Hi, The answer is no!. your EAD and AP are put on hold until you return the RFE. I know this from experience because we have had exactly the same thing
happen to us!. Unfortunately, all you can do now is wait until someone at the USCIS decides its time for them to look at your file.

Hi, Congratulations to you!. I know exactly what you were going through!. We applied for AOS, EAD, AP, early July and
got an RFE on Sept 11 on the I485. We responded 2 weeks later and, since then the I485 has been touched on two
occasions but, still nothing on the EAD oe AP since early August 08.
I wonder HOW MUCH LONGER this is gonna take!!!

Our I485, I131 and I765 applications were recieved by USCIS on 07/14/08. On 9/11/08 they sent us an RFE on the I485 which was responded to. My question is, since the processing times are 3 months for both I131 and I765 am I now gone outside the timeline or, does the fact that there was an RFE screw the whole thing up and, we have to start
all over again?
I would appreciate any of your thought's!

I'm wondering am I panicking too early!. Our attorney sent off our i485 RFE docs on 10/06/06 and still our case
processing resumed has not shown online. A few of you have told me this was only taking a matter of days.
Im just curious to know, are the nice people at the USCIS sitting on their hands again?.

Pablo, I am on the same timeline as you. I sent my RFE on Monday, 10/6, and I checked USPS many times and verified that it was delivered almost 5 days later, and then I waited another 5 days for it to show up online. So, I think yours should show up online early next week. Did you check to make sure it was delivered (did you mail it priority or certified)?

Actually, I am also working with an attorney, but I wanted to make sure I KNOW when he mailed it, so I made him send me the tracking number, so I can track online on my own. If you can't stand the wait, ask your lawyer to provide you with the mail tracking info, so you can check it yourself. It still takes between 5-6 business days after it's delivered for it to show up in the Case Status Online system... I don't think you have anything to worry about. But do ask your lawyer for the tracking info, so you can sleep better at night. I know the feeling!! :star:

We sent back what they needed (Tax transcript) and now our casse online state has changed.... now it says:
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 10, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our NATIONAL BENEFITS CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.
It's a big releive to know they got the missing evidence...
Fingerprint were done past Oct. 2nd, and we dont know yet if theres gonna be interviwe (hopefully NO).....
What should we expect now?...why do they say they will notify within 60 days?? notify what?!... it seems to me thats way too soon for the green card!!!! but anyway... a miracle can happen right?

were . If you could let us know the date, we could watch the for case status online to change, roughly around the same length of time it took for yours to show.
I also sent the RFE evidence for my AOS on Oct 6, and yesterday I checked USPS and saw that the package was delivered to the Missouri PO Box. It hasn't been updated online on the Case Status section yet, so I am just waiting to see when it will be reviewed, and decision made.

Our return receipt was received after a few days. USCIS didn't send us a response until a month later, and it was a rejection notice. I posted the story here if you are interested in reading why:

ours was about 2-3 weeks after acknowledged receipt... (When the online system said that the case resumed normal processing)

HI everyone! Our visa has been approved!TODAY!
Even without the long form birth certificate and with a more complicated immigration history.
We are so happy since we received the visa right away (1 hour later) in my passport!
We are so happy that we are a part of this website and were able to learn so much from you guys!
The questions we were asked were no different from what they say in the guides on VJ so I don't need to post them here.
I just wanted to share my joy and thank you, also wish good luck, and promise I will stay commited to the website for the next part of the journey AOS.

went smoothly for you. My interview for the K1 is in April and I would be obliged if you could answer a few questions for me. Firstly, I see fron your entries here that you had a previous overstay. The last time I was there I overstayed
60 days, but I left voluntarily. Did they question you at the Embassy about your overstay?.
Also, how was your experience dealing with the people at the embassy?. Was there any hassle with them?.
Any advice you could give regarding the interview would be greatly appreciated.
Also, did you leave through Shannon POE?. how did this go?.

Hi again VJers, Does anyone know, what would the minimum income requirement be for the I134?. My fiancee has one son, and I hope to be bringing my daughter to live with us at sometime in the future. I find this whole affadavit of support thing very confusing!

I am working on the I-129F tonight and I got to thinking there are probably lots of others doing the same thing.

How do you know if you are stuck in a background check, when waiting for noa2?.. We filed late june 2007 and, still no approval or anything else. Our attorney emailed Csc and that uncovered nothing. All they said was, wait another 30/60 days before contacting them again!.. Im getting seriously p***ed off with this. Local congressman seems to be a waste of time also!..

Long time to wait. Very sorry to hear that. But you are now outside the 180 day mark. You should be doing some serious investigating now. Time to call and bug them and bug them and bug them. Get your local elected officials involved as well. Good luck to you. I'm sure it will work out in the end. but not knowing when the end will come is the whole problem. There are others in the same boat. You're not alone. But eventually you will have your time of joy. Hang in there.

I was told by officer ******* at the Csc, that since I had already contacted them on 1/10/08, not to contact them again for another 30/60 days for more information. She was definately not very helpful!..

I contacted Csc last week to ask why we had still not received any update on our i129f. We filed mid June 2007 and since then our application has been touched on three occasions, but no approval or anything else!.
Is there many people left who filed around that time who have still not received approval?.. Please let me know!..

at home for another 2 month's?. My hair was like a rock star when I started this process, I now look like Kojak!
