    That's why the box on the form in Q8 is called Current income and not the amount from your tax return. 

    You INPUT Tax reported amounts for all three years only in 24a,b,c. PROOF of it is only required for the most current year.

    Read the instructions carefully for those VERY different sections.

    The tax return is not a high value as per current income. That's why as the instructions state you can provide other evidences of current income.

     

    Okay thank you that gives me hope. We will try without a joint sponsor as his current income will be above poverty guidelines. Thank you so much for your help!

    Only self employed use GAI.

    Employed uses GTI.

    I have looked at the tax return too.

    all i see when it comes to income is this and they are all the same number as his w2: (see images)

     

    Note: he is in fact employed.

    Not sure. Your post is quite confusing whether you understand or not. 


    I do understand but i am just worried that because he didnt meet the 2023 guidelines that i will still need a sponsorship despite the fact that i can prove that he will meet the 2024 guidelines.
     

    Because i think that the tax return is high in value. 
     

    I made this post to ease my worries and to know if with what i have said before, if it will cover my grounds and if it will be enough proof to show that he will meet the 2024 guidelines if i DONT file with a joint sponsor.

    2024 taxes aren't the most recent year for proofs until after the filing deadline date in April 2025.

    2023 taxes are the most recent tax year until April 2025.

    The reason why im thinking about this too much is because we have now found out bc of his insurance, he did not meet the 125% 2023 poverty guidelines. We are short by a couple hundreds. So i am trying to figure out if maybe we are still fine going without a joint sponsorship.

     

    As you have mentioned before. When i will file approximately around october 2023, i will have to meet the guidelines of 2024.

     

    For the evidence i will have to include employment letter, recent tax return 2023 and other documents. 
     

    If I file with those, will they give me an RFE saying he didnt meet the guidelines? Because the reason why he didnt is because he got promoted mid 2023. His income for his position now would have made enough for 2023 if he didnt got promoted mid 2023.

    He will also make enough for the 125% poverty in 2024 when it goes up.

    I would be able to prove this with the employment letter.

    You have to meet the guidelines that are posted at the moment you file I485.

    And as well, you'll be required to prove you still meet whatever they are at the moment you are interviewed, if interviewed.

    The former (meeting them at the time you file I485) is the policy. 

    The latter is a common practice that an adjudicator will sometimes expect from sponsors. 

    Keep in mind that the AOS process can be two years plus before anyone opens your file and can be scheduled for an interview which is why:

    1. if you aren't scheduled for one and is been a long time since you filed, they send out RFEs for current proof of meeting the guidelines.

    2. if you are scheduled for  interview, you'll bring an updated Affidavit of Support and financial proofs, just in case they want proof of still meeting the FPGLs.

    So bc i will file for AOS after they have posted the new 2024 guidelines, i will need to meet the 2024 guidelines. But how about 2023? Cause i will have to attach a recent tax return and if i will file for AOS in approximately October 2023, the tax return for 2024 obviously wont be available yet (as the year hasn't also ended).

    Look at the paper copy of the ACTUAL tax return that you are to keep for your records for 7 years. 

     

    Are you using this info to fill something out?

    Your timeline says you haven't been approved for a K1 visa but you've posted this in the K1 AOS forum. 

    Numbers on any Affidavit of Support must be supported and match financial documents. It's best you wait for the actual financial document that you can use as proof before you go inputting numbers incorrectly.

    He has filed taxes last week. The tax transcript takes a couple of weeks to generate. That’s why i’m using w2 at the moment. But from what I see is that the income on w2 and tax transcript is the same. 
     

    Where do you see gross income tho? Like i only see total income and what i have mentioned previously.

    I have a question for the poverty income guidelines for 2023: Where do you find the income that needs to meet the guidelines on the W2 form?
    Is it: 1 wages, tips, other compensation?
    If so is that legit just that box or do you also have to calculate in other boxes?
    If so also isnt that then the taxable wage? And not gross income? I thought you had to look at gross income? Idk 😩

     

    I want to add that my fiancé (petitioner) pays for insurance through his work.

    Received NOA1 in October 2022 (K1). Now I see that cases that were filed in December 2022-January 2023 are getting approved without any expedition requests (beneficiaries the same nationality as me), while our case is moving very slowly in the queue. Using a case tracker app.

     

    I don't understand how this whole system works but it seems a bit unfair. Or could it mean that our case somehow got lost or stuck?

    I’d say for DS-160 i would wait till you received your case number and your status shows ready.

     

    For police certificate depends on the country or countries you need to request it from. Meaning if you know it will take several weeks from request till you actually receiving it, then you can request it now but if it’s just a few simple  clicks on the government’s website (as it is for me) then i would wait. Keep in mind they also have an expiration date.

    Definitely leave 2 weeks in between your interview and medical exam. Don’t book it too early cause as soon as you have your  medical exam done, you have six months to come to the usa. 

    When the earliest availability is for your medical exam is something you need to call for yourself. Call the doctor that is approved by the US for your country tomorrow to see the availability. I would not wait long with this because there might be long waiting times.

    NVC does not schedule interview dates for K1 visas. They only do that for spousal visas so ignore that. Its the embassy that schedules it for you or  you have to do it on the embassy site. It depends which embassy you have.

    Edit: As part of my inquiry, NVC discovered that USCIS also bungled my fiancé's birthdate, so NVC told me to send a passport scan to correct their documentation. USCIS continues to be mind-boggling bad at everything, even though we thought we finally escaped from them...Docs submitted today, fingers crossed this doesn't hold us up even more. 

    Invoice ID is not needed. The letter NVC sends is called K1-FTP and will be emailed to the petitioner. NVC emails the letter when your case will be transferred to the beneficiary’s embassy. If you want you can ask NVC for your invoice ID but it’s not really needed.

    Oh you should try to scan monday again bc i saw a lot of people had low numbers when they scanned but after a second time they had more. I know the scanner in january had that issue. But obviously you don’t need to do that ofc. Only if you want or have the time.

    I pretty much stated when we were engaged, when we hoped to marry per our intent for the I-129F and what our plans are now.  :)  well now as in during that interview process.  I took out full names for privacy reasons but kept first name as we have that in our profile.  This is basically what they are looking for.

    *NOTE* that I stated how the delay affected us without being too specific.  :)  I know that did not sway their opinion much as for Ukraine, it was more about my tax documents and whatnot.  But still, it felt great to express this.

    Well, we found our interview times.  I talk like I am there.  I found interview times for both of them (her and her son) for next week Tuesday.  We were going to do ASAP, but the only times this week are Tuesday and Wednesday.  Both of them have their medical Monday morning so between that and the COVID vaccination, it is better to wait 1 week.  Appointments are scarce in December now (which makes sense because we are approaching the halfway mark of the year) but January is not lacking in appointment days.  The appointment should be scheduled within the next 2 hours today and then it will be me emailing all the paperwork to her, including my reaffirmation with an updated intent to marry.  I am definitely excited about this and I know she is also.  We both are just concentrated on taking this one step at a time but Friday was awesome for her.  We submitted both corrected DS-160s (we had to complete another app for her because I put official for her passport.  It is regular by the way unless the beneficiary or child are diplomatic or government people) with pictures and 1 hour later she went to the banks to withdraw and pay for the MRV.  She provided me the receipt numbers at my lunch break (which was 8 hours later) and I attempted last night (almost 20 hours after she visited the bank) to put in the receipt information.  She told me the bank said the next morning.  I read on the site for 10am the next morning, but I thought it was 10am weekdays only.  I checked this morning, put in the receipt numbers for both of them, and the system accepted them as valid numbers and showed me the available appointments.  So for the appointment thing, just check following morning after the MRV is paid.  Just as with other computer systems, it works 24/7/365 so it does not wait until Monday to open appointments if you pay on a Friday.

    Hi can i ask you what you said in the UPDATED intent of marry? Did you write something different then the first intent to marry you included in your i 129f packet?
