I recently got my US Citizenship, and i wanna petition my mother to come here in America. I don't make so much money in the past few months and i don't have a full time job yet. I think my average earning is less than $25,000 a year. I don't pay rent because my mother-in law owns the apartment. I don't know if my husband will help me since he do not want my Mom to be here in America but i will still do it anyway. I don't have Family here so, i want my Mom. My mom can still work and she is strong. If she come here, she will not depend on any government help.

Can anybody help me? I don't do food stamp or anything that depend on the government. I'm getting unemployment but not very much.

Any help i can get, i will really appreciate. Thanks.

I have a few Questions,

I wanna Petition My Parents, and my sister and brother. The only issue i have is my Dad, He had stroke 3yrs ago and he can not talk, but he can walk and understand. I wanna know if i should petition him too or not.? I wanna make sure that USCIS will not deny my father due to his condition, and waste our time and money.

1) Should i petition my Sister (27yrs old) and brother (21yrs old) now or wait till my parent get her and they will petition them.

2) My brother has 2 kids and girlfriend, Can i petition them too or wait till my brother get here?

3) how long will it takes to process my parents petition and my siblings petitions?

4) What form should i file?

My husband lost the copy of his Divorce Decree, Can this affect my Application for N400? USCIS has Copy of it when we File K1 and Removal Of Status. We try to look for it and we can't find it. His ex-wife remarried after their Divorce and She's been deceased for 3 years now. I just wanna make sure that this will not affect my application. Will send it today 4/24/2012

I had my interview Yesterday and My ROC was approved right after the interview.

So, What's next?

I've been in US for 3yrs now and Married for 3yrs.

Can I Now apply my Citizenship?

My husband want me to be independent that's why he's not putting me on this things...

I am so frustrated here. We have not had any updates, touches, transfers, or interview letters. I figured it was because the system was not updating our case information. so, i decided to call USCIS to see if they had any other news for me. The lady that answered the phone was less than pleasant and took me for a moron. I finally said "so you are using the same database that I am to look up the case information." after a little bit of a struggle, she admitted that they very same database we use on uscis.gov to look up the case status....so it does me absolutely no good!

i just want to have a clue about where our case is. I know people wait for years, but this is infurating. So...i asked her if the infopass people would have more info. she said they do, but wasn't sure they would be willing to share. So, i made an infopass appointment to get an update. Just remember, the last time i talked to the uscis people they confirmed that my AP was wrong and i would have to re-apply (not true..after an infopass appointment we found out it was correct after all!)

We have the same situation. I feel bad too. No touch, no interview and no transfer not even a mail. The last update I have was July 15. I called them too and I have the same answer. I don't even know what happen to my papers. The other has their interview already and I still don't have. They told me that in San Francisco office they are processing February 2008. So I still have 5-6 months to be process. They also told me that it takes a 12 months processing.... Why is that other June and July filer got their GC if they say that the processing is January 2008 or February 2008? That is really strange....

What else can I do??? """NOTHING, BUT TO WAIT FOR THEM TO PROCESS"""" EVEN IT TAKES FOREVER....

Congrats Jackielibera! It is my first day at work tomorrow, I had my first job interview 2 days ago, got a call today and already I am about to start . It is sales, but great for start, and also just across the street from where I live. I was so lucky they needed someone urgently. Couldn't be happier for now

I just called USCIS. The lady was so sweet and nice and she looked up my case for me. She said my case has no RFE and she said if my case has not been approved within 70-75 days, I am allowed to call them and request for service.

So they can take a look at my case.

So if you are waiting for over 80days, definitely call them.

I had no idea how to reach the customer service, so I just went to the address change and went to customer service. I just said oh sorry, I did not know. The lady said that's ok.

Thanks for the advice. When nothing came in the mail today, I called the number on the page with information about each case (the receipt number links): (800) 375-5283. After continuing in English, I chose option 2: to check the status of an application. Option 1 is for if you know your receipt number, but it wouldn't accept my receipt number (it kept telling me that I hadn't entered enough digits), so I chose option 3, which is for if you've lost your receipt number.

The woman I talked to was business-like and helpful. She got all 3 receipt numbers from me and looked them up. She didn't see any more information than I have except that they are all at the National Benefits Center in Chicago. (Aren't they processed somewhere else?) She was also able to confirm that no RFEs have been sent out.

She then told me that they're processing cases from March 1 and that cases can take longer at times due to factors such as how many applications were sent in before mine, etc. I responded that I take part at an online forum where people record application dates, and that numerous people who had applied at around the same time or after me had had their EADs and APs approved. Because it had been more than 60 days since I'd heard anything, she did a service request for information about my files. I should be contacted about them within...[drumroll here]...45 days. Probably closer to 30 days, she said, but I expect to have my EAP and AP well before 30 days. But if my files are stuck somewhere, at least the service request should be able to get them unstuck. We'll see.

I file the same day as you do. I got my EAD now. I guess they are not organized,. Sorry about what happen. maybe this week you will get some good news... Good luck...

I went to SSA office to apply for a new SS card with my name change adding my husbands last name. I was on line waiting and when my turn came, I was told that I have to have an original certified marriage license together with my EAD. I wnt to court right away and got a new certified copy of my marriage license.

I went back to the SSA, this time everything was in order BUT the guy said it looks like the USCIS did not post your new EAD in the system that is why I can not see it. (I guess he was checking electronically to see if the EAD is authentic or something like that) He said because of that, the new card will take about 2 weeks to be issued !!! Anyways, I told him that I have applied for many jobs and might be called for an interview, can I use the old SS card until the new one arrives. He replied that he will have to keep the old SS card, which makes me wonder WHY? and what guarantee that they will destroy it or it will be mis-used ....

Anyone has similar experience?

SORRY ABOUT THAT... I DID CHANGE MY SS CARD WITH MY MARRIED NAME. THEY ONLY ASK FOR MY EAD AND PASSPORT.... AND EVERYTHING WAS OK AND TODAY I HAVE MY NEW SS CARD WITH MY MARRIED SURNAME. i JUST DON'T KNOW WHY THEY DO THAT TO YOU.... GOODLUCK TO YOU

Wow, AOS approved. That was so fast! We got the email from CRIS this morning stating that the welcome letter has been sent, but the approval was from yesterday. Awesome, I was not expecting this so quickly.

I cannot even get a State ID. Mine is already expired. DMV said I have to get EAD, so they can renew my ID. I cannot even get a driver license. I feel that those officers are totally ignoring my file!!!!!!!!!!!!!

How come they cannot process cases based on the received dates?

I had same situation as you do. Ans its true that you need EAD to pursue the processing of your STATE ID.... all you can do is wait for your EAD... and once you get your EAD you have to go to SSN again to change your name to your married name and it process 24 hrs so you can go to DMV the next day to change the name again so you can get the STATE ID.

They will get your SSN and they will send you a new SSN with your married name... When you get you Green Card you will be needing to go back to SSN and update it....

I hope i help you with this. Don't get so frustrated, this people are doing their job and they are following rules.... GOODLUCK to you....

My husband called the USCIS and they said we can only file for AP and no charge or fee. They also said as soon as we get the notice of acceptance we can call and ask if can do it a little faster and tell them the situation....

I have no touch since July 15... i don't even know if they already transfer it to CSC.... we also ask about my status and they said they only processing the month of January. i don't know if its true because only they said March, and as i read here in VJ the june filer get the GC already. so i still don't know which is true....

Guyz, i have a question... I already have my EAD. I did not file AP because i never though of leaving the country until i get my Green Card. Now i Need to go back to the Philippines because of my father. He is so sick and the doctor don't know what's wrong. He have stroke. I want to go back home. My question is, if i file AP how long will it take and do i have to pay a fee or something??? IS there any other way i can go to Philippines and i can still came back here in America???

Yes, that is because the 90 day EAD is not intended as a viable work permit. It is included so that K1s can get an SSN, which some states require to obtain a marriage license. Without it K1s in certain jurisdictions would be in a situation where they were required to marry in 90 days but unable to obtain a marriage license until they married and adjusted staus.

The intent is obviously not for K1s to all find <90 day employment then have to quit. Yes, they must have documentary evidence. So if you go and get a job with a 90 day authorization the employer should correctly ask what documentation will you be able to show me in 90 days? Will you have work authorization documents beyond then? The above law makes it clear to employers that unless they are hiring for under 90 days their employee will be illegal at that time and they will have no documentation and you'll both be in violation of the law.

If you've found a great 89 day job in the US, more power to you. I'm not knockin' it. A K1 visa is documentary evidence that by law you are work authorized for 90 days because by law, you are work authorized. It can therefore be presented at SS office to obtain SSN.

I'm not a lawyer but I've seen these discussed extensively here and on candleforlove.com and the relevant laws seem to back this up. That is why POEs stopped routinely giving the stamp.

Having a stamped I-94 has nothing to do with getting a social security number. K1 holders are work authorized so they can get a job. USCIS is responsible for an individual's work status, and the Social Security Agency is responsible for issuing an individual with a number. They are separate areas covered by separate laws.

I think you're making a few leaps in the interpretation of the Code of Federal Requirements and the I-9 rules. It's illegal for an employer to disregard an application or refuse to hire an applicant based on the future expiration date of a document. The fact that you have a 90 day EAD does not mean that in 90 days you'll necessarily be ineligible to work, it just means that specific document expires. The status may still be valid. It just happens that in the case with K1 holders they do become ineligible unless they have obtained their [c][9] EAD before the [a][6] stamp expires.

A K1 visa is not documentary proof of work authorization. I'd like to see which law says it is, when I've shown you the law that says a K1 holder must apply for documentary proof of authorization. A K1 doesn't prove the work authorization, just the status.

But if you can show me some immigration law that backs up your claim, I'll happily read it. Until I see otherwise, I'll go with the law in Title 8 CFR §274a.(12).(a)

Mine never been touched the only time it was touched is when they email me that the production of my EAD was already order... and after few days i received my EAD on MAil.
