  1. My USCIS account shows that case was approved and card was produced for I-485 on 25th August while concurrent case I-765 showing that "Your case is taking longer than expected to process. You will be notified if you need to take any action."

Did anyone have the same experience ? What does this mean ?

I assumed that if I-485 is approved and card was produced, the next step was to receive green card by priority post.

    Thanks,

  2. I am preparing the AOS docments and have a question about I-765.

Instruction of Form I-765, page 20 says "if you are filing Form I-765 " under the (c)(9) category, copies of any of the above are not requited."

So, I don't need to submit I-94 or copy of K1 and entry stamp or marriage certificate ??

Only two passport style photos and completed and signed Form I-765  are enought??

  3. I came to the US with K-1 fiancee visa and just married.

Regarding Form I-485, instruction of I-485 says that one of the Evidence required to file is "Evidence of Continuously Maintaining a Lawful Status since Arrival in the US".

Does this apply for the K-1 visa holders as well ?

The instruction lists copies of  I-797, I-94 and passport page with an admission or parole stamp as evidence but these are also evidence of inspection and admisison and documentation of an immigrant petition.

Other than I-797 or I-94, what can be the proof of lawful status ?

    I appreciate your help.

    1. You need to satisfy PP pictures for each form independently.

    2. Look at your recipes for a PD if any.

    3. Read the heading of "part 13."

    Thank you.

It should be listed in your I-129F receipt and/or approval notice.  If not, just put your I-129F filing date.

I checked and found out that in our case, there is no PD. Thanks.

  5. I have several questions about Form-485.

1.If I apply for the Form-131 togheter with Form-485, do I need to submit 4 possport style photos?

    2.Regarding ItemNo.4, in Part2. P.4, "Priority Date from Underlying Petition(if any)".
What is priority date ?? I can't find it in my K-1.

    3.On p.19,
XXXX subscribed by me, including the corrections made to this application, numbered □ through □, are complete, tre and
    correct.
What is the "corrections made" ? I didn't make any corrections on Form I-485, then these two boxes can be blank??(attached part of the Form)

    I appreciate your help.

Note the "or" in the form instructions.  If you are an AOS applicant, no need to provide documentation on the purpose of travel.  It's ok to enter "TBD" for part 4 of the I-131 form.

    Thank you.

As mentioned, you can leave Part 4 blank if you do not have immediate travel plans.

For our I-131, Part 4, 1.a, we listed "no current planned travels", and 1.b, we listed in a few countries including my foreign spouse home country as potential travels.

For Part 7, #1 you can mark "More than one trip", and add a separate sheet of paper explaining that you have elderly parents.

For our I-131, we added a Part 7 separate sheet including names of the elderly relatives and pics of their foreign ids who are potential "humanitarian reasons" to travel outside of the country for my foreign spouse.

And surprisingly, that Part 7 separate sheet was a document uploaded by USCIS to our USCIS account under the I-131 application document section.

I don't know if that made any difference, but if you go see our Profile or Timeline, you will see that we got the EAD/AP combo card after doing an I-765 expedite.

  9. I would like to file I-131 because my parents are old and I worry just in case they got sick or  they are hospitalized, etc.

Instruction of the Form 1-131 says I must provide "Documentation of a family member’s serious illness or death." in Part 4.

What should I provide if my parents are currently not seriously ill  and I don't have documataion from a medical doctor ?

    Thanks.

    I am confused.

    I am working on Form I-485 and I -864.

My husband is my sponsor and we are already married since I entered the US with K1 visa.

He sponsors only me because I don't have any dependants.  In this case, the Item No.8 in the Part5(Sponsor's Household Size) is 2 or I ??

It seems the number "1" is automatically input in the Item No.8.

Regarding this form, Part 6. Sponsor's Employment and Income, Item No. 21 and 22,

our Item 8,11,14,17  are empty because my husband (sponsor) does not use the other's income. In this case, Can we keep No.21 and No.22 blank ?

  11. Hi,

    I have a question regarding I-485 and I-131.

I am reading the following page of USICS which says "Pay each filing fee separately. We are transitioning to electronically processing immigration benefit requests, which requires us to use multiple systems to process your package. Because of this, you must pay each filing fee separately for any form you submit. We may reject your entire package if you submit a single, combined payment for multiple forms."

    https://www.uscis.gov/i-131

Did you separate checks for $1,225 (fee for I-485 and the bio metric service fee) from a check of $575 (fee for I -131) ?

Or did you cmbine  them all togeter in one check ($2,800)?

If you could  share your experience, I appreciate it very much. Thanks.

  12. Hello, Did someone visit your boyfriend/girlfriend to the US after your case was approved ?
I understand that one can visit the US with a valid VISA such as ESTA or B1 while waiting for the K1 VISA.
But, is it OK to travel to the US at any stage of the K1-VISA processing ??
Can one enter the US after one gets the case number (and bofore scheduling the interview at the US embassy in one's country)  ??
I am worried because I saw some people taken to a hearing room at the immigration and questioned for 2 or 3 hours.

    Thanks,

The petition is primarily about the petitioner, so background checks done prior to approval are as such.   Background checks may be done at any point throughout the process though.

Hello Jorgedig,   I have just received the second approval 40 days after our case was sent back to USCIS.  I have no idea why it went back to USCIS. I am now waiting for the case number to come. Another a couple of months waiting?? But, the most stressful part is over.  Thank you.

NVC sends approved petitions to the consulates once requested....  timing on that can really vary.  Some consulates have recovered from Covid backlogs and are quite efficient.  Others still have huge queues.

In generally, you will be notified when your petition is in transit to the consulate, and then consulate will send the petitioner a 'packet 3' email, which outlines the next steps, such as scheduling the medical exam and obtaining police report, as well as interview details.

But again, these details are quite consulate-specific.  I'm speaking out of experience from what Auckland did in 2018.

Thank you. I thought background checks were done before NOA2. It seems that all we can do is to wait for further notice.

    Best,
