    Received hard copy of I-129F & I-130 approval yesterday.

    I'm reading the I-130 approval letters and its states

    "The above petition has been approved. The petition indicates that the peson for whom you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the local USCIS office to obtain Form I-485, Application for Permanet Residence. A copy of this notice should be submitted with the appliation."

    "If the person for whom you are petitioning decides to apply for a visa outside the United States based on this petition, the petitioner should file Form I-824, Application fo Action on an Approved Application or Petition, whith this office to request that we send the petition to the Department of State National Visa Center (NVC)."

    "The NVC processes all approved immigrant visa petitions that require consular action. The NVC also determines which consular post is the appropriate consulate to complete visa processing. It will then forward the approved petition tot that consulate."

    Did you get letter similar to this, correct?

    #1) In which case it is saying my wife is in the United States or I need to apply I-485 after she gets in the United States.

    #2) It it also saying if I want to apply for I-130 at this time, I should contact NVC and let them know and I should file I-824 to forward the file to embassy in foreign country.

    Is this what you understand to be?

    Yeah, I got the same thing! Looks like it is indeed a standard formula they are using...

    for your first question ( which put my lawyer in difficulty I don't know why :wacko: ) because most of K3 filers go through adjustment of status after the arrive to the US, I 130 will be used for that purpose. After your spouse comes to US you can start AOS and yes I think by Form I-485.

    If however at this point you choose to change to IR1/CR1 you can request USCIS (where you've been processed) to send I-130 to NVC by filing Form I-824.

    My husband just sent me the NVC letter scan. Apparently I will be receiving Packet 3 soon. On Monday I'm gonna try and call the embassy and find out more.

  2. Vernon, on VJ the aproximate time from embassy receiving papers to interview is 15 days in Bucharest, Romania, but I'd say closer to 1 month. I'm calling on Monday to try and get some info about it. Anyway I'm trying to think what's next. I guess I just have to wait for the wonderful envelope.

    How are mother and soon-to-be-born baby feeling?

    My I-129F & I-130 were approved and sent on May 9, 2008 but, still haven't received the NOA 2 hard copy as of today.

    My questions was how did you find out that your file was received by the NVC and it had left the embassy. And how did you get the case# from NVC.

    Did you get an e-mail or did you call the NVC?

    Regarding the going K3 or CR-1.

    Don't you have to go the K3 route? I thought the CR-1 file just sits at NVC until you file for the adjustment of status after your spouse gets in the U.S.

    At least thats what I thought.

    Hey Jigs! For NVC info I called (my husband actually) and they gave us case# and they also said our petition was sent to the embassy yesterday. So now it's just a matter of waiting for the embassy envelope that I (the beneficiary) will receive.

    About K3/CR1 there have been cases in which I130 was sent forward, but only exceptions. K3 ususally goes to the embassy.

    So keep me posted about that NOA2 of yours!

  4. Apparently I made a mistake.. I didn't paste the entire paragraph. here's what it says:

    I was more worried about the "person for whom you are petitioning is in the United States" part... but from what i understood it's a standard sentence.

    What do you think?

  5. I see that you guys have been approved on both petitions. What are you going to do? Which way are you going? K3 or CR1? I was approved on May 6 and I am really confused right now and don't know what to do next. Do I get to Choose or does NVC choose for me?

    And something else.. What's written on your I-130 NOA2 first paragraphs? Mine says "and will apply for adjustment of status. He or she should contact the local USCIS office..." bla bla bla. Did everyone get this? I am the beneficiary.. but I'm NOT in the US!!!!! What is this?

    Yes, I got the message too.

    I am going to proceed with both CR1 + K3, but we will hold on to CR1 and not send back any documents until few months later when the K3 physical file arrives in China. This is so that if my husband fails K3 interview, we know he still have another chance for CR1. I know this means we will be spending more $$, but getting the visa for him is more important. How about you?

    So the same text is on your I130 NOA2? Can you please double chech for me? I would be forever grateful, because my husband got scared of the part "The petition indicates that the person for whom you are petitioning is in the United States " and I'm actually still in Romania :(( I am really scared something's wrong.... please help me

    Uscis is saying that since both are approved I-129F is cancelled and I-130 is oly valid.... NVC says that it's the I-129F being sent to the embassy and I-130 is being held for future adjustment of status.... The embassy is saying we can choose which to pursue and I don't understand anything anymore :(

    So please for my sanity... look and write here what's written on your I-130 NOA2... please

    I would call and verify that with USCIS so that they will send it to NVC instead of you local office. It sounds like a box was checked wrong. That will be a big issue if it is not corrected

    I'm going K3 so I don't want I130 at NVC. I just want I129F at NVC and then to the embassy. I was just worried about that paragraph but from what I've been reading and talking to VJers it's a standard formula for NOA2 of I130. I'm just keeping fingers crossed my approved I129F reaches the embassy soon, so this way I know for sure I'm still on the K3 route. My lawyer was trying to persuade my husband that if both petitions are approved at the same time the I130 gets priority and I129F gets cancelled. I refuse to believe that...

  8. I am soooo really confused right now with both these petitions approved...

    What the hell does this mean?!

    My lawyer understood (misunderstood I think) that something's wrong because of this sentence the petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of status

    I am so scared that she should know this better than us...... and clearly she's misunderstanding.

    From what I know this I-130 remains at USCIS for further Adjustment of Status, while I-129F goes to NVC and then to the embassy.... We are both so panicked right now.... Don't know what to do next!!! The lawyer yesterday started giving my husband instructions as if we were pursuing CR1. She says that if I-130 was approved it should go first!

    The embassy on the other hand says it's up to us whether to choose K3 or IR1/CR1 up to our needs because Ir1/Cr1 is longer.

    What on earth am I supposed to do????

  9. Although on USCIS site my I-130 appears as pending, my huband received today NOA's for both of them : )) I don't understand anything... does this mean anything or are we still going the K3 route ?! :help:

    Now we are waiting for the letter from NVC but I think on Monday next week my husband will call NVC to see if they have our case and when they'll send it to the embassy.

  10. From what I know NVC is only a transit location for us with K-3 before our papers reach the embassy and only for IR1/CR1 you have to pay processing fees to NVC.

    I'm still waiting for the hardcopy of NOA2 and then my husband and the lawyer can send me the Affidavit of Support. Meanwhile I'm getting papers together: e-mails, cards, phone bills, photos and sorting through my 1,500 pages :wacko: of messenger conversations to see what I'm taking as proof. Since we are both Romanians (my husband became US citizen 3 years ago) all our papers are in Romanian and I'm wondering in what language do they need them at the embassy. Translating all of my docs into English will take longer than USCIS.... :huh:

    Also, lately we've been talking mostly through Y messenger calls and I don't know how to take that as proof.... :oops: Anyone knows?

    i thought you just waited to be contacted by the embassy.

    After USCIS the papers go to NVC and after that NVC sends them to the embassy. Then the embassy requires some additional forms (for the visa itself+Affidavt of Support+medical) and only then you can get the interview. At least that's what I understood from all the reading on the forum and guides :reading: . I'm estimating 1.5 to 2 months till this is all ready :clock: . My birthday is June 26 and I hope from the bottom of my heart I'll be blowing my candles in Cleveland!!! God help! :innocent:

  16. During my daily routine, I came across this: my timeline changed dramatically

    Based on timeline data, your I129f may be adjudicated as early as July 26, 2008*.

    I got no more touches since March 14, when the petitions were paired I think.

    I'm not getting my hopes up, but has it happened to someone else recently? Actually I am a bit worried.. someone in the same situation as mine, also going with a lawyer got an RFE.. God help we won't get one, although we didn't put any pictures in the file. USCIS officer told us I would only have to take pictures and other proof at the interview in Bucharest, so we only attached Affidavits of a very close friend and of our godparents :wacko: ... What do you guys think? The last thing I want is an RFE delaying the process.. It's slow enough! :unsure:

  17. Here's what our timeline say: "Based on timeline data, your I129f may be adjudicated as early as August 27, 2008."

    I'm trying not to believe that. I hope my birthday present on June 26 will be an NOA2... I really wish for nothing else.

    Regarding how often I get to see my husband, i've seen him in October and then in January, but it's never something planned and scheduled because of his job. Something always comes up so when he has a calmer period he just comes along to Romania. As most of you know, money is also an issue... with a plane ticket of over $ 1000. So most probably I'll see him next after my POE on some airport near Cleveland. :huh:

  18. Ralu&Doru - I totally understand how you feel! This endless waiting is hard enough, when you see some cases taking 50 days and others taking 350 days it doesn't leave much room for hope. It's too bad they couldn't just put all these people to work doing name checks and just let us in. It's not like we're trying to get in so that we can work illegally or something. We just want to go in to be with our spouses and those we love. I could honestly wait a year while they process my application to work or whatever but I would rather be there with my husband. The thought that he's going to miss out on who knows how long of our daughters first year of life breaks my heart.

    Danyel - What exactly is the RFE trick? And wouldn't a fake touch cause it to take longer?

    Vernon, it's cases like yours that break my heart knowing that so many people are suffering being away from each other especially when a baby is involved. The strangest part is that despite their requests of proof in order to make sure of "the bona fides of the marital relationship" and the very complex way in which they process the cases, ironically those "not so just" applicants who are doing this just to get to the US will get approved sooner. And I bet no one can say for sure if a case is for real or not.. If one wants to fool them about a relationship they will fool them! There are ways... And those of us doing this just out of love are left behind. I'm so tired of this illogical way of approving cases... it obeys absolutely no rule!

    I'm sorry that I'm so upset today. I miss my husband and who knows when I'll see him... Easter is coming soon here in Romania and he won't be able to come and neither can I go to Cleveland...

    Danyel, I was going to ask about that "trick". What is that exactly?

  19. Up untill recently I would count patience as one of my qualities... but this whole thing is testing me down to the last cell in my body and patience is begining to fade away. Especially since nothing is changing. Recently I've seen some people get CR1/IR1 approved in less then 50 days and with no particular reason or emergency involved. I want a strike of luck just like that... because I'm beginning to think is all up to luck :unsure:

    Untill then I'll do my best and wait and pray for a little more patience each day :innocent:
