The beneficiary in actual fact had partner with 2 kids at the time of filing the petition.
The beneficiary misconstrued what it meant to be married for the purpose of immigration, the petitioner as well thought he was actually married. Hence, the petition was filed under married, F3. But there is no supporting document.
Now, the beneficiary get a better understanding of what constitutes legal marriage and found out he has not been married.
