    I have one suggestion, why not include a format for affidavit from friends or families that they are aware of the relationship. We didn't use any because we had other proofs but still others may need it, also at least with Indian consulates they do ask for these affidavits during interview time.

    And did you hear anything yet? its going to be 12 noon in anther 2 minutes in India.

    Loto, you mention that I-129 or rather K3 visa is free, which I thought was not the case. Since VSC forced us through CR1 by approving just I-130 we got the I-129 fee waived off, if it wasn't the case I presume we would have paid the I-129(K3) visa fee and got that processed first. Isn't that the case, am I missing something here.

    Secondly, do you know if NVC assigns the interview date and then sends the case to the consulate. If this is true, it would be nice to add this too.

    On a general note, while i look at the document it feels as though all this will happen in the first few months which is not the case and while most of us have been waiting around an year now. Probably a disclaimer in the document will help people set the right expectation.

  4. Hi everyone just wanted to start a thread for people who have had there case done at NVC In June or July and hope to get a August interview date.

    My wife was approved June 19th at NVC but they said all July interviews in Manila are booked and we have to hope and wait for a August date. :wacko:

    Has anyone already gotten there interview date? Can you find out before they send the appointment letter by calling the automated phone recording or do you have to talk to a operator?

    Has anyone paid there Delbros in the Philippines already before getting there interview? I heard you can pay delbros now but still have to wait for the Embassy to send documentation verification to them, so it is not any faster?

  5. So you sent in the documents but they said they never got them at all right? That is what the RFE was for? not that the police documents themselves were wrong. I am so worried about sending those in today, they are originals, (they dont need to be translated by the way, sorry no one told you :crying: ) but they are different looking from state to state and the only one that was notarized was the federal one, the other 2 states ones did not have to be from my understanding, what did you do exactly for your police certificates?

    My understanding, including what my lawyer has told me, is that they need to be translated. It also says that on the NVC website. I know there is some dispute about that (and even NVC officers have told me different things), but my understanding is that translations are required for all documents written in a foreign language.

    You might want to do a post, asking if people generally send in translations or not or whether anyone has gotten an RFE for not providing translations - I have never heard from people one way or the other on that...

    Yes, I did send in the original documents the first time around, but then the NVC said they did not have them. As for the police certificates themselves, I believe we did the same thing as you. The federal one does need to be notarized, though the state ones do not.

    My guess to avoid RFE in such condition based on my experience is to have a proper cover letter indicating the purpose of the document and explicitly mentioning that it is original or certified copy... like Saradanielle mention, that is equivalent to saying.. you dumbos look at the seal in the document. My idiotic lawyer didn't do in spite of we telling him and hence we ran into this issue.

    Saradanielle, since you are done with all this sit back and wait for case complete.. and all the best for your interview :star: And I plan to have all these document copies for the important one original/certified copies to the interview as well, just in case.

    No , no translations needed as long as they are in english or portuguese, if it is a foreign language for Brazil then yes. But NVC website says any language that is not in english or the language of the country in which the visa application is being filed needs to be translated. Edgarvirginia can tell you that too, they sent in portuguese only too. It has been stated in many forums so I am so sorry that your lawyer made you go through all that money (translation in Brazil is so expensive). Tell him to brush up on the NVC filing rules and ask for some money back!!!!!!!!!!!! Good luck to you too, who knows we might see each other in Rio, my DS 230 arrives tomorrow to NVC.

    Oh, I understand. Yes, it is very unfortunate that I have spent so much money on translations. Well, it is all over and done with now, so I suppose I can't do anything about it. I just hope that they accept the documents and complete my case already! Anyway, it is very possible that we will have similar interview dates, if you get a quick go-ahead from NVC. I (like everyone else) am just done with waiting and I want it to be over with already!! Anyway, I hope that you get a case complete ASAP (and I hope I get one too!)

    Interesting - we sent original Police Certificate along with other originals or certified copies of things and they say they only got copies - will resend and make sure there is a note attached saying "------->look at seal showing certified ------but interesting!

    hmm... we had something similar.. resending it might take longer (1-2) weeks, talk to the NVC operator preferably 7:30 A.M in the morning and tell him/her to put a note in the system that they are certified copies and requesting them to recheck, we had our case complete in a day after this. All the best.

    thanks for the info. my case # starts with NWD. So interview will be in Delhi?

    Just wondering why the packet 3 would come all the way from Chennai...is that normal?

    Check out the appointment schedule list on the New Delhi consulate website to confirm you have been scheduled for a interview in this embassy and do write a email to them to confirm the same and also check for the reason the packet 3 came from Chennai. As per my knowledge that shouldn't be the case. Getting a written(email) confirmation from the New Delhi consulate and carrying it with you for the interview will be a good idea to avoid any issues.

    Shouldn't the marriage be registered quickly then? Can the marriage be registered at the place of marriage even though it is not spouse's district?

    The passport has address but written in pencil, since it can change. So I don't think that will be sufficient address proof.

    Hi Yeye, my case is similar to yours and I am done with this process of registering my marriage . Once you have gone through naturalization you can't take up the route of Hindu Marriage act(even though you were a citizen of India earlier and do have a permanent address in India). Religious ceremony is no way related to the civil marriage or registered Marriage in this case. You will have to submit the application 30 days prior to the marriage and get it registered on any day after the 31st day. The address proof can be your driver's license in the U.S.

  9. I´m dying to hear those words from NVC!

    When you all heard "case complete" was it from the AVR or from an actual operator?

    It hasn't happened to me yet, but I beleive that you would hear it faster from the operator... but the phone msg, shouldn't be far behind. I just called and the operator said , give them 2-4 weeks to process the information. I'm hoping it will be next week. :whistle:

    2-4 weeks??? Why are some people's cases complete after 3-4 days? Does it depend on the country the petitioner comes from? We quadruple checked our papers so I know nothing is missing or incomplete. So frustrating!

    "2-4 weeks to process the information" this is a standard statement of NVC operators and they have been taught and asked to say that.. so don't worry.... you should get your's sooner...

    If I buy ticket for my wife from here, will they give her hard time at the airport if she has eticket instead of paper ticket? I could have her buy the ticket in India but if I can I would like to buy it here and then just e-mail her the eticket. I've heard that they like to see paper ticket when travelling for the first time but not sure how much of that is true.

    Please share your experience with coming to USA with an eticket. I doubt that an eticket would cause a problem these days but you never know!!!

    etickets are turning into an airline policy across the board, and Indian security personnels are used to accepting email confirmations for tickets. all they check at security is name on the eticket, date and if lucky check the person and passport photo if they match :)

    Airport in reference - Mumbai and Bangalore, donno about the others, i would assume the same considering most low cost carriers in India have etickets

    Yes, eticket is the norm these days.. :) inclusive of international travel. I have travel to US from India with etickets few times and had no issues at all. So nothing to worry.
  11. No need to worry everything will be fine.

    My fiance was denied a tourist visa and she was asked a few simple questions about it and that was all. Just make sure your fiance answers the questions honestly with nothing to hide and everything will be fine.

    If your case is straight forward DON'T GO TO THE LAWYER. Read up at VJ and other resources available and ask questions at VJ and I would suggest you do it yourself. Going to Lawyer for a straight forward case is not just waste of lots of money, but you end up spending a lot of time waiting for them to react, while you could have very much done yourself, rather than following up with the lawyer to do it. These are my 2 cents.

    Wife finally got the PCC from passport office!!! She says the PCC was folded and placed inside the passport. When she unfolds the PCC she says it looks like two originals with perforation or whatever it is in the middle.

    So the question is, since I have no idea how this PCC looks like, do they give you 2 originals? and did you keep one original and sent one to NVC or send both to NVC?

    Please advise asap....

    yes they give two certificate, one certificate will be taken by consulate while submitting papers at vfs , who will put that certificate in sealed brown cover when you enter usa, which is kept by them....

    and you will have the other one....(pls keep it, you will need if you do aos process or for future)

    its simple certificate saying that there is no adverse information against(benificiary name) with date and issuance place and passport number , etc.....

    and that person can travel ....

    and in passort there are two stamps given by regional passport office

    1) regional passport office stamp

    2)ministry of external affairs stamp(govt of india)

    You will have to send one to NVC with your wife's DS-230 Packet and with all the original documents they will return this as well during the interview.

    I also noticed in my copy of I-130 my employer's company name is INCORRECT by one letter. For example... Instead of "Bullet Compnents" which is the correct spelling, it's spelled "Dullet Components" which is INCORRECT. Would I have to correct this with USCIS? :unsure:

    If your co-sponsor lives in the same household(address) as you (i.e., he/she is the household member as well), then you need to add that to the number. You don't have to send a copy of I-130 to your wife. About the spelling mistake if I was you, won't worry about it as it is just one alphabet... but that is just me :)

    does she need proof of payment for the I-130, not the copy but the proof of payment? The payment was $190

    Nope she doesn't need the proof of payment either.

  15. My husband is a US citizen (caucasian) and we got married at 2004. That time around we were told that getting married at Arya samaj is enough ( I admit we both were pretty immature regarding all these technicality of getting married). The lawyer I contacted a few days ago told me arya samaj wedding comes under special marriage act and its pretty valid according to Indian law.

    I still do have fear about the court papers, which we haven't been able to provide.

    So basically me and my husband are going to register the existing marriage if we do get an RFE.

    I have been researching on this subject and the legal way of registering the marriage also takes 1 months time.

    I just hope my husband gets leave from work for around 45 days if that does happen; you guys do know how things go in India, 1 month can go upto 1 and half months.

    This makes it clear. Anything related to a foreign citizen is stricter/harder in India these days. I went through the same process, only difference is we had both our traditional and legal wedding close by. I don't think there is a way out other than your husband being present in person for the legal wedding/registration. But one thing you can check with your lawyer is if the form submission i.e., 30 days prior to the registration, if that can be done without him. We tried doing this(while my husband is an Indian origin and still has roots here), but the officials insisted that he should be present in person, but he didn't have much to do legally rather than just makes his presence felt :) during form submission. I feel it depends on the officer / office you are talking to. If this is possible your husband's India trip can be shortened.

    One piece of friendly advise is, even though you don't get a RFE, I would suggest you get this registered later sometime at least as you would run into this problem in the future for any kind of legal requirement. All the best.

    Most of us gone through Special Marriage Act which takes 1 month, i can understand the pain but this is the only way in india for marriage solemnization.

    I know the other way as well but i read someone got Visa denied because he could not prove his marriage terminology in interview. he shown his court marriage certificate which was not enough for CO.

    It is special marriage act if your husband is still an Indian citizen and is a PR in U.S. If he is a U.S citizen, then it has to be foreign marriage act, which I think is what your lawyer gave you as a second option.

    [Disclaimer for this sentence, I am not a lawyer] if you are getting legally wed again, then you will follow these, if you have been wed already, I mean few years back and now just to registered your traditional wedding, the process might be different and shorter is what I understand. In such a case, you won't have a wait period of 1 month etc. I am sure you should find references of these on the internet.

    Immunizations is very simple and nothing to worry; Collect a certificate/record for the vacinations taken now and show it to the panel physician along with the reports you get from lab. He will determine if you require anymore vaccinations as per ur age. If he gives anymore vacinations he will charge you seperately for that. If you don't have any records you need to take all vacinations which ever they suggest.

    VFS: atleast 3 days before interview you need to pay a fee of rs 365/- to VFS and hand over any documents requested by consulate/NVC; like any orginals, proof of relation stuffs. You can also carry such documents for interview straight.

    Dunhill, can you please share your experience related to immunization at your medical. I basically have no immunization records from my childhood. Now I have taken Hep A & B(3 shots, will complete 2 shots by the interview and plan to take the 3rd one in US :) ) and Vericella (2 shots). So by my interview I will have records for these.

    And can you please let me know what is the VFS formality in detail. All the best for your interview.

  19. ... we didnt receive the AOS bill yet (and they sent to us on 04/28, 2 weeks ago!!!), my husband dont want to pay the bill online... he try to call NVC but it is impossible to talk with a person... they accept my agent (i sent an email - because we didnt receive the form either... it is normal to take that long to receive the bill?

    Online payment works, we paid, and print the barcode cover sheet on the same day. Save lots of time. We have not got any email from NVC so far .

    For us also it took close to two weeks. It also depends on where you live in US. Usual mail standard :). So look forward you should get it anytime soon. We are also like you, didn't take the online route as this is not officially announced :). Lets trust our instincts ;)

  20. My wife's interview will be on June 5th! Geez, this is totally unexpected. I just gave NVC a random call this morning and decided to talk to an operator about when should I call in order to inquire about the interview date. She said I got an interview date for you now. I only said, "wow!" I was expecting the rep to tell me to call back later this month or even next month to find out. After all, my case was just completed at NVC on May 8th and HCMC post is well-known as one of the busiest post.

    I called my wife and her heart was pumping very fast heh. We are both vere excited right now. The funny thing is that I already scheduled and booked my flight for a vacation to see her from May 30th to June 16th. Right now, we're still deciding whether I should take her home with me on this trip or wait until September trip for her to relocate to US with me as we have planned. Anyway, thanks VJ community for all the resource and guidance. I would not reach this point in this journey without that help!

    I guess our lawyer is going to be our choice of agent but I am not sure. I have been reading other posts and there they were saying how their lawyer got the NOA-1 and then the lawyer forwarded them that receipt, but with us, its my husband (the USC) who got the NOA-1.

    Silent, if you are getting this done by your lawyer, you are right. Lawyer will be the choice of agent by default. Only NOA-1 hard mail is received by USC(and by the lawyer as well) all the other correspondence from NVC will be only to your lawyer. Hope this helps.
