  2. Hello all,

    I didnt know that I need to file I-864 together with form I-485. I have a problem coz my husband (US Citizen) has just resigned form his work last April. He is currently doing a small business (not registered though) he buys and sells cars.

    Legally, he is unemployed but has an outstanding income from last year up to the end of his employment. Will this create a problem if we submit the form I-864 and indicate that he is unemployed? And then find a co-sponsor (my aunt- US Citizen) in order to support my husband's petition. A problem that I see here is that my Aunt has already retired but is receiving good pension from the government, she's got lots of assets, owns lots of cars, a big land in Utah.

    Another way that I see as an option is that, do not file the form I-864 now but still file the form I-485 and wait till my husband starts to work again. Im pretty sure he can start a job by July. The reason why he is not been active in going back to work is because we are still enjoying our time together.

    Please please help me. I was about to send my AOS package tomorrow but was alarmed by one of the comments I received about the Affidavit of Support. I honestly do not know about thi.

    You must send in the I-864 along with I-485 if you don´t do that your whole packet will be rejected, it´s clearly explained you have to attach this in the instructions. If you have somebody willing to sponsor you I would go both ways, use your husbands tax return last year and your relatives as a joint co-sponsor.

  3. I made multiple copies of each document and sent in small packets for each form, without being a big bulge of folders make it as organized and straight forward as possible. I also included a Cover Page listing the forms I was sending and every single document along with the checks.

    I think the more organized you are the better it is for the processing

    We are about to send out the AOS package.

    Each of the different forms asks for the copy of the passport and/or I-94. Do you make multiple copies of them and send a copy for each form?

    Do you separate each form and it's supporting documents with paperclips or send it all as one big pile?

    I really don´t know how it works with Canadien citizens but I assume that at least you get a stamp on your passport saying when you came in and when you have to leave. That is what the I-94 pretty much is, so if you do have something like that on his passport I would at least give it a shot. About the I-551 like everyone else said that is pretty much the temporary Permanent Resident Card and there is no way you would get it by just going for an infopass. When I had the AOS appointment the officer stamped my passport with I-551 so I wouldn´t have to wait for PR card to come in the mail since my Employment Document was lost in the mail.

    Here in Wisconsin you are allowed to drive with a foreign driver´s license for up to 6 months or 1 year (can´t remember) check into that in your State.

    I have searched the forum, and while I found some helpful information, I am wondering how things worked out for others or if anyone has advice.

    So, I too received a generic letter regarding a pending background check for my EAD.

    I am in the process for family based AOS. I have been waiting months (like alot of others here).

    I do have my GC interview next month, so have figured I would be able to sort out the delay with my EAD when an immigration officer has my file in front of them.

    It was my understanding that the EAD is interim while case is pending... so how they can make you wait for background check?

    Has anyone else here been able to have their EAD issued after contacting USCIS or a congressman?

    Will I be wasting my time by crying to USCIS?

    Will I get better answers by discussing this at interview?

    I would really like to hear anyone else's experience who has gone through the same thing.

    I am sorry to hear your EAD is delayed, I feel for you since mine was actually approved but it just got lost in the mail, I don´t have much experience with delays due to background check. In my experience, just like you I had my AOS interview about a month after my EAD didn´t come, I contacted congressman and that didn´t help, I went for Infopass and I was told I had to re-file and pay again the fee for EAD and wait for 90 days... again my situation was different EAD was lost in mail. At my AOS interview the officer was very helpful and she not only approved us on the spot but also stamped my passport with I-551 (temporary green card which allows you to work and travel) while my green card came in the mail. The card came about a week later so no more need to worry about EAD. Once again my situation was different and if you are stuck in background check for EAD most likely you will also have that situation with AOS, BUT you definitely can bring up that situation to the officer at the interview and he/she will give you more information that all you can find through USCIS Call center, Infopass or Congressman.

    I hope that helps... be very patient I know how you feel but this is how the process works... =(

  6. I am very depressed now I have not seen my husband in seven months and out one year aniversary is Monday. I just found out that the embassy sent packet three for my husbands visa to our lawyer in the US and it is going to take another month or longer before we get the interview set up. I just want someone to talk to before i go crazy.

    Can anyone give some advice or support?

    I know it´s a very hard process but if you have been lucky enough to find your true soul mate think that this wait is necessary for you guys to be together... Some people never find the right one, you have hang in there!

    Oyeme ya veo tu firma de los foros... no te hicieron el transfer a CSC? Veo que hice mi filing dos meses antes que tú... Hoy me toca llamarles porque parece mentira que se estén demorando tanto. No quiero pedirle el favor a mis parientes que trabajan en USCIS para no meterles en lios.

    No fijate que no me transfirieron, gracias a Dios tuvimos la entrevista muy rápido y me aprobaron "on the spot"... ojalá se resuelva pronto tu caso... es cuestión de tener mucha mucha mucha paciencia!

Yes he will be able to travel as long as the I-551 hasn´t expired, I traveled abroad and had no problems when coming back in with the stamp, they do advise to bring supporting documentation with you such as the welcome letter and marriage certificate, in my case it wasn´t necessary to bring those out, you better safe than sorry.

  12. Very bad Idea. Using a tourist visa to immigrate is visa fraud. There is a proper visa for your situation, K-3 or CR-1.

    If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US.

    You can file I-130 while here, but I would not try adjusting status, big questions can be asked at the AOS interview.

    Do you want to risk being band from USA for life?

    This is what I´m talking about when I say people will tell you you totally screwed up. Best advice go to a lawyer before going back and having to be away from your family for 6 months waiting for your Spouse visa. The law is very explicit and yes coming with the intent of staying is visa fraud.

    I am married to an USC for a year living abroad. We decided to move to the US a few days ago. I entered the country with my tourist visa and I am about to file the I130 and AOS. That said, I have just read the following sentence in the guide section of this website, which made me very nervous:

    "If you are already married, and your spouse came to the US on a tourist visa with the intent of immigration and marriage, then he/she should return to his/her home abroad, and the I-130 (or along with an I-129f for a K-3 Visa) should be filed with the relative outside of the U.S. to avoid denial, deportation, or even being banned from re-entry to the US."

    Does anyone know the likelihood of any of these penalties happening to me?

    Regardless of what anyone can say to you (you will hear some people say that you definitely have to go back and start the spouse visa process), you CAN go through the AOS process from inside the US. I came here on a tourist visa and got married after three months of being here and I have my green card in hand right now. You have to be very careful about the way you word everything and put your paperwork together because it could be considered visa fraud. According to the law you can´t use your tourist visa to immigrate, but there are some special circumnstances like my case where we decided to get married "spur of the moment" in which you don´t run into any legal issues.

    Now, I don´t have experience in couples that were already married and came together to the States, so my best advice would be for you to look for an immigration lawyer and have a consultation, for us that consultation was $100 and they told us what our options were. Now the lawyer will of course try to sell his/her services and that for us was $2,000. We decided to go on our own and we were approved.

    Don´t totally freak out about this, you were supposed to send the original but at least you sent a copy, I don´t think you will get denied because of this, the worse case scenario is that you will get an RFE (request for evidence) for the original of this document and then you will have to send it in. The best case scenario is that they are ok with a copy and your process moves along normally and are requested to go for an interview and then show the original!

    Like you I am going through AOS process, luckily we had the interview and it went just fine, got approved on the spot and even got the I-551 stamp on my passport due to the fact that my EAD never came. We are young as well but have our few assets under both names and utility bills and lease agreements is what the Immigration Officer looked at.

    The scrapbook idea is great, not only shows your pictures but shows that you have the "love and enegy" to put a scrapbook together, it worked for us.

    Take it easy and don´t be so extreme about things, there is only so much you can do, just do your best, freaking out definitely is not the way to go.

    Eres del mero Sinaloa donde se rompen las olas?? Yo viví en Tepic antes de venirme para acá pero realmente he sido un paria, nací en el DF viví en Tabasco, Chiapas y luego Nayarit... así que bueno... que chido que igual hayas andado por varios lados!
