Hello, Looking over the I-130 and hoped someone could clarify what they experienced using DCF with Exceptional Circumstances; specifically for the sections Mailing Address, Physical Address, Intended Address. Do you just use the current foreign address the petitioner and beneficiary both live? Or do you need to have a place already in the US? Any help is appreciated on how to approach the I-130 in general. A bit confusing considering the DCF-EC is for a new US job offer on short notice yet that seems to conflict with the overall US domicile requirement? As for the I-864, also curious how the tax/income affect the overall visa approval at the interview. If the USC petitioner has no income for previous tax year, and currently not employed until returning to US, would that matter at all if the petitioner is also submitting a second I-864 from a Joint Sponsor? Any other insight to the forms etc is greatly appreciated. Thank You
  2. @Black Unicorn any guide for the I-130 when applying via DCF with Exceptional Circumstances? How does the domicile section work if the US petitioner is living in a foreign country, which is the purpose of needing DCF-EC...? Is the job offer the evidence? What did you specifically submit? Also, how does the mailing address section work? Did you use the US citizen petitioners foreign address? Seems contradictory to what's needed for approval. Thanks
  3. Hello everyone. Been researching for awhile and would appreciate any insight. Background: - US Citizen married to Austrian Citizen - Married in Austria, January 2022 - US Citizen recieved Austrian residence permit (Aufenthaltstitel) via family reunification as married couple. The card is dated April 2022, and US Citizen simultaneously registered the address of residency with the local authority in Austria. Questions: 1) Does the consulate in Vienna accept Direct Consular Filings with Exceptional Circumstances? 2) The DCF-EC would be due to a job offer on short notice. Is there anything specific required to qualify, other than the US Citizen providing proof of Austrian residency and their Austrian residence permit? (Does it matter if they have not been employed in Austria?) 3) What is the exact policy on length of stay in a foreign country before the US Citizen can use DCF-EC for their spouse? (Is it 6 months?) 4) Can DCF-EC be used again in the future if they decide to move back to Austria for a few years, which would require surrendering the Green Card via I-407? Thanks in advance.
