question. My husband is going to move to Germany in March. He is going to stay here for a year until the process is over. Does he have to change his address in March or can he leave it with his parents? That's the address USCIS got.
