  1. <p> Exceptional hardship waiver for J1 To show that his/her departure from the U.S. would cause extreme hardship to his/her U.S.Citizen or lawful permanent resident spouse or child (mere separation from family is not considered to be sufficient to establish extreme hardship). Factors that will be considered when determining exceptional hardship include economic, physical and emotional hardship; loss of employment, educational and health opportunities, etc.Hardship to spouse can include:

    • Where the spouse would have to disrupt their education or career;
    • A situation where they could not financially maintain 2 households;
    • A situation where they would have to give up a medical practice to accompany spouse;
    • Psychological and other hardships.

    Thank you so much for the input. My friend submitted the requirements you mentioned but still were all denied. Now they are looking for some other alternative "if possible" for her to stay in US with spouse.

    Not sure if this is the right thread

    I just want to ask questions regarding my friend who applied for hardship waiver to obtain permanent residency. She came to USA over 10 yrs ago with J1 visa(internship) for 2 years contract but she did not go back to her home country after her contract. She went to another state and married her US citizen fiance. Now, they applied for hardship waiver for her to obtain permanent residency but it is taking so long to process and they ask a lot or requirements. They even hired a lawyer to help them with the process but I think the lawyer doesn't help them that much. She just wants to know what else to do besides applying for hardship waiver so she can obtain a permanent resident card. Of course she has been in the US illegally after her contract until she got married with a Us citizen. She wants to know if any of you experienced this? Or any adive and suggestions for her? Will appreciate your inputs. Thank you.

    A sister of my co-worker who is a resident of Singapore for about 20 years plans to move in the USA with her family for good, kids are 7 and 11yrs old). They have properties both Singapore and Philippines, the husband has a stable job is Singapore but willing to give it up when they pursue their plans of living in the USA for good. Next year, their family plans to visit USA(tourist visa) for couple months. My question is, what if an employer here in the USA wants to hire and sponsor work or immigrant visa to either of them? can either of them process the work/immigrant visa while here in the USA(under tourist visa)? or either of them should leave the country and do the processing in Singapore? They just want to know the easiest option. Any insights or has anyone experience this? will appreciate your response. Thanks in advance

  4. Hi, my sister's flight to US will be this coming Friday. We bought her tickets online CHEAPOAIR.COM. She is under F2A Category and her first time to travel outside Phils. My question is, is the terminal fee still 550php plus travel tax of 1650php? Will she pay all those fees before departure right? I have read in some that there are travelers that don't have to pay travel tax. Pls enlighten me. Thanks so much

  5. My sister had her interview last june 10 she rec'd 221g( w2 2014 and pics)..sent the addt'l docs same day then usem rec'd it the next day...status in ceac has been AP since then Last update was June 17... until I checked ceac yesterday it went from AP to Ready.. Last update still June 17.

    hey my friend, I haven't heard anything from him yet. It seems that he did not get any updates from the US Embassy. So I don't think he will get an interview soon. VB will be out in few days. Let's hope for the best.

  7. Medical exam fee in the Philippines will increase as well.. And the saddest part, my sister will repeat the whole medical process and pay another medical fee because her PD is not or will not be current for october and since her medical results will expire on oct.. she will have to do the whole process and pay the fee again. BTW, retro caught her while she was pending on her medical exam. F2A pd: 08/22/2013.
