Effects of Major Family Changes on Immigration Benefits

This forum is dedicated to topics such as but not limited to divorce or even the loss of life of a petitioning relative (Family Member) and how it may affect immigration related benefits.

i mean after i got my name changed, i'm going move to another state then they will ask me show my Green card (with my husband's last name) and with my final divorce decree with my maiden last name, probably they will ignore to transfer my diver license with 2 different names

  2. any one get your last name changed after getting divorce, so will i have to change all paper work back to my maiden name? including social, driver license...how about bank account, and credit card? how about the 2 yr green card?

    thanks

You do not have to change your name after a marriage or a divorce, it is your option (in the USA anyway) But yes, if you change your name you need to change it with everyone, submit a copy of the divorce certificate with your request to change name. You will need a new bank account and credit cards if they were jointly held. Close the old accounts and open new ones, in your name only.

Your two year green card is conditional on you being married to the petitioner...you know what that means?

thanks for your replying but the whole point is i'm going to move another state, thought my paper work would be mess up when i get driver license's name changed then the conditional still with my ex husband's last name?

  3. thank for all sharing your opinions, by the way i'm planning that wait till i get 1o yrs , at the same time i will sill living with my bf still celebrate wedding with our marriage license, then i will file for 751 waiver then if they deny i will try to fight and i will apply more evidence about me and bf in the bad case he has to sponsor me again. what do u guys think

    Thanks

As My understading from this: If you are denied on your I-751 USCIS will claim that you didn't enter the marriage in a good faith therefore it was a fraud. USCIS is very strick about the faud cases and you will not have any chance to stay or come back yo U.S under any circumstances. If they approved base on good faith than there is nothing to woory about... Is tehre any other way USCIS can deny I751 besides fraud?

My question is if you never apply for I-751 and start new I130 with your new husband, is that going be a problem or solution? In a way USCIS may say ;if your previous marriage was in good faith why didn't you file for I751? Or they won't even bring it up to table and take it as a new case?

Sorry I am just brain storming....

i dont think apply for 130 is a good idea, if you do that way, means you completely tell them your 1st marriage is fake, if they denied 751 they still give you time for appeal then there is nothing to say that your is not a good faith marriage because you have paper work, your have marriage license, who said that your is fake marriage, the only thing it will take long time and still depending

Back to my case, anyone think that if i have more evidence of ex spouse like a letter from his letter explain that he has a new gf is good for applying 751 later?

  4. hi there,

i came here by K1 and got 2 yr GC in but the relationship didn't go through my husband had another gf, i moved to apt where near my school and he moved to another one which is convenient for working ...then we got a divorce in 19th month of relationship , then i move to another state and met my bf ( he also got divorce with his wife who came here by student visa and they got divorce while she was going to apply for I-751 last year). The whole point, i'm going to apply for 751 next year...then i dont know should i apply for 751 by myself like waiver then wait till i get done with 10 yr GC or can i get marry with my bf , because i'm not sure if any problem with more complicated paper and look like multiple marriage if i get married with him ?

    Thanks

  5. can you share more experiences and details about your case, also the lawyer, how much did they charge?

    Thanks

    hello there!

I just wanted to share that I got my 10 GC.

I was married, but for many reasons my marriage stop working. Then I filled for a dissolution.

With my divorce papers, I hired an Attorney and I filled for ROC. My love and my marriage were true.

Surprisily this was the fatest Immigration process that I went through. No RFEs, nothing.

I filled on May, 29, had my biometrics on july 8th and I got my GC on Sep 11th. Less than 4 months.

    Just sharing with you guys.

    Good luck to all!
