    My husband is an active duty in the military. As some of you might know that we are getting a basic house allowance every month and those money are non-taxable. Can I include that to calculate his current annual income? I am freaking out because if we include that, he is making enough to support us above the poverty line. But if not, he doesnt make enough.

    On the W-2 for 2008, it is only including his base pay but not the housing money. So on the wages lines, it seems like he makes so little base of his regular pay. BUT we have a proof of his paystub AND the employment letter from the military that he is getting other support.

    Can anybody PLEASE help me out????

    The BAH definitely counts as income, and you have the proof, so don't worry. I think you already know that his income only needs to meet the 100% of poverty level rather than 125%.

    Just be as accurate and honest as you can. It's probably better to err on the side of underestimating. One thing they are looking for is honesty.

    What is so confusing is that...on his W-2 for 2008 on box 1 and 12 where it indicates his wages, and non-taxable incomes, I only added up to about $20,000 BUT when I added all his pay stubs and the proof from his employer, he makes over $40,000.

    I am just not sure what to use. :(

  3. The instructions for the I-864 indicates:

    If your claimed income includes alimony, child support, dividend or interest income,or income from any other source, you may also include evidence of that income.

    Thanks for the reply! DOes that mean that we are ok?? His W-2 from 2008 doesnt show all the money that he makes and doesn't match to what I put for his current annual income BUT I include his paystub and a letter.

    I CANNOT find any places where I can buy a money order for $1010. The maximum amount they sell is $1000. I know that we have to pay $930 for the I-485 application fees and $80 biometric fees. Is it ok if I buy one for $930 and one for $80??? Would that matter?

    OR can I get a casheir check instead? It doesnt say in the instruction that I can use a casheir check so I am not sure.

    P.S. Writing a check is not our option.

    Have you tried the Post Office? Otherwise, a cashier's check made out correctly will do the trick.

    Yes, I did. They dont sell more than $1000. Do you think I can use a cashier's check instead?? Or just buy two money orders for $930 and $80???

    I am getting ready to send I-130 and AOS and AGAIN, I am stucked!!! I don't know what address I should send my packet too.

    Hope somebody can help me out.

    On I-130 form instruction, it is said

    "NOTE: If the Form I-130 petition is being filed concurrently with Form I-485, Application to Register Permanent Residence or Adjust Status, submit both forms concurrently to:

    U.S. Citizenship and Immigration Services P.O. Box 805887 Chicago, IL 60680-4107"

    BUT

    On the I-485 form instruction,

    It said that " If you are applying for adjustment of status under one of the eligibility categories listed below, file your Form I-485, Application to Register Permanent Residence or Adjust Status, with the USCIS Lockbox Facility.

    1. Spouse, parent, unmarried son/daughter under age 21 of a U.S. citizen with an approved or concurrently filed Form I-130 ......"

    I am getting ready to send in my AOS in Jan 2009. Regarding I-864EZ form, when they ask for "the current annual income," Can I use use income from year 2008 and not 2009?? FYI, we use year 2007, 2006, and 2005 for the most recent tax years.

    Even though, we will have my sponsor' W-2 for year 2008, we won't be file year 2008 taxes by the time I send in my documents, Can I include W-2 from 2008 with the document to prove his income for that year??

    I have another question for you, lol.

    It is related to the military. So we just got married in March and he received BAH starting this year which in I-864EZ for where they ask for his currently annual income..do you think I need to write the explanation why he makes significantly higher this year than other years??
