  1. We filed for adjustment of status for my mother. She entered the country on a tourist visa. And no, we didn't have any intentions to apply for a green card before she came to the U.S. We had her tickets booked round trip before she came and changed her flight back a couple months later until we decided to apply for AOS.  

     

    I recently had a baby and my mom was going to come to visit for a month to visit with her grandchild. However, with my new job training, we had a problem with original plan of who would be watching the baby.  

     

    She came last June and we filed for AOS in October. 

     

    I am asking for advice of how we can prove our intention to immigration officer. Would our records showing her flights multiple times be sufficient to prove to immigration officer our intention? Any helpful comments are welcomed.

    10/26/2016 Biometric appointment

    11/09/2016 RFE for I-485

    11/25/2016 USCIS received RFE

    1/18/2017  Advance Parole received 

     

    It has been more than 90 days since they received RFE. Should we contact the office? Any thoughts? Also when we check the status of I-130 on the website, it only said that they received the form. 

     

    P/S  We adjusted of status from a tourist visa.

  3. Hello,

     

    My mom entered the U.S. last June as a visitor. We applied to adjust her status (for a green card) in October due to an unexpected circumstance. We are still waiting to hear back about the interview. My question is if she makes a trip back to her home country for about two weeks, will there be a problem coming back to the U.S? She has her Advance Parole paperwork. She also doesn't speak any English so I am a little worried that there will be issues when she enters the U.S.

  4. We are applying for AOS for my mother. Got a RFE stating to provide evidence of relationship between the applicant and petitioner - "a copy of the petitioner's birth certificate showing applicant as a natural parent"

    On my birth certificate (translated version - this was done by a professional translator when I applied for AOS for myself years ago), my mother's name is spelled out very differently than the name on her current passport. I'm suspecting that the discrepancy could be the reason why we got RFE. If I translated my birth certificate again to match the spelling on her passport, would they accept it?

    Should I send an additional evidence to prove that she's my birth mom? (Even though I'm not sure what else I can use) I have my marriage certificate that have my mom's name on there however it spells out different too.

    My mother entered the U.S. on B-2 visa in June. I am a U.S citizen. I recently had a baby and my plan was to have her help out with the baby for a couple months. Now, we are thinking of having her stay here permanently to help with the baby. My question is - is it possible to adjust status when on B-2 visa to green card? If so, what are the requirement? Should I file I-130 first or file I-130 and I-485 concurrently?

  6. Hi all,

    The situation is I have a sister who entered the U.S. on J-1 visa. She is an au pair. She supposed to stay for one year with her current host family. Her I-94 doesn't expire until later this year. However, things don't work out with her host family and now she is in the process of "rematch" where she has to find another host family within 2 weeks. If she is unable to do so, her condition will be terminated and she will have to go back to her home country.

    She currently has a valid tourist visa and used that in the past to come visit me a couple years ago. Everything is jait so sudden and I would like her to at least come visit me before she has to fly all the way back home.

    My question, is there any ways she can change her status from J-1 to B-1 while in the U.S? If not, is there anything we can do so that she doesn't have to fly all the way back to her home country? Could she file form I-539? I don't think this will make a different but just in case, I'm a U.S citizen.

  7. Hello all,

    I am not sure if this is the right place to post my question but hopefully some of you can help me out. A little background: My sister is here in the U.S as an au pair. She is currently holding J-1 visa. After her J-1 is expired, she is planning to apply for F-1 visa to study in the U.S. I am a U.S citizen and planning to petition my sister so she can stay in the U.S. (I know it will take at least 10-12 years for the whole process).

    My questions are

    1) Should I wait until AFTER she gets F-1 visa before I start the paperwork to petition her? I want to start the process as soon as possible but I don't want to jeopardize her case when she is transferring her J-1 to F-1.

    2) Is she allowed to stay in the U.S after she completed her study in the U.S as F-1 visa?

  8. p/s - Do I answer yes or no to the question 10? --- "Is your spouse currently serving with or employed by the U.S. government and serving outside the United States?" He will be deployed on the ship but his duty station will remain in San Diego.

    Also, Should I have him sign the I-751 form before he leaves or should I sign the form and attach a power of attorney?

    And I just check with the Costa Rica Embassy and this is what I found.

    New Visa Regulations

    Effective February 16, 2009, nationals of countries that require a consular visa to enter Costa Rica are no longer required to apply for the visa, if the visitors are holders of:

    * A valid tourist visa, crew member’s visa, or business visa to enter the U.S., Canada or the countries of the European Union. The tourist visa must be stamped in their passport and valid for at least 3 more months.

    OR

    * A permanent residence (green card), student visa (F1, J1), work visa (H1B, G4, etc.), or refugee status in the United States, and/or in any country member of the European Union or Canada, valid for a minimum of 6 months. Residency extensions stamped on passport are not accepted.

    The passport expiration date needs to be over 6 months from the day of arrival to the country

    Visitors are allowed to remain in the country for up to 30 days. All visa extensions should be requested at the Immigration Office in San José, Costa Rica

    I think I understand the context but I still would like a confirmation. I believe it applied to me that I do not need to apply for a visa, am I correct on this?

  10. Hello all,

    Back in May 2009, I received a two years green card in my married name. I applied for a new passport (thailand) since it was expiring but it came back in my maiden name. The Thai Embassy wouldn't let me change it to married name because I wasn't considered married in Thailand so there is really no way to change to married name on the passport without flying back to Thailand which I don't have a plan to. Anyway, so now my name on passport and green card doesn't match. Well, I need to travel to Costa Rica for 9 days with my school over the Spring Break. My question is will I face a difficulty returning back to the United States? Will a marriage certificate be an enough proof? What else should I bring with me to prove my situation?

  11. Hi guys,

    We already have an appointment for an interview on May 21st. My husband I are moving on May 1st. We are still going to be in the same apartment complex, just a different building number and apartment. (the road, city, and zip code will be the same). Anyway, I figure that since we already received all the necassary documents..I believe that the only thing that USCIS will send me is my final green card after an interview.

    Anyway, my question is...should I still fill a change of address form BEFORE an interview OR when I have an interview, I should tell the immigration officer there?

    Have anyone experience this?

    When I send in my AOS packet, I included the original I-693 with it. I only had one HPV back then. Now, I will have my interview in May. I was just wondering if we are REQUIRED to get ALL THREE HPV SHOTS??? I didn't follow up with my shot at all so I don't know if that will be a big problem.

  13. Hello all,

    If you are a green card holder, do you suppose to keep your foreign passport valid? I am just curious.

    My Thai passport is expired next year...if nothing goes wrong with AOS process, I believe that I MIGHT get the green card before my Thai passport is expired. I am just not sure if I want to renew it right now since I have to get a new one every five years. PLUS I dont have any plans to travel right now.
