  1. Hi, looking to clarify some information and understand if my case (which was filed under F2A) is now considered as aged out and not eligible for CSPA. My DOB: 12/17/01, Priority date: 09/22/22, I-130 approved on: 10/28/24, Petition became current (F2A): 10/1/25 Based on my calculation my age would be 21 years, 8 months, 8 days, so it would not qualify. However, I read on USCIS website that a different clause applies for "Determining When a Visa is Available for the CSPA Age Calculations for Adjustment Applications Filed Before August 15, 2025" I am located overseas so I am not applying for Adjustment of Status. Can anyone tell me if that clause only applies for that or for other "sought to acquire" requirements as well? I did submit the AoS and paid the fees and I actually am Documentary Qualified since 12/17/24. If it does not apply and I would not be considered F2A anymore, does it mean they will change my category to F2B? and just need to wait for the priority date to become current? Thanks for any and all your help!
  2. It seems to me you request to have a copy of your I-130 form mailed or something like that. But it does not seem to me to be anything related to the HR. When I contacted USCIS to see if they got the letter I also had a hard time getting info as I was also not in the case. I was never able to get confirmation they got my HR letter. The only way I knew they did was when I got my reaffirmation letter.

  5. so where was your case when the petitioner passed? was it not with NVC?
  6. I did not use a lawyer (too expensive) and I guess I did not end up needing one. I did call USCIS and asked if they got my letter. They later emailed me with no helpful info "If a Humanitarian Reinstatement is being requested, the request must be made in writing by a surviving beneficiary. Once the request has been properly submitted and received, USCIS will communicate with the surviving beneficiarys designated substitute sponsor or authorized legal representative to indicate the documentation needed to pursue reinstatement of the visa petition."   7. I had not submitted anything to NVC. I would assume that once you log into the CEAC portal you can see whether you have to or not? I believe once I got reaffirmation I logged into the system within 2 weeks. I did not get any letter from either agency telling me that the case was up in the system, I just tried to log in and it worked.
  8. Sorry, I can't remember how long it took for them to mail me the notice. However, when I message NVC they were not very helpful, I would just use your previous NVC numbers to log into CEAC
  9. Hello, I did not get anything else from USCIS. I just used my previous information from NVC to log into the CEAC system.
  10. Hi there, I did not. I know some people have, so I was worried they did not get my letter, but they did. I sent my letter June 2022 and I got the reaffirmation letter (approval for humanitarian reinstatement) October 2023, so a little over a year.

  12. I want to add an update for those in the same boat. I added my documents under the principal sponsor/petitioner (the dead petitioner). NVC has now added me as a substitute sponsor and I have to resubmit my documents, they also N/A the requirement for the petitioner. Will update you once I get more info!
  13. I submitted my documentation under the petitioner/primary sponsor since the NVC did not answer my questions. I am waiting on them to tell me something. I will for sure let you know once I get that info!
