  1. Hi everyone.. i am a US legal permanent resident, I am planning to visit canada this summer.. anyone know the requirements? what do i need to show the boarder officer? do i still need my philippine passport? or just my state id and the legal permanent card? actually my philippine passport is already expired by the time of my travel.. what do i do?

  2. Got my EAD and AP approved, me and my family is planning to spend Christmas in Canada after our AOS interview on Dec. 23. Just wondering if i can travel in Canada without Greencard yet but i have my AP papers with me.. I got no clue how does it work.. i know for sure that im using my Philippine Passport.. i just dont know if in Canadian boarder they will ask for Canadian Visa. Or my Philippine Passport with US K1 Visa (expired) and the Advance Parole document is enough for me to show them so they'll let me enter Canada and go back to US. Any answer regarding this will be so much aprreciated. Thanks!

  3. hi just wondering.. is the signature taken in biometrics, is the signature that will appear in EAD card and in the Greencard? My story is like this, the lady taking my biometrics told me to just write in my whole married name since i didnt show them any valid id with my married signature.. which i dont have any but my passport with my maiden name and signature on it. So what i did is just wrote my full married name.. im just worried coz the signature i used in all of my application in AOS is my married signature.. it might not match! :( im so paranoid again!

no problem with that. i assume that when you say full married name that it's the longer one with your maiden name as middle name, vs the married name with just your first name and husband's last name?

if this is the case, no worry. :)

Yes.. actually when i filled out my AOS applications i used Maiden name as my middle name and my husband's as the last.. And when i got my AOS NOA1 it says there my full name using my last name as middle name! I understand (after i talked to the officer in biometrics, when she get me so nervous telling that in the interview they might not allow me to use my maiden name as my middle name not unless i have the court proceedings to retain it, she even advised me to just hypen my husband's last name  which when i asked my hubby.. he doesnt want the idea ) that it's not legal in US to use the maiden name as middle name. But on my side, its a false mistake.. i know nothing about it since in our culture (Philippines) once you get married you wil use your maiden name as your middle name. I got no problem with that if they say it's illegal.. they can dropped my middle name and just use my first name and husband's last name. And i explained to her that when i applied for my SSN after i get married they allow me to use my maiden name as middle name.. But i guess, if they will approved my applications and dropped my middle name i need to go to the SSN Office to have them change my name without middle name on it. So i just hope everything will be fine.. i can just explain it to the interviewer. Im just worried that in my EAD/Green cards, it might show the signature i had in biometrics! Coz i typically just wrote it as it is!

    Thanks for all the replies

  5. Filed AOS Packet (k1/k2 Visa holders) last October 1, still not getting Letters from USCIS. How long does it take to get it? Just wanted to know because the check is not cashed in yet.. been checking our account. We filed with Joint Sponsor.. is that a problem? I mean i am thinking maybe that's what taking it so long.. just worried. I know it's only been a week.. just worried. or maybe im just paranoid hehe

  6. I doubt they made a mistake. What evidence did he submit to support his self employment? They use line 22 of the tax return OR the current income. My guess is he did not support his self employment income sufficiently or miscalcualted it. You can claim as income ONLY the amount which is reported as personal income, NOT the gross business income which is then expensed or costed out to establish personal income. If the supporting evidence of self employment is not sufficient it will be discounted and they will rely only on the documented income, which is not enough.

I am not sure what you mean by separated tax returns. ALL income is reported on the 1040. There would be a separate schedule C for the self employment (or 1099) but that is part and parcel of the 1040 and reported on the 1040. Sounds to me like someone does not know how to report income and that is the root of the problem.

    Hi Gary and Alla,

Thank you so much for you reply.

I have 2 more questions for you.

1.about I-864 25. my total income (adjusted gross income on IRS Form 1040EZ) as reported on my Federal tax return for the most recent three years was:

For 2008, I put the adjusted income in there as it requested. Was it correct?

    2.about I-864 23. My current individual annual income _______

What amount should I put in there?

The estimated income of 2009, adjusted gross income of last year's tax returns, or line 22 of last year's tax return?

Hi! You should compute your income this year not the previous year (not from the last year tax return) it's like you need to derive your income. For example you're earning $15/hour x 40 (if you are working 40 hours/full time weekly) X 52 (# of weeks in a year)

    15 x 40 = 600 x 52 = $31,200/year

but you need also supporting documents for that like employment letter and pay stub

if you are below poverty line you will joint sponsor.

  7. If his annualized income for 2009 (meaning what he will earn for the entire year, not just up to this point) does not meet the requirements then you will need a co-sponsor. A co-sponsor can be any USC or LPR, not only a household or family member.

Yes, he will need to complete the I-864 as he will always be the primary sponsor.

Ok. thanks so much... Does it mean that we can have his dad as the co-sponsor even if his not living with us? I mean not on the same household? what form does he need to complete then? Thanks,

  8. Hi! We just found out after deriving my husband's employment income this year, he doesnt meet the income requirement.. it's like $1,000 short when compared to 2009 Poverty Guidelines.. My question is, do we need a joint sponsor? We are living dependently, so there's no one in the household who can help us but his father living in the same town, can he be our joint sponsor? Or my husband just need to fill-up the I-864 even if it's $1,000 short? Will his Income tax returns for the past 3 years will help to meet and establish his ability to maintain suffcient income? beacuse his last 3 years ITR over-exceeds the Poverty Guidelines. In short, even if he doesnt meet the income requirement after deriving his employment income this year, are they going to based that in his ITR for the last 3 years? Any answers will be appreciated.. We are running out of time.. and we wanted to submit the AOS. Thanks again.
