  1. I need help. I am a US citizen and my husband is currently in the process of the AOS. My question is:

    My husband's son (my stepson) would like to come live with us. He is turning 18 in September so we were married before he turned 18 and therefor is legally my stepson.

    What is the fastest and least expensive way to get him here?

    What about that "following-to-join"? Would that take longer?

    Yes FTJ would be simpler but not cheaper, you need to contact the consulate about the K-2 visa. FTJ needs to be done within 1 year of the K-1

    But would I have to wait until my husband has the green card before I can apply for the ftj?

    NO, why do you think so? It would be based on the already approved I-129F.

    Well because it says

    •Form I-824, Application for Action on an Approved Application or Petition

    •A copy of the original application or petition that you used to apply for your immigrant status

    •A copy of the I-797 Notice of Action for your original application or petition

    •A copy of your alien registration receipt card or I-551

    •Proof that the child meets the appropriate criteria for Following-to-Join Benefits

    He doesn't have an alien registration receipt card or I-551...I thought that was something that he got when he became a permenant resident...

    I was reading and it looks like that if I file the I-130 I will have to wait for an available visa number...where as the "follwing to join" wouldn't require an available visa number. The downside with that appears to be that I would have to wait for my husband to actually have the green card before we could use this option...is that correct?

  5. Hey all. I electronicaly filed permission for my fiance to work and am a bit confused if I have to send any information via mail. It appears that if you E-File, under our circumstances ( K-1 visa) that you don't have to send any information...only if you file by mail. But the information seems to be a bit conflicting and I just want to be sure...any one know?

  6. My fiance has applied for permission to work on his K-1 visa but I've just read that it will expire when then visa expires in 90 days. How can I avoid a gap in when he can legally work? For example, if he recieves his permission to work in a month ( we already received a biometrics appointment letter for 11/04) can we just go to the court house to get married and then immidiately file another form with the AOS application even though the permission to work will not have been expired yet?

    Any suggestions would be appriciated, thank you!

  7. Hey all...I know that it says that it takes three months to get the permisson to work but we submitted the request on 11/3 and his biometric appointment is already on 11/24. Will he recieve the approval then or is there a waiting period after that as well? Three months is too long to wait :( This process has soaked up all our money :(

  9. Hi all. My fiance called and says that his paperwork that he received from the consul says that he is supposed to bring a court paper showing that he is paying support but such a document doesn't exsist. He pays support for his children but it was a verbal agreement after his divorce and not written. If his ex-wife writes something and signs it saying that he is paying, will that be sufficient. Did he read the instructions incorrectly? Does he really need that ??

  10. I called NVC to check up on the fiance visa and they said that it has already been forwarded to the consul on Friday...! However, when I spoke to the woman on the phone she had indicated that they would send both my fiance and I information and that I would have a choice at that time to make myself the person whom they contact for anything needed for the visa instead of my fiance. This would probably work better as my fiance is...well he calls himself a brut because he is far from computer savvy and doesn't understand any of these forms. However, I am afraid if I am the person that they are sending all this stuff to, that it will take much longer because I imagine that they are mailing to me from the US consul in his country. Does anyone have any experience with this? I'm being told on this website to send all the info to my fiance but NVC says different...

  11. Sending a copy of the I-129F packet to fiancee for interview is just a way of having anything the the interviewing officer may request to see like the originals of evidence proving having met within the past 2 years.

    Ohhhhhhhhhhhhhh....lol. Thank you! Duh, that makes sense. So, is there anything else that I am sending to NVC or anything or at this point everything goes to my fiance? Sorry if I seem ignorant...this is just all so much! Plus, I'd hate to make a mistake that could cost me more time :(

    Sorry, one more question...how much money should he take with him when he goes to his interview?

  12. Hey All, thank you so much for all your words of encouragement. I am hoping that someone can help me once again. I am a bit confused...I've received my NOA2 and I read on the website here that I should send a copy of the I-129-F packet to my fiance for his interview? Don't they have this info already? Also, the NOA2 doesn't tell me to do anything. Will I recieve something now from "NVC" now requesting info or telling me the next step? Will NVC send me the form that I need to fill out for my financials? It's just like " congrats, your I-129F has been approved...have a nice day. Help...:(
