  1. I have been reading up on the 245(i), and under this law sisters are forgiven but must pay $$ for overstaying if their priority date is before Apr. 30, 2001 and the petitioner is a USC.

    If you are thinking that the sister will be forgiven for overstaying while waiting for the priority date to become current, you are mistaken. For immediate family members of USCs, an overstay will not be reason enough for denial of an adjustment of status. However, for everyone else (not an immediate relative of a USC) the overstay will absolutely cause a denial of adjustment. Siblings are not included in this definition of immediate relative.

    My mother is a USC petitioning for her sister. I am very grateful for any details on my questions below, or any additional information you consider helpful.

    My aunt's I-130 was originally filed in April 2010, which has just become current. I am in the process of Adjusting her Status with the I-485(including I-693). She is covered under the I-485 (i), and should be able to stay in the US. I have been told that there is a forgiveness letter that needs to be submitted as well? Is this true?

    In addition, my aunt's application includes her husband and two sons. I have filed out the I-325a, I-485(+I-693 from doctor) and I-765 for each. Do they need to fill out the I-485(i)? I wonder if her two sons need to pay the I-485 (i) fee, or may they be exempt since they were very young when they arrived - 5 & 6 receptively. The two boys have only attended school, and never worked.

    My mother has filed out the I-864, and my father is serving as a joint sponsor with the I-864a.

    My understanding is that it is all mailed together in the same packet to USCIS, PO BOX 805887, Chicago, IL 60680-4120 (USPS).

    I believe it might be best to have separate checks for each of the applicants? Is there a cover letter sample already for sending out this group of forms?

  4. I have tried to communicate with the Red Cross for weeks and coincidentally I found it the night before the appointment in el Centro Andino first floor. The Red Cross in el Andino direct number is 621 3111 ext. 123. They said that they have trouble with the number listed on their website. They have very long service hours. It was something like from 9:30 to 9:45 but call first to confirm. They gave me a price list of the three principle vaccines needed and it ended up being more expensive then having it done with Dr. Roa. The prices at the red cross are the following: Varicella 102,000.; MMR(triple viral) 25,000.; TDap (DPT)80,000.; and el carnet Internacional 4,000. While with Dr. Roa these three came out to 203,000. Dr. Roa uses a group in the same office builidng named IDE(Imunologia y diagnostico especializado) and their number is 214-9403 if you want to compare price with them and the red cross in the future, since my prices will eventually change. this groups also has another office at Cra. 9 #48-40, consultorio 402 and telephone 570 0028 0r 570 0029. I don't see why Dr. roa shouldn´t accept vaccinations from the other office that's not in his building or in the fact the other female Dr. Just added this info. in case this second address is much closer.

    My husband said that the exam went well. The doctor was fine. No complaints on his part. Feel free to ask if you have any questions.

  5. I had posted this on Club Colombia II, but thought it can help you find out the prices. I have numbers you can call to find out prices by the time you come around to your medical. Keep in mind that the prices below are for an adult, and if its for a female under 26 you need to add the HPV. Of course, it all depends on what vaccines you need, but the main three are listed below. Once you have your appointment with the doctor ask the person on the phone what vaccines you need. They can give you this info. based on age and gender, although keep in mind your medical history.

My husband had his medical exam with Dr. Roa yesterday, and on the vaccination worksheet in results Vaccine History Incomplete then Applicant must be eligible for blanket waiver because vaccination not medically appropriate was checked off. I believe this is because he did not present his vaccination history and has had varicella. The Doctor gave him the MMR shot and the TDap. I just want to make sure that this shouldn't be a problem for the interview nor at POE. --thanks!

    tengo una pregunta ... es que yo la verdad no me habia fijado bien en lo de las vacunas que me dio el medico y en dos de las vacunas en la DTP y la de la triple viral esta tachadas la X donde dice insuficient time interval.... no entiendo porque

    y abajo dice en resultados : vaccine history incomplete y que el aplicante may be elegible for blanket waiver because vaccination not medically appropiate ....

    alguien me puede explicar esto ? ... voy a tener algun problema o me va a tocar volver a ponermelas o alo asi ?

  9. how can i reschedule our interview date for later in the week? this really sucks and never thought i would need to even think about rescheduleing but our interview date is tuesday April 14 and unfortunetly is the week of semana santa (holy week) and the medical offices will be closed the end of the week. i called today to schedule an appt. and they said for the 7th, therefore the 6th she (my fiance) would need to get her laboratory exam. we dont know anyone in bogota and really cannot afford a whole week (even more) in bogota....would we have to write a letter asking to reschedule our appt. for friday april 17? would they do this and what excuse would we need to give? does it need to be faxed with all details like when send the packet 3 documents? thanks everyone

    I know Omar G doesn't need this information any more, but just for future readers. I am not sure if you can postpone it a week, but to make changes to your interview email IVBogota @state.gov . We postponed our appointment months later, and they were helpful at the embassy. They asked me what month I wanted my interview for. I had asked for Sept. but they forgot to schedule my appointment on the first round. I sent them an email reminding them of our previous conversation, and I mentioned that I did not mind if our interview was for October. (we are both living in Colombia thats why i have been flexible, and my husband has to finish a project before he leaves) On their second round of scheduling Sept. interviews, they scheduled us for Sept. 29th.

  10. I want to verify that I am correct, if not please clarify. My husband has his interview at the US embassy before our 2nd year anniversary, but he will be entering the US after our 2nd year anniversary. Since we are entering after our 2nd anniversary, I believe that he qualifies for permanent residency am I correct? Also, who does the person at the POE select which one he qualifies for?

  11. My husband and I have both received emails asking for my financial information, but I have already sent this. I check NVC automatic phone message and according to the phone message my case is complete. I am completed according to the phone message. I am starting to believe that NVC email service has some sort of glitch, has this happen to anyone else lately?

  12. In most cases, visas will only be renewed if you have a very good reason (kids who will immigrate with you still in school and you want to wait till the holidays, immediate relative died and you need to settle the estate etc)

    My husband's interview is coming soon, and i was wondering if we can can extend the initial 6 months granted after our cr-1 is approved at the embassy? My husband is working on a project that needs to be completed before he leaves. any help is appreciated.

  13. is there any way i can stall/pause or delay the process? We are thinking of possibly spending some time in Colombia until the situation in the US improves.

    Better if to go to the US and get the GC in hand and then return. Can stay up to a year without problems. Alls you have to do is file a I-131

    Will filing the I-131 avoid the following problem:

    "When a person is given LPR status, they are expected to make their actual home in the United States. If they leave the U.S. for anything other than a temporary purpose, they will lose their LPR status automatically. This means that when they attempt to return to the U.S. after having automatically abandoned their LPR status, they can be detained at the port of entry and held pending a determination of abandonment by an immigration judge. In many cases, such returnees are not told of their right to a hearing before an immigration judge and are simply put on the next flight out of the U.S. For this reason, it is important to understand what constitutes a “temporary” absence and what constitutes abandonment of LPR status."
