  1. Waiver wont work but try an appeal.

    On what basis, the CO denied her visa because of fraudulent marriage, so there's no basis for an appeal, the only way out is to prove that her previous marriage wasn't fraudulent and her ex husband confession was a lie which will be a nightmare to prove. CO has full discretion on their decision for Non-immigrant visa, so appealing that decision is almost impossible.

  2. Please read the note on the link you posted, it clearly says if the patient is does not qualify for medicare or medicaid, the state of CT has some funds that pays for the care, this can vary from state to state.

    I am just clarifying that tourist on business or pleasure to the US, are eligible to apply for EM, their status wont be an effect. When they use the service under EM, it'll be paid for by the Government. Although tax payers are furious about this.

  3. There is no emergency medicaid for tourist, that is not the responsibility of US gov, they would do it as a humanitarian thing, but in no way they are responsible for emergency care of tourist.

    End of the day tourist and if they have family and friend in US are responsible for the cost associated to tourist's medical aide.

    I am not sure if when tourist apply for tourist visa, if there is a question that is asking tourist if they ave ever used the medical aide in US in their past visit.

    my sister used emergency medicaid BTW, she came to the US with a b2 visa, the government paid the balance in full.

    Immigration status is NOT a factor for Emergency Medicaid eligibility. Any person, regardless of legal immigrant status can be eligible for Emergency Medicaid if he/she meets income and asset limits.

Yes, everyone is missing the point, yes a pregnant female tourist will be provided emergency care to deliver her baby, but when she re-applies or present herself at the embassy or at the POE and if she is questioned about receiving any kind of free emergency government care, her visa will be denied or she will be refused entry into the US.

    You guys are missing the real point, the emergency medicaid is design for non-resident, so receiving it shouldn't have any effect on the tourist that applied and used it, why would it gets you in trouble when you apply for something you've qualified for. Doesn't make any sense to be refused entry to the US because of used of government sponsored program.

    @Life'sJourney' have you heard of a case when the tourist was denied entry due to used of government sponsored program such as Emergency Medicaid?

  5. That emergency aid would be provided to tourist, but at the end of the day its not free they are responsible for paying the bill.

    Thats the reason there is something called medical insurance that you need to buy when you are traveling to different countries.

    If this person did not buy this coverage, then they would be liable for using govt funds.

    Emergency Medicaid is government sponsored, the tourist as to apply for it, and can only be used for Emergency or when giving birth meaning you wont get any normal care with it. Unless the tourist wants to sucker punch himself/herself to go to the ER. For me it would be useless since the last time I went to the ER for care was when I was 5 years old.

  6. That article does not make any reference to how govt benefits are handled for a tourist. You'll are taking things out of content, but I am not going to debate this issue, when the non-immigrate is questioned about using benefits in the US that are not available to them, I hope they can pull this article out and help persuade the embassy or the POE officer to let them re-enter the US.

    Emergency Medicaid is available for pregnant women on tourist visa, or tourist who needs emergency assistance at the hospital. It can only be used for emergency care only or to give birth.

  7. Answer accurately and truthfully, any lie will grant you a denial with a lifetime bar from entering the US for misrepresentation. These guys are very serious when it comes to dishonest immigrants.

    Don't ever play smart with the CO, they look for eye contact, body language, the way you stand, tone of your voice, etc...

  8. correct the wife could petition for the mother when she's eligible. an appeal could be filed.

    If that appeal is base on the denied tourist visa, then I wouldn't recommend it. The CO already made it clear to the applicant that there's no way she's gonna get a visa. Appealing a CO's decision is a headache will little chance of success.

  9. you've been married to a US Citizen for 7 years, you got your green card in 2006, and was in removal proceeding for not lifting condition and your husband file jointly, now you want to file for divorce, your lawyer is telling you to file for waiver cause its easier or claim abuse.

    If your marriage was more than 2 years, you should have receive a 10 years GC without the conditional GC, that's for spouse who been married less than 2 years to a USC.

    I really don't know where to begin giving you any advice, something its not adding up. Its 2011 its been 3 years since you should have lifted condition :whistle:

  10. This instance hardly rises to the absurd examples in your post. Afterall, they did provide a service.....This is the first time in my life that I've been scammed, ever, to my knowledge. I suppose that there are people that would pay that much to a Lawyer for the same. I'm pissed because I know how to fill out an application, even archaic mundane and absurd ones such as USCIS produces.

    I blame this snafu wholly on my distaste of this process and my haste in clicking links from a site I trust, this one (oh, and Barrack Obama for not protecting me).....

    I was too quick to want to get on with this #######, and ####### it is.....

    so far my transition to life here in the US has gone really well.

    I have a wife, a life and a job here so that's great.

    However, I am trying to build some credit rating and am wondering how you guys did to acquire credit card(s).

    It's a bit of a catch 22 where I can't build credit rating without a credit card and I can't get a credit card without a decent credit rating.

    I make decent money and have a good history from Europe, but does that matter?

    Any ideas/suggestions?

    Preferably I'd want a credit card with some rewards (like frequent flying miles, cash back or similar).

    You need to go to your local bank and apply for a secured credit card, the credit limit will be the amount you deposit into your fund, if 500 your limit will be 500, and after approximately 12 months of on time payment, that 500 you've deposited will be returned to you and your credit card will be unsecured.

    Capital One is one of the few major credit card issuer that will take the risk and issue an unsecured credit card, but the available credit limit will be as low as 300 dollar, and APR rates will be in the 20's with no rewards, plus an annual fee of 19-30 dollars.

    Credit card with reward, miles, cashback are for people with good and excellent credit, some CC issuer such as Chase, Bank of America or Discover require the applicant to have 2 or more account open in their history report for over 2 years at least. I was denied a Chase Freedom with a credit score of 720 so imagine you with 0 score.

    Another thing to know is there's a lot of horrible card out there, on the lookout for desperate people who wants to build credit, these cards has high interest fee, high annual fee, very low credit limit like 100 buck. Avoid these at all cost specially FirstPremierBank.

    I guess I'm out of status since I came here as a visitor from Canada where we don't need a visa to cross the border. I thought I was clear about that.

    You will need to file AOS I-485, I-130, EAD, AP immediately and do not leave the country until your Green Card is in hand, because if you leave you will be banned for 10 years from entering the US because of overstaying, I would definitely consult with an immigration attorney if I was in your shoes. Also since you are now married to a USC, your illegal presence will be irrelevant at AOS interview.

Living separately for almost 2 years will raise some serious concerns on your case, USCIS is very strict when it comes to married couple living together, I would strongly advice you to come up with more details because living separately is way more expensive than living together, and you guys visit each other from Texas to CA back and forth which isn't cheap, so if I was you I would be very careful about the true reason why you guys doesn't leave under the same roof. maybe school in another state, deployment to Iraq or Afghanistan, job that require frequent traveling these are usually reason couple live separate, etc... Just my opinion :thumbs:

    USCIS may suspect that you guys are separated and decide to file jointly anyway.

  16. I would strongly suggest to follow the k1 route instead of marrying here and file for AOS, coming here with a pending k1 and marrying your US fiance and file for AOS, the intention of staying prior to your arrival to the US will be pretty obvious to the IO at your AOS interview, just understand the risk you'll be taking if you decide to stay, no right to appeal if your AOS is denied. Plus a ban for overstaying. :thumbs:
