  2. so just to keep everyone updated on my timeline:

    I went to the ASC today to get my 2nd (SECOND) Biometrics interview...I had the chance to speak to an immigration officer, when he compared my PREVIOUS Biometrics Appt notice, he pointed out that it said a 'Code 3' in the upper right corner...the one I had today said 'Code 1'. He explained that a Code 3 they just take a picture and a Code 1 is the actual Fingerprint process...I really don't remember exactly but I think they took my fingerprints back in Feb with the Code 3...

    anywhoo..so NOW at least I know they have my fingerprints complete (7/28), hopefully I will get a case notice in the next few weeks...

TBoneTX: I really would not see how would they get any nastier since all they do is run the GC through their scanner...I had the letter holding in my hand and they just glanced at it...one lady from USCIS the first asked 'u have not got your GC yet?' and I said 'no, I applied for it in January (pointing at my letter)' she just said, 'OK GO AHEAD'...both times it's been really straightforward. To be honest to whoever wants to travel via land these entrance points I would not see an issue doing it with your letter like I did!

  4. just wanted to update my status:

    yesterday I received an envelope from USCIS (holding breath....) and to my surprise it was nor an RFE neither an interview appt, but ANOTHER BIOMETRIC appointment for July 28th! how could this be?? I already had my Biometrics on 2/17 (see my case timeline), and on this notice it says that 'your fingerprint card has expired'...it makes me think that USCIS maybe screwed up and didn't get my fingerprints in February...either way this is kinda disappointing!!

    anyone has ever heard of such a thing?

    anyway, my status guess should now read 7/28 for a BIOMETRICS again!

    USEFUL TIP: I have got out of the United States twice this year with an expired green card and my extension letter with no problems (both times via land through Laredo, TX). Just a heads up! I would not be scared to cross if u have your extension letter, they just let u go with no problem!

  6. I jus find the situattion a little odd. I don't understand how he could cross the border without getting his I-94 (the immigration officers always staple that to the passport). How come noone knew that he had no record of his entry here. When my parents come first thing I do is to check their passports and their I-94s right there and then. He was so unlucky about the whole thing & totally odd :unsure: I hope you have a good lawyer for him.

    it was really odd actually but he has NEVER crossed the border by land before, he said that there were only 4 people on the bus and when he got to the ICE checkpoint (25mi past the border), an ICE agent got inside the bus, checked the documents, he held his passport and looked at it, inside he has this tourist visa and just simply handed it back to him.

    so yeah, overall is a very weird situation, the reason why he ran into immigration was over a traffic violation, he had his passport and visa with him at all times, but he still had to spend about 10days in jail :(

  7. so this is a little odd what happened to my brother:

    He arrived through the land border in Laredo TX, he holds a VALID B1 Tourist Visa. This is his FIRST time crossing by land and he did not know how to get the I-94. When he got to San Antonio he said that he didn't get a permit (June 5th). so basically he entered the US WITHOUT INSPECTION even thou he has a valid visa!

    so he had the bad luck of running into immigration a month later (July 2nd) and he faced deportation, but we posted bail bond and is now facing immigration court. Most likely he will be granted Voluntary Departure on Dec 2th (our next court date) and he had to swear under oath that he entered the US on june 5th and that no officer stamped his passport.

    That means he will not have an overstay? since he entered on June 5th and voluntary departure will be granted on Dec 2nd?

    more important: once he leaves the US will he be eligible to re-enter? as far as I know a voluntary departure with NO overstay would not make him inelegible since he has a valid tourist visa.

So I was in Las Vegas last june, had a blast with about 8 of my friends...I had to take a separate flight back home (San Antonio TX) and at the security checkpoint, you know, where u have to take your shoes off, wallet, belt, phone....the person in front of me totally forgot a Blackberry phone. Me, in my hungover state (I admit it), I took my wallet, coins, belt and without thinking since I personally have an iPhone, I took the other phone.

    Well, the guy came back, they look at the footage and found me 5 min prior to my departure!!

    He pressed charges even though I look in my bag and handed back the phone! I am still facing FELONY CHARGES bc under Nevada law, if you take something worth over $250, is considered GRAND LARCENY.

    The DA is willing to lower the charge to PETTY LARCENY (misdemeanor) with absolutely NO probation.

    Does anyone know if that could represent a problem when filing the 751 Lifting of Conditions? I need to tell my lawyer if I'm going to accept the misdemeanor charge.

    oh and the cost for taking that Blackberry phone? $1,500 in lawyer fees. That must be the MOST expensive phone in the world now! :blink:

    Just wanted to share my case: Filed for AOS 08/12 and got a RFE 09/09, it took me a while to get all the documentation (my wife does not cover the support requirements and we had to find a co-sponsor) so I file the documentation 10/17 -more than a month later :blink: -

    My case has been "touched" on the CIS website saying that it has been transferred to the California Service Center (10/30) and it was recently touched yesterday! (11/06)

    Just a few questions:

    on the website I have status of all 3 petitions (AOS,AP,EAD) but so far only the AOS is the one showing any progress...is this normal??? AP & EAD haven't moved at all since 09/08...so would the CSC be in charge of approving all 3 petitions?

    Any info/comments/experience would be greatly appreciated.

    also, does the fact that it was transferred to the CSC means that we won't have an interview?

    I received my Biometrics Appt notice last week! is all set for SEPT. 10!! (Wednesday) at 10am.

    One question though, at which point do I get my travel document?? I mean the I-131 Advance Parole. Is because we'd like to make a trip in about 1month overseas!

  11. "How to add 2 months to the K-1 process" by Brian.

    As some of you know, my K-1 was approved on July 3rd. I received an email on July 22nd, that my case was under further review. Then on July 26th, I get a NOA saying the earlier approval was overturned, and an RFE. Apparently I did not answer the Sec. C military section completely. So, I answer question 2, and send it back. And the RFE, said a decision would be forthcoming by August 26th.

    I take responsiblity for the mistake. Though I still see why I made it. What makes me mad, is that if I had received the RFE on July 3rd instead of an approval, my file would be in Juarez by now. Instead, an extra two months has been tacked on.

    Just venting. I made the mistake, and I will live with the consequences.

    Brian, just to get the terminology right, your K1 hasn't been approved, but it will until you go to the consulate interview. Your approval was referred to the initial I-129F Petition for Alien Fiance.

    oh and this is me with my actual K1 Visa on June-05-08 about to cross the border to El Paso! think it would be nice to see MORE of this pics soon!!!!

    jmmr - No, you would need a certified copy of your certificate, not a notarized copy. Please refer back to that link for your state's vital records office, and it'll probably cost under $20. And the apartment sounds great!

    Marty - I'm only somewhat familiar with the waiver process, but I think you should start visiting immigrate2us.net regularly and post some questions there about your situation to see what they recommend. There is a member named Laura Fern (she's one of the moderators of the site and is going to start law school in the fall), and also an immigration lawyer named Laurel Scott. I answered one of your lasts posts about the weekly chat they have there.

    I only used a PLAIN PHOTOCOPY of my fiance US Birth Certificate and they gave me my K1 Visa the same day (June-05-08). For some reason I'll always remember that day!!!

    Don't sweat it! I went to CDJ back in June and the ONLY thing that delayed my K1 was my fiance US Birth Certificate but the LONG version...the IO said that it was because she was from a border town in Texas and there's a lot of fraud with birth certificates so just be prepared.

    by the way, I just presented a PHOTOCOPY of this birth certificate and my K1 Visa was approved the same day!

  14. Yeah, filing a request for a duplicate approval cost around $340dlls ouch!

    As to why we gave them the original...I sincerely don't know, i guess we were nervous about getting denied that we didn't think of it. Will the immigration officer at our INFOPASS be able to help us? Is just a copy that we need...

    Also, what's the Electronic Approval message mentioned above? is the email automated system from the USCIS website?

  15. SORRY i THINK I WAS CONFUSED REGARDING i 130 FEE I DONT EVEN HAVE TO USE THAT IN THE AOS PROCESS =)

    Correct, adjusting from K-1 does NOT require an I-130

    Thank God! Just one fee covers it all! :)

    Have one question: what happens if we don't have a copy of our 797 Petition Approval Notice? can I include a printed page from the uscis website that the notice was sent? it includes the receipt number

  16. OK, so at the embassy interview (Cd Juarez) we turned in most of our paperwork, including the original I-797 Approval Notice of our petition.

    Now we can't find a copy of that notice and it seems that it will be required to file the I485 (it says to attach a copy of the Fiance Petition Approval Notice along with the marriage certificate).

    So how do we get a copy? has anyone been in a similar situation?

    We already processed a INFOPASS Appointment so maybe speaking with a local immigration officer would help, since they're the ones handling our case they'll probably have the packet that I turned in at the POE (El Paso,TX).

    Any help/comment would be greatly appreciated!

    Best of luck to you!!! I hope that it's quick and painless tomorrow and they give you the visa!! I've heard that most people say it's not necessary to even bring the USC birth certificate with, since we already sent it in with the original petition, but whatever- things happen I suppose.     thank you so much!

    it's been a blessing to have my laptop and wireless internet and stay connected with the VJers right here in our hotel room. We haven't left the hotel because we don't know our way around and basically everything here in Cd Juarez looks...well dirty and not really safe :(

    As before, I'D DEFINITELY recommend this hotel Los Cedros, it seems like one of the most secure we've seen so far...I've taken pictures and I'll post those later!
