  1. So much for “ we process cases on a first come, first serve basis” 😑
  2. I did one time last year and the DOS sent a boilerplate response that was completely unhelpful. Mind you they only responded to the congressman after multiple emails I have sent them myself went unanswered. They never once replied to my emails. Absurd
  3. Thank you! It's stressful because right now it can go either way, Fulbright is difficult. If I were you, I would definitely be reaching out to the DOS or your Congressman and demanding a decision. This is definitely not fair. You can also consider filing a write of mandamus. if you have the money. I think these lawsuits are playing a role because DOS is suddenly working faster.
  4. I also want to share the same update! my hardship case reached DOS on May 24th, 2023 and I just saw now that they requested Sponsor views yesterday! at long last some movement!! My sponsor is also the DOS . No idea how long the sponsor views step takes, can be few weeks to a few months now. Fingers crossed for a favorable outcome .
  5. Has anyone with gov funding tried to reach out to the Bureau of Educational and Cultural Affairs to ask for a favorable recommendation?
  6. Mine does have gov sponsorship so I am aware it will take longer. However, there is no reason for them not to request sponsor views now since they are working on cases received the same month as mine. It’s not like our hardship is somehow less
  7. Oh If I were you I would definitely reach out and try to force a decision. The way they process these cases in the order they receive them but this is clearly not the case. This is incredibly unfair on top of the ridiculous long wait we have to endure. Just a question, does yours have gov sponsorship ?
  8. They received my case in May 2023 and I still have no response. This is ridiculous
  9. Do we have any idea if this person somehow managed to expedite their case with DOS or if they are actually working faster now?
  10. I have the impression that cases with a NFR take even longer to get a decision . Sad
  11. wait is this another new update? The latest update from a few weeks ago had a footnote about how hardship cases are taking longer because of the volume. If we are to believe this latest update it gives us hope!
  12. At this point this thread should be renamed "J Hardship 2021- forever state of agony timeline".
  13. This is crazy. they claim that they process them on a first come first serve basis but this is clearly not the case!! So unfair to those unlucky ones who have to wait years for a decision. This is the definition of “capricious and arbitrary “ that US immigration law sets. Grounds for a lawsuit if you ask me.
  14. Has the DOS published their Visa waiver statistics for 2022 or 2023? The last available data is from 2021.
  15. I have noticed that all cases decided relatively quickly are ones without government funding. Interesting.
  16. Please keep us updated about the mandamus Yes I think this qualifies as hardship. But you should definitely speak with an attorney
  17. How long have you been waiting for a decision in total? Between USCIS and DOS?
  18. You cannot sue them when they tell you clearly that their processing time is 12 months. That’s ridiculous. You can only sue them once they exceed their own posted timeframe. I know that this is not what you would like to hear and that unfortunately the DOS can keep changing the processing time like a moving target, however, you are not entitled to a decision before the official posted processing time is elapsed. The DOS will most likely request the judge to dismiss your mandamus. curious though, who advised you to file this mandamus lawsuit so early?!
  19. Wait do you mean DOS received your case in Feb 2022 or Feb 2023? Because how can you file a mandamus for a case that is still within normal processing time? If DOS received your case in Feb 2023 the earliest you can argue they are late with processing is February 2024. Their own posted timeline is 12 months.
  20. Unfortunately what you believe may not necessarily be true. It’s not pessimistic, it’s realistic. DOS operates on its own schedule and I would not be surprised to hear that there are some cases still pending from 2022.
  21. This person must have had their expedite request approved because I don’t think this happens on its own!
  22. I think the main issue is not whether someone ended up overstaying or not, it is the absurd amount of time hardship waiver cases are taking to be processed. Most of the time the lengthy delays cause people to lose status as visas expire and they’re still waiting for a decision for years now.
  23. Congrats! it should not take too long from this point on, maybe a week or two. Did you receive US gov funding? were sponsor views requested?
  24. And with sponsor views too! Very interesting. I wonder if this person somehow managed to expedite That is way too much. Highway robbery if you ask me. I would file myself, it’s not too difficult
