  1. hi!.you still have roughly two weeks to soften your sister's heart and remind her that it's your sister's future in her hands, -and not your dad's.

    in the meantime, as long as you have your sister's income tax information from 2012, you can ask the IRS for a copy of her 2013 ITR. Go to the IRS website and check the information. I did this for my husband, because he was so busy with work.

    and as a back-up, yes fill out an additional affidavit of support showing your 2013 incomes with your husband.

  2. if i remember right, the question is all previous (Old) addresses since you were 16 years old> so if you lived at only one address since you were born, then you write only that address. if you moved several times, you write down all the addresses since you were 16yrs old. if you moved also when you were 15 yrs old, you don't include that. only addresses where you moved when you were 16 and older.

  3. I am currently putting my package together and have read so many conflicting views on what should be sent for evidence of the relationship. Anyone who has been approved please help me out and share what you included?

    I really want to avoid getting an RFE so any help would be much appreciated.

    anything and everything that shows that since you met, you have been communicating...communicating about what? travel, meeting up, dating and that the communication has been steady and consistent and means that the relationship is serious. so for pics, around 6 showing you/both of you with each other's friends, family, at each other's countries, phone bills showing have long you talk, how many times a day/week/month. the more, the better.

  4. Hi everyone. I have a question. I had my interview a week ago and the office said everything looks good and was going to approve it this week.but still not yet.he took my I 94, didn't stamp my passport. Was wondering if I could travel to Africa with my EAD/AP. What are my chances of coming back into the country without any problems. My visit is not an emergency, it's just causal visit. Thanks for your help.

    your AP is what you need to travel outside of the US and come back legally. the i-94 is what you get when you come to the US as a temporary immigrant and the i-94 is what is taken when you leave the US. you won;t have problems leaving. but when you come back make sure you show your AP, it's good for 1 year.

  5. His interview was 1/28/14 he got the first RFE. Then 2/28 they call and asked for another RFE...

    then he was called on last Friday to come for final results. He went today and was denied

    We been dating since june 30 2012

    RFEs are issued when your evidence seems incomplete or not convincing enough. it is a chance for you to submit more/stronger evidence of your relationship. what were you asked to submit the first RFE? what about the second RFE? if he got denied, it could have been because what you submitted was not sufficient or not accurate. when you respond to an RFE it is to close the doubt of uscis and to give them no more reason to ask for more. think about it.

    Yes it is stated on there. We simply overlooked it and thought the affidavit of birth would be sufficient.

    uscis does not give exact timelimes for RFEs. but from secondary experience, the sooner you reply, the sooner the result. good luck!

  7. Hi, I'm getting ready to file my application and I have two questions about the form:

    1. Information about Marital History:

    On my husband's prior spouse "Family Name" does this mean her maiden name used before they got married or do they need the present legal name which her husband's last name?

    2 .I already asked this to one of the members but I wanted to have another opinion from other members. I have been 5 years permanent resident but does it matter if I chose to file for the 3 years permanent resident? I know 5 years is easier but I had collected all the requirements for the 3 years application and almost ready to go.

    1. the last name the ex-spouse carried (pretend/what if you didn't know she remarried)

    2. since you are now eligible to file for either category, filing for the 3-yr is ok, if that's what you want. make sure you got all your reqs complete and accurate

  8. Hello all! We just had an interview at the Montreal Consulate. The officer requested an English translation of the birth certificate. My question is does anyone have any experience or been through something like this, how long does review and approval take? We were not given great instructions from the officer so we had to search around the web to find what to do next. We sent the documents through the chosen Loomis Branch. Did we complete this correctly?

    Any feedback would be greatly appreciated. Thank you.

    you have an easy problem to solve: find a legitimate business that translates legal documents such as your BC (because not everybody understands written technical french). follow other instructions such as format and other docs to be insreted) send it right away to the address you were given and you'll get approved =)

  9. Greeting from HCM city to all. I have decided to share what has just been an amazing two days for both of us here in Vietnam. I have, 6 months ago, posted a "plead for help" here on this forum due to a mistake I created ( labeling wedding pictures and mentioning our weddng ceremony in our timeline.) Well, several members came to comfort me and yet there were those that painted a very "dark and grim" picture for me. All We did was reminding each other just to tell the consular officer the truth about what happened. Her interview date was set 6 months afte I sent in the I-129f. We arrived at the Consulate at 7:45 for our 8am appointment. I noticed the Vietnamese nationals that worked at the Consulate are, for the most part, rude and extremely impolite toward alll people that came for their interviews. Wait almost 4 hours and finally Oanh was called to a window. The interview officer is a young white make who always has a smile on his face and speak perfect Vietnam. He did not have a translator with him. I was next to Oanh at the window and he swore we in. The first question he had for her was how we met, what I do for a living in the US, and what she wanted to do when she come to California. I was so nervous the whole time waiting for him to ask about the word wedding in the timeline. Please keep in mind I filed a K1 for Oanh. He took quick scan of the pictures and looked at us and told us when we plan to back to the US together. After 4 hour waiting and he asked her three questions totalling not even 2 minutes and told us to wait for the Visa. I would like to advice others just to come to the interview felling confident and prepare to tell the truth. I know I have made a mistake in this case, but I also refused to believe that the mistake warrants a denial. Prepare the evidence to prove your relationship and just let the consulate officers do their jobs. They are very fair and helpful. Best

    congratulations! and i apologize because unfortunately many members here on VJ like to play consul that they give not advice but judgments about you as if they know you well. good thing you trusted your gut and stayed honest about your mistake. consul officers are there because they are trained to investigate the truth. some vj members just want to mess up with your head.

    Whilst I know that technically they should not be able to do this they have and they are not budging.

    I applied at the local ssa office just under a month after getting here. Without asking they said they were putting in a manual application with no option not to. Called the main toll free number for an update last week and they were less than useful, rude and stating they could not give an update on the application as they were not allowed to ask security questions over the phone. I called the local office and they could confirm that the application was still pending and that if I left a message then they would call me back. A week later they haven't called me back.

    Then I find out that the state employer of my fiance, now husband, will only add me to the health insurance with an ssn. Despite me asking for it to be under another number they have refused and obviously not going to listen to me demanding that they do something they don't normally do.

    I have emailed SAVE.Help@uscis.dhs.gov asking if it has been updated so I can go back to the ssa office and see if I can get a new application in but I only have a set amount of time to apply for the insurance after my qualifying event.

    I officially hate paperwork, ok rant over. I realize that this is just a moaning post and not much can be done other than us going to see them on Friday and asking to apply again.

    good self-answers! you can't apply a second time; you can't really do much about it but wait...and pray that you get it already. insurance companies have the right to ask for info and your husband's just happens to be one of those who do. don't stress out too much.

    My boyfriend and I are planning on getting married. We met in college and both just graduated this past December. I am still on F-1 visa, currently on OPT expiring Feb 2015, he is a US citizen. We have both found employment, my employer is willing to sponsor my H1-B but due to the lottery system, we want to get married regardless so I don't have to leave the US if my H1-B application did not get chosen.

    Main question: Our combined income will be ~100K, 50K annual each but our employment does not start until August this year. We have our offer letters from our companies but no income yet. In such a situation, will we still need a co-sponsor? His family is not very well-off so I'm not even sure if his parents can act as co-sponsor in the first place.

    Also as an aside...suppose my H1-B visa falls through, will the fact that I have applied for it affect the approval of the AoS in anyway? I guess I'm just worried that the officer/USCIS will think that I am filing for a green card through marriage as a 'last resort' because of my H1-B falling through, although we do have a bona fide relationship. Thanks!

    before your main question/s can be answered, when do you plan on getting married? if say this month (soonest) and he submits his application for your petition, your incomes won't count. if you get married in august then you can show pay stubs to show (by the time he submits the petition )that your husband is financially capable of supporting you and you won't even need his parents' support .

    when is your prospective employer going to apply for your H1B visa? if now then you have enough time to get married and find out if you will get the h1b or not before your F1 expires.

    even if you don't get it or the result gets delayed, you still have a valid status to stay and at the same time, time to get married before the f1 expires.

    if it falls through it won't affecct your AOS as long as, as you say, you have plenty of proof of your bonafide relationship.

    now if you wait til the last minute (close to f1 expiration) to get married then they will definitely say you just wanted to skip the longer route.

    think about what you really want to do. h1b or not, you will get married right?

    I have a silly question about the DS-260...

    It asks, "Is your spouse immigrating to the U.S. with you?"

    I assume it's talking about me, the petitioner right?

    I'm a citizen, but I live in Japan and have for 12 years.

    I'm moving back to America when my wife goes.

    Does that mean that I answer no? When it asks me again do I answer no again?

    no such thing as a silly question. better sure than sorry, right? anyway, yes, it's asking you the petitioner. and your answer is no because you are already a citizen and not applying to immigrate as well.

  13. my wife needs to go back to her country in a few months to finish K2 visa process for her daughter, and we didn't really expect that green card process will take longer then four months so we didn't apply for AP right away but now is the time :) so have a quick question, in the application they ask for specific dates and duration, we just have approximate date is that ok? and don't really know about duration since it might take up to a month for here to finish everything up there, should I put 30 days, do they care about duration that much? they also ask for country and reason to visit, so what should I write: travel or K2 visa application, do we need to go into details about that? there is also something about writing on a separate sheet about why do you need advanced parole, I kinda didn't get that part, what do they want there?

    it's better to put approximate but real dates. for instance if she plans on flying there a month from now, put that date there and indicate one month/30 days. the reason for this is they want to get an approximate date, so that if you put one year, they will know to advice you, for instance, that you have only year to use your AP. they will know too to process it sooner if your application is for an emergency. in any case, your AP will be good for a year so you don't have to worry if you actually leave little later than the date you put on the application. don't write the whole story for the application, just enough info to answer "why" you're applying.

  14. Guys, need some help here.

    My husband is moving to an apartment size for two, just he and I, when I come to the USA. Actually he is already moving out this week.

    The house he lived in, he used to live with his late wife, she died and left a son living in the house, but the son is not his, he is 21 years and he decided to move out to start his new life with me his new wife.

    so we are filling out the affidavit of support while we wait on NVC...to be ready when the letter comes.

    My husband wants us to put the same address, because he said we already have that address in the form I-130. So not to confuse he said we should put the same address. Because he still will come around there to receive his mails and see how things are going with his step-son.

    My question is: when submitting these files. Aren´t the immigration officers will make there investigations? and if they find out he is not living there anymore, can that affect us in some way or the other?

    But my husband is stubborn he insists to put the same address and size of house.

    your address is mainly for receiving documents so it's really for your own good when you indicate only one address throughout the process. make sure though that you receive your docs in a timely manner.

    i'm just curious though about him moving out of his own house instead of the step-son who is 21yrs old anyway. does it mean your husband is letting his step-son (adopted his last name or not?) live there for free or with rent? the reason i asked is ownership (or non-ownership) of that house could affect his affidavit of support (owning a house generally makes him more financially capable than renting one), and he has to declare it as is.

  15. I have applied for my wife for CR1 category. When I applied I used her father's name since she had the old passport. Now being that said, she obtained a new passport under my middle name. I am worried that this may cause a problem when she go for interview. As of right now, we are at DS-260 stage, can anyone please advise what to do with this situation. She currently has two passport. one is canceled and one is current. The current one has my name and the canceled one has her father's name. Please advise.

    the cancelled one passport has no bearing anymore on her application (she does not need to show it unless it is asked for for verification). it's the current passport that she will submit for her visa stamping. so she should be ok. although your description is a little confusing when you said that her new passport has your middle name? you meant your last name, right? if it's your last name then you did the right thing.

  16. that is a lot of money for consultation and for vietnam. tell our fiance that all she needs to be is honest during the interview. she will not be asked how good her education is or if how much money she has. she will be asked simple questions about our relationship and her intentions. she is not alone, there are hundreds who are feeling the same way she is simply because they don't know what to expect. what she should be nervous about is if she has all her documents ready, payments ready, -all requirements for the interview. trust me, after the interview, she'll be okay.

    Hello again, I am almost finished preparing my K-1 visa forms and photos...

    The problem is, my fiancé in Vietnam is very nervous about this whole process. I have talked to her about this web site and the fact that we are fine preparing this ourselves and with the help of visajourney.

    She made an appointment with a lawyer and they filled her head full of doubt. They told her they would walk her through the whole process from start to visa approval for $2,000. I told her I am doing all the work, and a lawyer will basically proof read our packet and mail. At a cost of $2,000

    She is worried about her interview and believes she will say something wrong. I have told her it is all about the truth and us. That we will keep the whole process simple and honest. She is terrified that we will make a mistake and cost us another year or more apart. The lawyer has told her that she can help coach her for the interview. I am frustrated about this.

    I would much rather spend our money on another visit, and preparing for our lives together.

    Any words of encouragement for her? Any ideas how to comfort her on the interview process? Our case is simple and straight forward, nothing out of the ordinary. Just two people who fell in love 7,000 miles apart.

  17. We are in the process of filing out 1-134 and we had a couple questions.

    1) On question #10 when he puts my name and filing with i-129 on the date submitted, do we put the date we filed the i-129F or the date we fill out the form?

    2) I have read that if you meet the poverty line you do not need to fill out any more than the amount of income. Is this true? My fiance has many stocks and other investments and we want to make sure to include them if necessary.

    3)At the bottom of the form where you sign your name, there is a small blank line above your signature. Are you supposed to initial that line?

    1) it's the date you filed it (or date indicated in your notice of action )

    2) better to include all income to assure uscis that he's MORE THAN capable of supporting you

    3) not sure about that line, but if it says just signature, then that's all you need to put =)
