Sorry for so many questions and I appreciate your time and effort to help me. I just wasn't sure about employment/educational history part on I-485 part because I-485 instructions do not explain this part clearly. I have to list 5 years of employment/educational history as it says. However: The most recent employment/educational history would be University but I graduated and I was unemployed all this time ever since I came to the US with a K1 visa. So should I list my unemployment first or should I first list the university where I graduated? It says also to write the source of financial support for unemployment or retirement period. Does it apply if you were studying? Since you technically were "unemployed" you were also a student.

Just to confirm regarding I-864, we can choose if we want to put all 3 years of annual income, or last two years, or just the most recent (2024)? I was wondering if my spouse can just do 2024, and 2023 only and leave 2022 as N/A even though he filed taxes? Because it is a little bit confusing, maybe the form suggest that you can write either the most recent or you can list down the last 3 years of income, but not two. Also, regarding the name change. My spouse and I both want to have both of our surnames together, basically a double surname (which is common for Hispanic people). He didn't write the new surname he wanted to have when we applied for the marriage certificate in the probate court. Is it okay if I write his new surname and mine new surname in the forms?

My spouse E-filed with Turbotax app, like 5-6 days ago. My I-94 and my stamp says my K1 (90 days) expires on 10th of March. I'm not sure if I should wait for the transcript or I should file now with 1040+W2. Since it is new year, her letter from the employment place shows the gross total income Year to date basically how much it was earned from 1st of January of 2025 till now. I guess transcript is better right than w2? Since you do not need to submit W2 or 1040 if you submit IRS tax return transcript plus paystubs of 6 months and letter of employment I guess?

I have a few more questions regarding the new I-485 form. 1. Part 1 Item 11 When I last arrived in the United States: "I was inspected at a Port of Entry and admitted as (for example, exchange visitor, visitor): Should I just write "K1 Fiance here" 2. Part 1 Item 12 and Item 15 have similar questions and it is a bit confusing if I should write the same date. Item 12 "Expiration Date of Authorized Stray shown on Form I-94 or type or print "D/S" for Duration of Status. I should write a date from the "Admit until date" line on the I-94 form, right? Item 15 Asks for "Expiration Date of Current Immigration Status or Type or Print "D/S" for Duration of Status. Basically it should be the same date as on the I-94 or the date on the stamp on my K1 visa, right? Or should I write here D/S or N/A? So technically my days expire after this date right which is on the stamp and on I-94 and I have to file before that. 3. Regarding Current U.S. Physical Address. There is a line that says "In Care of Name" If it is under my spouse's name should I write the new full name on all documents and all lines not the maiden name after marriage? Since we want to have both of our surnames updated. 4. Part 2 Item 2 Receipt number of Underlying Petition (if any) and Priority Date from Underlying Petition. It should be no, right? Is there any if I get admitted to the US with an approved K1 visa? 5. Also am I applying for adjustment from K1 visa under INA section 245(I) 6. Part 3 Item 1 Under Section 213 A withFamily based K-1 visa, I don't need an exemption and I'm required to submit an Affidavit of Support, right? Which is 1f as shown in the picture 7. Part 9 Item 64 Have you ever received long-term institutionalization at government expense? I'm not sure what it is.

Thank you for explaining me, I appreciate your effort and help! Umm, regarding the Part 6 Item 16, if my USC spouse filed taxes for all 3 years but in 2022 it is below the poverty line (because of the studies in college). Should I still list it or I should write N/A? Or they do not care that much and they look at the most recent year. So I'm concerned if it is okay to list total income from the 2022 transcript if it is below the poverty line.

Thank you for your help again Edward and Jaycel. I have an additional question just to confirm. In 864 form, part 6 item 7 "Current individual income" is it from IRS transcript or it will be the same income calculated from the paystubs and it is the same income you put in the "Household income" which is the Part 6 Remarks section Item 12 Household income? Also regarding the household size, as shown in the attached image, I want to confirm if we did it correctly since our household size should be 2 (me and my USC spouse). Because I read some people got confused about this part.

Thank you for your message Rachel n Tyler. I just saw one thread on VJ AOS forum that someone received RFE for not sending enough evidence for bona fide marriage. I only have an internet bill, I am under my spouse T mobile account but as far as I know it doesn't on the bill mine name and it is not possible to add someone's name on the lease right now only when we will renew it.

I have an additional question regarding I-864. I tried going through the forum and posts of other VJ members, but I saw different types of responses when it comes to income. My spouse is the one who will sponsor me and I'm not sure if the income is enough. Is it okay if we only provide income? My spouse's recent gross income is >20k above the poverty line. In 2023, it was 5-10 K above, and in 2022 it was below that because he was studying in college. So I am confused, do I need to provide IRS tax transcripts from the last 3 years in my package (2024 which was filed this year in February,2023,2022) or do I only need to provide only the 2024 recently filed tax transcript which is the most recent. If I understood correctly, if I include IRS tax transcript from the most recent year, I don't need to add W2s, or 1040. Only a letter of employment and paystubs for the last 6 months, right? If her adjusted gross income in the Tax transcript is above around >5-10k the poverty line of a household of 2 people which is 25,000$ Also, is the joint bank account really necessary right now? Because we couldn't open it yet in Chase bank. Also for the documents, is the birth certificate of my USC spouse, marriage certificate and the first bill for the internet under my name is enough? Perhaps can someone list the most important things I should include into the package? I have DS3025 in which my vaccination is marked complete.

Hello, I am planning to adjust my status after arriving with a K1 visa to the US. However, I have encountered a few unclear sections in the new I-485 form, and not sure if I understand it correctly. I would appreciate your help and assistance on how to fill certain sections in the form listed below. I read the I-485 instructions before writing this post and these questions are not explained. Part 1 Item 10 Nonimmigrant visa number. Is the K1 visa number is the one on the right bottom that starts with a letter and 7 numbers? It has shiny letters. Part 1 Item 14 What is your current immigration status (if it has changed since your arrival)? I am going to apply for AOS within 90 days. So I should write K1 Visa holder right or K1 fiance? Which number is A-number? Is it a number from my K1 visa when I received NOA1, and NOA2? Part 1 Information about you. Prior address, I listed the address where I stayed for 3-4 months most recently. Because my current address is in the US and I haven't resided there for 5 years. As a reference check the image named "address" that I attached to this post. Then next question is "Most Recent address outside the United States" Provide your most recent physical address outside the United States where you lived for more than one year. But I only stayed longer than one year in one address but it was 3 years ago. So it is not really the most recent location but that is where I stayed longer for more than 1 year. So should I fill in the address where I stayed in Sweden or the most recent one where I stayed 11 months? Part 4. Additional Information about you. Item 1 Have you ever applied for an immigrant visa to obtain permanent resident status at a U.S. Embassy or U.S. Consulate abroad? I marked it No, since a K1 visa is technically a non-immigrant visa. Is that correct? Part 4. Employment and Educational history. 7 Provide all of your employment and educational history for the last 5 years as indicated in the instructions. Including employment and retirement periods and list sources of financial support. It is quite confusing it asks employer or school and then they ask Name of the Employer, Company or school again. It is literally the same name. Then regarding the unemployment should I also list 9 days of unemployment as well? If I came with K1 visa and do not work right now, should I list that financial support as my wife (Fiance/Sponsor USC from K1 visa). Part 8. Provide your most recent employer or school outside the United States (if not already listed above). Again it is quite confusing. I already wrote a position outside the United States which was the most recent which is the university where I received my degree. Or should I write that first I'm unemployed first and then in Part 8 write the most recent thing was my university which I attended? Part 6 Item 1 What is your current marital status? I just married my fiance (USC), so it is okay mark "Married" right? Part 6 Item 9 Date of Marriage to Current Spouse. Do they want a date when we married or the date when the marriage certificate was issued? Because technically marriage is considered legal after the judge approves and signs the marriage license and the probate court issues it. Part 9 Item 43a Received any weapons training paramilitary training or other military-type training? So If I did temporarily a mandatory military service, does that count? Part 9 Item 50 Have you EVER served in, been a member of, assisted (helped), or participated in any military or police unit? If I served in a military academy for a little bit as part of mandatory military service I should mark this question as "YES", correct? Part 9 Item 58 Indicate your annual household income. Should you indicate the income from the IRS tax return transcript or W2? Part 9 Item 59 Identify the total value of your household assets. If we won't use assets in the I-864 form should we still mark the assets? Part 9 Item 60 Identify the total value of your household liabilities (including both secured and unsecured liabilities). Should my wife list her college debt? Part 9 Item 62 List your certifications. I understand the question but not sure if it is okay to list your skills as well without certification. As for certifications, it should be a high school diploma and etc? What other certifications are they referring to? I appreciate your help and time. I'm really thankful for any type of help.
