    also, what are the requirements that i need to submit to the USCIS beside copy of my GC, Photos and the Payment. i am really confused because i do not have his BC, Copy of his Divorce paper, but i do have our marriage contract. help...

    You don't need his birth certificate, but you do need his prior divorce degree since you are still married to him. Best option is to divorce him before applying for citizenship.

  2. If it doesn't work out, don't prolong the pain. You should ask your relatives back home wire you money or book a flight for you. If they don't have the money, ask your finance to take out a small loan to get you the ticket. You can pay him back when you return home. Next time, prepare yourself mentally and maybe financially before moving to a new country.

  3. Adjustment status application = Green card application. You do not need to hire an attorney to do your paper because the process is rather simple. You need to fill out a few forms and provide evidence of your relationship, and that's it.

  4. Have done some research today - some European consulates do ACCEPT Advanced parole document as a proof of residency in US in order to apply for Schengen visa.

    But for example German consulates do not accept AP - must be permanent residency - Green Card or long-term working visas.

    So information could be helpful for AP holders who wanna visit EU and need visa to visit EU - apply for Schengen through French or Czech consulates. Then you can travel anywhere within Schengen zone.

    Still have to do more research on other consulates.

    You are wrong. You always apply for any visa to any country from the country of you RESIDENCE, not the country of your citizenship. If I go back to Russia to apply for Schengen - I don't have permanent address and job there - any EU consulate won't even take my application in Moscow.

    Technically, you are in the adjusting status, and you're not a resident yet.

    You can't pick any Schengen state to apply for a Schengen visa. It must be the country you spend the most time in your visit.

  5. First of all, your lawyer screwed you big time for recommending you to leave the U.S having known you overstayed your visa. Had you stayed and adjusted your status, you would have become a legal permanent of the US.

    Unfortunately, there is no waiver for you to overcome your 10 year ban, which was automatically triggered once you left the US.
