  1. Quick question.. would this be the case if he leaves the US at all? Like what if he left the country and then decided to come back with this green card? I'm asking because in NC there is an option for No Fault divorce where as long as we live separately for one year, we could divorce much more easily than getting attorneys involved. We don't own any property together and we have no children, so we don't really have much as far as splitting. He is not being aggressive or hostile towards me, but he's still living with me currently until he can figure out how to go about moving his stuff out and shipping it back over to the UK. I think he understands and agrees that this just didn't work out and he admitted he has a problem, thankfully things are going smoothly so far. Just need to physically create the separation. I'm just wondering if he could re-enter the country during that year-long period with the green card or if it would become void as soon as he exists the border (with the intent of divorce). I know that's a weird question but I hope it makes sense.
  2. Thank you all for your advice and instruction. I have never felt so defeated after all that hard work and really thinking I married someone who was going to be there for me. I am beyond devastated and don't know what to do with myself.
  3. Hello, I'm wondering if there are procedures anywhere for how to go about filing for a separation and divorce after one year? I live in North Carolina and even though my husband came over on the k1 visa and received his green card last year, I have discovered that he is abusing substances, I caught him lying to me and hiding things from me more times than I can count and overall he is not who he promised he would be and I'm done giving second chances and tolerating his behavior. He is fully capable of going back to his home country and as soon as he leaves the separation would begin, but I don't know how to make this official and notify USCIS of this, also within the state of North Carolina. If someone can give me any advice on this I would really appreciate it. Thank you in advance.
  4. We had our visa approved back in May, and my fiance just entered the US a few days ago to start the 90 day process. I have our wedding planned at a small venue at the end of September, so the 90th day would be the second week of October. However, when the Customs officer took my fiance's packet and asked what our wedding date is, he told my fiance that's cutting it too close because we have to file for AOS by the 90th day and they have to receive the paperwork. This has terrified me and now I don't know what to think. If we needed to have gotten married AND have confirmation that they received our AOS request by the 90th day, then why does it say we have 90 days to "get married"? Shouldn't they say "receive AOS application by 90 days"?? I don't know if that customs guy was just being a ####### or if he's correct, but now I'm really scared we won't have enough time to apply for the AOS and he could get deported. I tried to look for this question in the forums but I don't see that anyone else has asked it yet. Please help!!
