  1. Correct. Canada's two consulates are not ones that penalize you if your fiance / spouse are not able to be at the interview.

With that being said, TBoneX happened to deal with a consulate that does, which is fairly normal for consulates in Central / South America.

As for the OP, you may not need to have a passport right now, but with the backlog of passports being processed due to the new rules of travelling between Canada and the US, I wouldn't wait too long to get that in motion. That, and passport stamps are wonderful evidence to use in this process. Just something to think about :)

Thanks so much. The online wizard is down until tomorrow. I have all the information I need but I originally did my passport papers a few months ago so they are no longer valid.

I'm printing off our photos for the I-129F today, and I'll be printing other proof tomorrow so I hope to send out both packages by the end of the week.

Do you think it is worth it to apply for a passport card as well?

  2. Not sure if this has been posted before but I had a couple of questions that I hope someone can answer for me.

1.) Would there be any problem if me and my fiancee get married in her country before getting the visa ?

2.) If not would it be okay to get married in her country after she receives the visa and then we both travel back to the US together using the fiancee visa?

Thanks in advance for any help.

pretty sure the entire point for a K1 is so that you guys can get married in the US. If you want to get married in her country you would have to go through a K3 I believe.

    Junk,

You need to read the guides if you don't even understand what a K-1 Visa is.

a k-1 visa is a visa allowing the beneficiary to come into the US with the purpose of marrying the petitioner.

    1) No you and your fiance may NOT get married in her home country and then apply for a K1.

    2) Once again No. You MUST get married in the US. This is the whole point of the K1 Visa, for her to come to the US and GET MARRIED in the US.

Junk, please read the guides as this question is standard knowledge for the K-1 Visa, sorry to sound like a jerk haha, but reading the guides will eliminate questions like this.

Just a quick word in here :)

You don't need a passport to drive across the border until next year or to travel by water ( The Cat ferry from Maine to Nova Scotia is an example). I live in New Brunswick and when Bo came up in March, I drove across to Maine (Houlton/Woodstock) to get him from the Portland airport and they don't ask for a passport, just government issued ID.

LOL it was so funny the difference between the US customs people and Canadian...US asked for my ID (I have a passport because I fly down to NC), they checked the car, the trunk real fast. Going back across to NB with Bo, they didnt ask for ID at all, didn't look in the car...just said to have a safe drive :)

Well we had no idea about this. Ash and I will look into getting an American passport for her as well then! Thanks for the additional information over this! And good luck with your K-1!! :D

People only get an RFE when they fail to provide correct information, or sufficient information. As in, they forget to include all required documents, evidence, or they provide incorrect documents/evidence, or they have had prior criminal convictions, etc.

I don't know how soon after sending the 129f do they get an RFE. Why are you worried about this? IF you included everything necessary then no reason to worry! B)

Wow youguys are pretty young. I'm 22. so you are 18 and your fiance is 17?

They won't turn you down as long as you have parental consent to marry. If you're over 18 you dont need it but your fiance will.

If you have parental consent then I doubt you'd get turned down as long as you have a bonafide relationship.

I was under the impression you needed a passport to go to Canada, as i thought this was required by law recently.

I would definitely start bringing your passport with you, not sure why you wouldn't, and get it stamped so you have proof.

Photos are good, emails are good,, phone bills, and not sure what you mean by money spent on trips? do you mean bank statements showing purchases made in the fiances country?

A)I just hope for the best and plan for the worst with the RFE since we are doing this without any sort of legal help, or help at all except for the internet.

    B) I just turned 19 and he will be 18 (June 9) before I mail off our I-129F.

    C) you don't need one, just a birth cert or citizenship card from canada. I do not have a passport.

    D) money spent on trips - my bank statements showing money spent in canada, yes.

He will need a passport. The visa is glued to a page in the passport. I'd be getting your own passport too.

I only have one official copy of my birth certificate and you have to send that off to get a passport since my parents lost my last one :( My mom also got a copy of it recently and we are not on speaking terms, the state of Minnesota said that they only give out two at a time and that was just a few months ago.

I did all of the papers to get a new passport before visiting in April but I really can't afford all the fees now since I have to send the 455$ with the I-129F

  5. OP, you're not the first couple on here that young - so don't worry as long as you're of legal age to get married (or have parental consent if needed).

As far as the USC being allowed in the interview room - it does depend on the consulate. I'm the USC and I was allowed to be interviewed with my (now) husband and the CO actually talked to me more.

That is great! It would be the best if we could both enter the room, wouldn't want go through the interview alone, I get nervous easily.

Yepp, got the passport taken care of last year on my own, so we don't have to worry about that!

When was the last time you crossed the border? You've needed a passport to fly across for a few years now and we needed one last year to drive across.

We actually crossed it last week, when I drove her to the airport. I live across from Detroit, in Windsor, so I make the trip quite frequently. They still accept Canadian Citizenship cards, birth certificates, and I think, possibly the new Ontario driver's license, but don't quote me on that one. I have a passport myself, so that is taken care of. She doesn't need to get anything stamped or done to her passport, which does not exist, so yeah, we won't worry about it though. Detroit-Windsor is fairly easy going with the border cross. When you cross the border from anywhere else other than Canada, that is when you need the passport. And I believe that requirement of the passport between Canada and America only exists if you fly from one nation to the other, but we always do internal flying, and then just cross the border on land.

Once again, thank you for all the help from everybody! We greatly appreciate it! :D

  6. Thats interesting, is that a saying of his? Sorry I have never heard that before.

    Does he speak Hungarian still?

he says, "Igen, még mindig tudok!"

I have no idea what that means though ._.

Nyíregyházan születtem, mindig a Keleti oldalon laktam Magyarországban. :< De most már minden rendben van! : )

Köszönjük szépen a segitséget! : ) És sok boldogsákot nektek!

Én is laktam Nyiregyházan!

Nagyszüleim Erdélyben élnek, náluk töltöttem a nyaraimat gyerekként.

Congratulations! Thank you for the help and kind offer, we shall definitely keep it in mind. Good luck with your move, we hope it goes as smoothly as possible for you. Hope you enjoy the city and eachother, congrats again :)

  10. A few questions, if these have probably been asked before but I couldn't find them:

    1) How often do people get an RFE?

    2) How soon after sending in their I-129F do they usually get an RFE?

Also, my fiancee and I are both fairly young (born in 89 and 90) but are quite sure about this decision in our lives. We've both noticed that most of the people on this board are in their twenties.

Are we more likely to get turned down for a K-1 due to our ages?

Has anyone had age discrimination problems?

We've messaged a lot but we don't have a lot of info (no letters or passport since you do not need one to go US/Canada), we have five emails each, photos from two trips, along with bills for our engagement rings, cell phone calls, and money spent on trips.

    Will this be good enough?

  11. Whichever embassy in Canada you put on the paperwork is where the interview will be as that's where the your paperwork goes after USCIS approval!

    Awesome! Thanks so much :)

    That is not true.

NVC automatically directs Canadians K-1s to their correct consulate, which may or may not be the one listed on your paperwork. I say that because 1) sometimes NVC makes mistakes and sends petitions to the wrong one (this happens very infrequently), and 2) many people don't realize that even though they may have a consulate in their area (and that is the consulate they put on their paperwork) only two US consulates in Canada deal with fiance/spousal visas.

Montreal deals with from Ontario eastwards, Vancouver deals with Manitoba westward (including Yukon and NWT).

Since your fiance is from Windsor, he will be dealing with Montreal.

Oh gosh. Apparently he's heard horror stories about dealing with Montreal, hopefully ours won't take forever.

  12. Your fiance is from Canada, Right? Well if so there's 2 in Canada: Montreal and Vancouver. so it's which ever one of those that is closest to your fiance.

And yes your foreign fiance will have to go to the US Embassy in Canada for an interview before getting approved a visa

First of all: congrats on your love coming home! :)

Second, thank you for the information. He's from Windsor so we thought he could do an interview in the US but I guess it makes sense for interviews to be held in someone's current country of residence. Sorry to be dense again but does it have to be the closest one to him (Montreal) or is Vancouver fine too?

  14. "20. Your fiancé(e) will apply for a visa abroad at the American embassy or consulate at:"

    What exactly does this mean?

Is it the closest embassy to where my foreign fiance lives? Closest to where I live in the US? Will he have to go there in person?

Sorry if this has been asked before or I am just not understanding it properly.
