Hello everyone, sorry that i have not been on here in some time...

But it is that time again to deal with the INS...

File Feb 6 mailed my packet off, check cashed Feb 14th, recieved my letter today...

Case was transfered to California, which i find strange or is this a new thing that they are doing, i mailed everything to Nebraska??

Since i am out of the loop these days, is California still faster??

I like your spirit and admire your courage. And quite frankly, rather than wait hopelessly and endlessly, I think a lawsuit is definitely not out of order. All the service center arms of the USCIS (except of course, CSC) clearly do not realize that lives and futures are tied to their actions (or inactions).

Unfortunately, many agencies of government (USCIS and FEMA being prime examples) are buried neck-deep in so much paperwork, bureaucracy and inefficiency. I'm convinced that agencies such as these are damaged beyond repair and it'll take drastic actions like punishing politicians at the polls or court actions to bring about the changes necessary to turn things around.

Don't let anyone intimidate you or discourage you if you feel aggrieved enough to sue. Many individuals and groups have sued this agency successfully. In fact, they will be settling yet another lawsuit later this month (check it out on their homepage). And if the USCIS gets slapped with a class-action, guess who's going be the first to jump in and sign on?

I have travelled using my GC extension letter and didn't have a lick of trouble. In fact, the officer was visibly pleased that I was organized, familiar with the process and had all my paperwork in order. Guess I was lucky that day or something.

Being Canadian does not exempt us from scrutiny, nor does it mean that we get treated better or differently, even though we have a long history of good relations with the US. So I expect to get questioning when I go through the POE, and am pleasantly surprised when I don't.

My job in all this mess is to make sure I am educated about this process, and to take action when it is needed and warranted. I personally don't think a lawsuit will get the results I am looking for. I am looking into lobby groups dedicated to make change in this crazy process we are all in, because I think that is where my energy should be spent. Iansig, you feel that a lawsuit is in order, and that's up to you, it's your choice! Again, good luck and best wishes to you in that.

And was I cross and frustrated when I saw a group of us stuck at Texas while people transferred to California got their cards in quicktime? Heck yes I was. Am I frustrated on others' behalf (like our fellow VJe'rs in Nebraska) ?? Heck yes. But I'm not going to develop an ulcer over it! I refuse to let them have that kind of control over me!

However I feel that if nobody takes any action to correct the problem then...we 're set for a long ,long wait .At least we shall force them somehow to provide some sort of explanation for all this delay and why some are processed so fast while other are just left to despair and wonder what's happening .

Yes ,being Canadian doesn't give you the right to be approved right away but still....how much threat we bring to this country versus people from Middle East ? Only a lawsuit will get them back to reality and I will see what my lawyer has to say tomorrow and the answear I will get from my Congressman also .I will keep everyone informed here on VJ

When my husband was going through the initial AOS process we watched COUNTLESS people get approved in weeks, one couple in a matter of 31 days, while we waited 10 months. There is no way to figure out how the system works and you will make yourself crazy trying to do so. Just do what you know you need to do to stay current. That's all you can do.

I'm contemplating more and more about starting a laws suit against them .I have contacted a lawyer already but I will need a few more people that I can add their names so we can prove we have a good case here and make them pay for this lousy job they do getting paid top $$$$$

Under no circumstances I'm willing to pay them even more submitting another application (N-400) dreaming that my case will be processed faster .That seems to be a pattern for a lot of people here on VJ unfortunately .Doing so will generate even more $$$ for them while the resolution of our cases will stay the same or get even worst .Something must be done

Yes of course I have a hard time with this BS. I waited long enough and I just want to get over with it once and for all. Everywhere you go with those extensions traveling outside US and coming back in you get harassed by the immigration asking tons of questions most of them not even knowing what an extension for I-751 is. All they know is ,do you have a GC or a US Passport ? And….I’m a Canadian not a citizen from one of the country listed as countries supporting terrorism

In my believe I feel that as long nobody does anything to change the situation ,things will continue just the way it is right now or most likely even worst .

man it;s been a long journey for me i applied my i-751 in april 2006 got intervied in feb 2007 got an RFE in aug 2007 just find out that i got approved by calling Uscis in december 2007 finally but it has been 3 months no approval notice or green card recived why all this waiting with me did any one got approved and did'nt get there notice or a greencard i just went to immigration office they told they will send me a e-mail on the 20th of feb will let you' know what happend thanks guys good luck on there cases got bess youll

Have either of you made an infopass appointment to discuss this issue? Since one of you intends to travel, making an infopass appt would be a good idea to see if you can get another one year extension to your current green card. You two are not the only ones who are waiting, although I can only imagine it's frustrating to be waiting more than a year. But getting an extension to your card that would allow you to travel and work until your I-751 is approved. Just my humble opinion of course.

The problem is that I don't want to have this agony extended for one more year .I just want to get the GC and finish with them for 10 years ...that's all I want .After waiting for more then one year now ,another extension will not give me any satisfaction at all .Again how was it possible that people who applied after us(June, July 2007) they were transferred and now they are done ? That's something that I want to know

Just wondering how many others are in the same boat as me. I have now been waiting since January 2007 for my 10 yr green card from NSC. I called to inquire on the status of my case about 5 weeks ago, and yesterday I received a letter telling me that my case is "currently awaiting adjudication by an immigration officer" DUHHHHHH fat lot of good that did.

Hoping to travel to Australia in May so I just want my damn greencard.

I called them numerous time also but like I said in a different topic you can't find any informations on their website .Waisting of time !

My Congressman contacted them and the solution was to go and get another stamp on my passport so I can travell,work...etc.

Well....I don't want another FU...ING stamp ,I want that stupid GC for wich I paid .

I called last week too, and was given the processing date that is posted on the web. On top of all, the woman had the nerve to tell me that USCIS posts processing dates biweekly. I basically lost it, asked her if she lives in a different universe, and accused her of lying to cusomers. That day, I was most likely being the "customer from hell"!!! I am not proud of it, but I've had it up here with USCIS. They should get rid of the customer service agents who serve no productive role, and use that money to hire some folks to adjudicate the papers.

The appointment system for Infopass says if you are following up on a pending application, you should have a service request confirmation if coming for an interview. It does not make sense for those of us stuck at NSC.

I have an opportunity to do some freelance work, and cannot follow up because right now, I have less than a month of valid time on my extension. I wonder if USCIS can provide restitution for opportunities foregone because of their incompetence. I also need to travel in the next few months. Oh! But wait! We should get used to it, according to some VJ folks

Yes ,for sure they should get rid of of the customer service agents ,no help or any new information's will come from them just an extra waist of money ,your money ,my money....our money ! Like you I'm also sick and tired of hearing more and more that "we are not a priority " and other type of applications should be processed first .That's BS!

Since I didn't any reply to my previous post, I went ahead and called USCIS customer service. The lady was polite but didn't seem to have any further information than the website. She told me NOT to worry yet as my case is still within the "NORMAL" processing dates of NSC and I should wait till the posted processing date to be "2/25/08" to call. Then she thought that the cases 30 days ahead of the currently posted 2/10/07 date are being processed. Also she told me my I-130 is still marked pending in the system doesn't affect my other petions. I have no clue why though. This is confusing... But you know what, after dealing with NSC for the past 5 years, I resigned to my fate.

I'm frustrated at the USCIS because there seems to be no process in place as to how they go about approving applications, and if like some people state, the I751 isn't important to USCIS because we are in the States with our loved ones already... well, then they shouldn't have the process at all. We should just be able to apply for naturalization at 3 years, or renew our GC after 10 years, or 5 years.

Or why not give the option of removing conditions OR applying for naturalization at 3 years. One decision, one set of paperwork, one fee.... hmmm, right...it's not about offering a service, it's about getting as much money from us as possible.

I called them numerous time also but I wasn't able to find anything new and to make the matter even worst the person that I spoke to suggested that I should look on their website for the processing time .WHAT A JOKE !!!!

They must believe that we have no clue at all about what's going on with these processing time updates .

I don't want to sound sarcastic but you can find more informations browsing through the internet from X and Y then from their website and again ......WE PAID $$$$$ for their service

Once again I called USCIS today just to get the same answer "call in 30 days " I totally feel that after these 30 days I will get the same answer so what do you guys think..... Shall we start a law suit against them? Who wants to subscribe?

I am getting the same every time I call too. Last time I called I got through to an immigration officer and she said that I-751 processing at NSC now takes 1 year and 30 days. One person on the NSC-list, Bertrand, fits into that timeframe. But no one has been approved after that as far as I know.

Guess what …I called them today also and all I could get was "call back in 30 days" suggesting on the same time to keep checking on USCIS website like we don't know already how much ####### they post on their website . NOBODY KNOWS FOR SURE ..what's the processing time date for I-751 right now at least at Nebraska Service Center .

Let's admit this is another screw-up like we got accustomed to see coming from USCIS

I would say maybe 14 to 16 months before these ###***ES will do any applications reviews .What can we do about it ????

I just called the USCIS "mis-information"-line to inquire about my year-old I-751 application filed at the lovely NSC. After taking all my information the USCIS representative told me that my case was definitely out of the time range by as much as 180 days. I was dumbfounded of course and said the current priority date for NSC is Feb 10th 2007 so how can I be out by 180 days. He then said NSC is currently processing applications filed in Aug 2007 and that the 02/07 date just shows "when visas become available" or something of that sort. He put in a service request for my case and said an immigration officer should have it by 03/16. I was also advised to make an infopass appointment to get a stamp in my passport (extension expires 04/08).

What he said does not sound right to me. What do you guys think? I didn't want to argue with him because he sounded a bit stressed but the whole time I'm thinking "What the heck is this guy talking about?".

Some years ago the filing of an application for citizenship was the only way to get the USCIS (or one of its predecessor names) to even act on an I-751. Removing of Conditions was not (maybe is still not) a priority application while a citizenship application was.

Right.... but that doesn't mean your application should be left alone unattached for years because is not "a priority application”

What makes one application more priority then others, when in fact we pay for all of them large amount of money???????

It's just plain stupid to go ahead, submit an application (I-751) just to have to file another one (N-400) thinking that will put an end to this nasty nightmare!

I am going to speak one last time on this issue because it appears that some of you don't want to hear the truth about what is going on... and that is at your option...

Lily... I have always been fair to you and have tried to provide you with insight on the events in your past in order to help you and others who may have found themselves in your stuation. I find you continued vitriol towards me to be extremely dissapointing and counterproductive. I thought we had moved beyond this childishness.

It is growing number of people like you and iansig who increasingly don't want to hear the truth about what is happening on the inside that has cause me to post less and less here and to share my knowledge and perspective with those who have the desire to learn the reasns for what is going on with their journeyat other places. The fact of the matter is that there is a priority order on how and which petitions are processed and which times based on the differing needs of the service. The fact of that matter is that I-751's are one of the lowest priority petitions, especially at Nebraska which processes a lot of what are considered high priority petitions such as employment petitions and asylum petitions.

It is also a fact that I-751's used to take in excess of two to three years to process until very recently. When I first started my journey, it used to be common knowledge that filing an N-400 was the only way to expedite a I-751 since granting of citizenship is a rather high priority for the service.

What we're going through is a reorganization on how petitions are processed. At the begining of our journey, petitions were adjudicated on a entirely geographic based system. All petitions were processed at a center based on where you lived. In the past 18 months or so, the service has been slowly moving toward a system where centain service centers process certain classes of petitions. For instance, CSC has been moving toward processing all family types of petitions. Which is why in in June or so, family types of peittions such as I-485's, I-129F's and also I-751 have been transferred to CSC. We have been caught in the gap of this transition... It would have been better for NSC to transfer all of our petitions at the same time that started transferring new ones to CSC... but for some odd reason they didn't. They chose to keep them for some reason, but there's nothing we can do about that other than let some people know what is going on. We have written letters to our congressman, our senators, and USCIS ombudsman and the DHS Inspector General, and the chair and ranking members of the Immigration Subcommittees of both Houses of Congress alerting them to the point of the inequity in approval of our types of petitions. Obviously nothing has been done about it yet nor do I expect it to, but at least I said something about it and feel better for doing so.

ANd for information, the reason I have been posting here is because we are in the same boat as all of you. My wife filed her I-751 peititon in April 2007 in Nebraska and we are still waiting and are just as frustrated as the rest of you are. But at least we are together and are living our dream... We for one are more that willing to give up our place in the perceived adjudication line so that those who are still waiting to be with their loved one can finally be together, or can fianlly feel safe for probably the first time in years because they have been granted asylum, or have been granted to chance to start their own American dream by being given approval to get employment in the US. If the rest of you are so selfish to wail about keeping your perceived "first come first served" precious place in line... well, more power to you. But the fact is, you're not going to get what you want and you might as well be resolved to the fact that all the complaining and stomping in the world is not going to change the reality.

That is all I am going to say on this topic... VJ used to be a place where hearing different perspectives and reasoning on immigration topics were welcomed and discussed in a civil and reasonable way. Now it is a place where you either preach to the choir or be shouted down and attacked. It is truly sad...

Well...lets make this clear as I see that some people got quite offended by our arguments related to I-751 processing time and the lousy job USCIS is doing processing these I-751 applications

I came to this country on a K-1 visa from Canada and from the beginning I got stuck with Nebraska ,same old story ,processing time for my first petition around 600 days .I thought that was the worst and everything after will go a lot faster .It didn't happen !

Am I supposed to be happy and pretend that nothing is wrong now that I'm going through the same BS with Nebraska ? I'm sorry but I can pretend that everything is OK and I should wait one year maybe two before someone will bother to discover actually my application laying down God knows where .Lousy job ,plenty of incompetence and mismanaging of the founds received for processing all these applications .

Zyggy- the slogan "first come first served " was not put on the USCIS website by me and if that's a lie then, they should REMOVE it right away ,don't you think so ? Do I have the right to be upset that after 12 months I still don't have any updates ? How much more patience do I need to have ???

I would be the first to admit that it isn't fair, as I am part of a group from TSC that have been waiting the same amount of time like you all here dealing with Nebraska. Hey, the TSC Losers finally got transferred out of Texas to Vermont and the first thing we heard was "oh ####### that's not fair to us" from those waiting in Vermont -- which is completely understandable. There is unfairness all around, but is that really a new thing?

But taking your frustrations out on Zyggy, who made a pretty good point (although it sucks to hear it), isn't going to make things better, or make you feel better. Just a thought.

I have contacted my Congressman and he promised to look into my case however, I'm more interested to know why older applications were dumped completely while the newer once were transferred to California and approved within 3 to 4 months .What makes some of up better then other? Is it just another scam that they put on our plate to force us to throw another $400 or $500 filling for N400 ?

Not to mention I found out that people who filed mid last year got transferred to CSC and fly through it... Why don't they transfer the cases that with oldest NOA date? This sucks.

It's just business as usual at NSC...they were doing the exact same thing 3 years ago when we filed our I-130. We filed in January of 2004, then about May or June the new filers immediately got transfers to CSC and we didn't get transfered until September. It royally pi$$ed me off then and it still pi$$es me off!!! It seems they can't figure out that new petitions should go on the BOTTOM of the pile.

And as far as filing the N-400 to speed up the I-751, that is pure BULL$HIT!! If that is what's really happening, they really have their heads up their arses...

I don't want to insult anybody but what's the use of keeping these lists with NSC and TSC "processing" dates when we all can see that the list gets longer every day and their activity is virtually null ? Do you guys trust these people ? I DON'T !

And, no, I don't view the relationship as "property" - that is totally putting words in my mouth and attributing to me a thought or feeling or expression I do not hold and have not held; however, I DO view the green card as a PRIVILEGE and NOT a right that becomes vested simply because the immigrant married a USC. There's got to be more to a green card than that!

Don't bet on that .The fee increase that took place few months ago was just another money grab ....nothing else .Same BS like before and I can tell that one center is worst then other and the slogan "first come first served "is another big lie . My application is collecting dust in Nebraska Service Center since Feb 7 ,2007 ...no updates ,no RFE ..nothing !!!!

Like I said before ...these people working for USCIS should be consider the LOOSERS not us that we complied with their policy !!!!!

I have contacted my local Congressman to see maybe he can find an explanation about all this mess

Um, can you answer the question then, WHY does the USCIS state on their status page that the NSC is filing I-751s dated Feb 10, 2007 when there are people in Dec 06 and Jan 07 who have not had any feedback on their cases? In spite of the fact that I disagree with what you said, they seem to be lying about where they are in the processing. IF they would admit they are behind, at least we wouldn't be worried that something was wrong because it's now been 6 weeks since they said our case was "finished".

Same as you Nebraska did nothing for me so far and calling USCIS is totally a waste of time .Just wondering if contacting the local state Congressman will help however I feel is just going to be another disappointment.

I really want to know and I will do my best even if I have to spend money and hire an attorney ...why in the hell applications filed on June and after were transferred to California and processed right away while ours are abandoned at Nebraska Service Center .Speaking with one of their customer service representative they deny this fact and they claim that every case is different and that's why it takes longer for some of us .I would say that’s BS. Cheap excuse to hide their incompetence !

Those of us waiting in Nebraska need to get used to the fact that processing on our petitions has pretty much stopped so that resources can be placed elsewhere. For most of us, our I-751's will be adjudicated the same time our N-400's are.

I personally will need to take time off from work to go ask for another stupid stamp so that I can travel in a couple more months.

It seems like you want to apply for US citizenship. I shudder to think what will happen to this country if all citizens thought like that. This kind of unjust, cr***Y service is NOT what this country is SUPPOSED to be all about. I am sorry for having to write this, but it just bugs me that people think it is o.k. to wait, and wait, and wait, with no apparent plans that NSC will get their act together, while other service centers are processing papers within a couple of months.

I agree with iansig40. Not everyone needs or wants to become a citizen right now. We are only asking for the services that have been paid for - many moons ago

I remember few years ago when I sent my application I-129F to the same terrible Service Center ...Nebraska it took them almost 600 days to process my application .Did they give me any special treatment because I was away from my spouse ...NO WAY so that's why I'm mad when some guys here consider that we should be just F****G waiting and forget about it .How long we should wait ,one year ,two years ...maybe three ????
