  1. You have send it to NVC Or embassy. Depends on where your case is. you don’t need to upload to CEAC
  2. When you arrive at the embassy for your interview and they find out that the petitioner has passed they will refuse your visa and send your case back to USCIS (if you hide the passing it is fraud, resulting in ban). at this point you should already send them the petitioners death certificate and launch your Humanitarian Reinstatement request, as it takes upto 2 years to get approval.
  3. Thanks for your response. we have a humanitarian reinstatement request too approaching the year mark. I would suggest if you are able to, get a lawyer to help you prepare the submission. As you only get one shot. Good Luck and hope you get it.
  4. Yes indeed the request has to be made On behalf of your brother. Using a lawyer is always advised for such cases as you get only one shot at it. we have a similar case and used a lawyer to submit our request back in Aug2022. now just waiting. P.S. Most of the cases people use lawyers in the USA as they would be more knowledgeable and upto date with any policies and developments.
  5. When did you submit your first letter? just want to understand the timeline.
  6. That is fantastic! I just had a couple questions if you don’t mind shedding some light: 1) When you sent your request, did you get any notification that your documents have been received or not? If yes, how long after submission did you get the notification? 2) Which center was your petition in? EAC, WAC, NAC?
  7. Hi all, we had a F3 petition that came current in Jan 2020, by March 2020 all embassies and everything shut down. March 2021 the petitioner passed away while our case was still at the NVC. When we informed them of passing they sent the case back to USCIS and told us it is revoked. then last year we heard about humanitarian reinstatement and applied for that using a lawyer. sent the request August 2022. can others who have recently gone through this process or going through it please shed light on the wait time and other details. Thanks
