  1. Hi all, my wife and I are starting to wonder if our case is stuck and if what are next steps should be. Confusion is due to seeing on VJ that many applicants for AOS May 2023 have gotten EAD and AP approval while our timeline on USCIS says everything is progressing as normal. MARCH 17, 2023: Entry in the US with K1 Visa MARCH 23, 2023: Married MAY 1, 2023: AOS+AP+EAD Packet Mailed MAY 5, 2023: Biometrics Appointment MAY 22, 2023: RFE MAY 25, 2023: Response to RFE JUNE 1, 2023: RFE Received Haven't heard anything else since then.
  2. Yes, included summary of both bank accounts with bank letterhead. One account had 12 month average, the other did not. This time I will include both bank documents (updated) and for the second bank I will include 12 months of statements with it (which they will average).
  3. So to clarify: At the moment I have $24, 300 total income on 2022 1040 + $30,000 in bank account. This is for household size of 2 (my wife and I) which 125% is $24,650. This is a difference of $350. I have chosen to go the route of income + assets rather than introducing a family member as a joint sponsor. Are you suggesting that’s a bad idea? Is it better to get a joint sponsor?
  4. Hi all, Submitted for AOS paperwork on 5/01 and just received a letter yesterday 5/30 with an RFE. The RFE states: "Why We Are Writing You On May 1 , 2023, you submitted your Form I-485. We are writing to inform you that we need more information from you to make a decision on your case. Please read this letter carefully and follow all of the instructions below. What You Need To Do You must provide het following information in order for us to make a final decision on your case. Please include a copy of AL pages of this letter with your response. • Based on the documents submitted, we could not determine that the petitioning sponsor on Form I-864, Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning sponsor's Form I-864 must be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's income meets 125 percent of the federal poverty guideline for the sponsor's household size. See Form I-864P for information on the Federal Poverty Guidelines." I am very confused cause I believed that we did all the paperwork correctly and my total income was above the poverty guidelines. I looked over the submitted papers and everything looks fine however my initial submission included a 1040X (amended return) as my accountant messed up the numbers when he submitted my tax return. I see now that the transcript for 2022 includes a different number than what was under total income in 1040X. Could this have been the issue? Do the agencies share this info to confirm and flag if the number is off (it's off by like $300). I will resubmit today but I have some questions: - is it better to submit online than by mail? - this time I will not include my tax return but rather the tax return transcript (with no additional paperwork 1099, etc.) - I am self employed and this year (because of the writer's strike) I have been affected financially. Should I just write last year's total income on taxes as my "annual income?" - how many times can you be RFE'd before you get denied? Thanks all.
  5. Received an email from the Dublin embassy on October 3rd with Packet 3 (k1 visa). In it says to make a medical appointment first- called Mater and was informed next medical appointment isn't until Nov. 30th. Is there any way to expedite this? Perhaps a wait list if there is a cancellation? Also about how long after embassy is notified of readiness is the interview? Thanks everyone!
  6. October 3rd, Embassy has application and has sent out packet 4 by email. This is Dublin embassy. So NVC shipped out Sept 27. Embassy received October 3rd.

  9. July 29th NOA2 here...still no communication from NVC. I reached out to NVC with an inquiry on 9/7 but it looks like that will take 2 months for them to reply to... How long is it taking to these days to hear back from NVC once you get NOA2?
  10. Thank you for your response. It was approved 7/28 and it is now 9/7- was is the current wait time to hear back from the NVC? I am assuming it is a letter that is sent or is it by e-mail?
  11. Hi all, I finally received my form I-797 (NOA2) from the USCIS. I was a little confused though as the form states "The above petition has been approved, and forwarded to the listed consulate. Please contact the consulate with any questions about Visa issuance or if you would now Ike them to forward the petition to a different consulate." Does this mean my application is not being sent to the NVC? If not, why was my application sent directly to the consulate? The consulate is not stated on the I-797 so does this mean it went to the consulate in my original application? NOA2 was July 29th, about how long does it take for the consulate to receive my application? I have contacted the Dublin embassy by e-mail for further clarification but hope to get answers here in the meantime. Many thanks!
  12. My fiance nor I have received any further email/letters since the I-797 from the USCIS. I just e-mailed the embassy in Dublin to receive further clarification.
  13. Gotcha! I think I have an Alien number because I was born in Cuba and perhaps that was my original Alien number when my parents did my citizenship paperwork. I wonder why my application was sent directly to the consulate and not to the NVC...
  14. Just wanted to give an update on my request to resend my approval notice from the USCIS. They responded (about 2 weeks after) that the letter was sent to my address but USPS sent it back because it had the wrong address (this is definitely not true as my address has not changed). Either way they sent another copy of the approval notice which was received on 9/3. On it there is a receipt number, a received date (6/7), a notice date (8/24), numbers next to my (beneficiary) and my fiance's (petitioner) name. It states the approval notice is valid from 7/28 through 11/27. It also says "the above petition has been approved, and forwarded to the listed consulate." Some questions: - what are the numbers next to my name and my fiance's name? - should i update the NOA2 date to 8/24 or leave it at 7/29 (which is the date that it said online it was approved)? - since the application was approved and forwarded to the listed consulate does this mean they skipped the NVC step? I still haven't received an e-mail from the NVC as of 9/7...is that step still happening or should i just got ahead and contact the consulate? - lastly, the approval notice did not list the consulate it was sent to, just wanted to confirm it is the original one listed in the application. Thank you so much everyone for the answers. Will be very much appreciated!
  15. July 29th approval, no mail received by Aug 13. Sent request was told it can take up to a month to hear a response...sigh. I guess it doesn't matter so much to get the letter just as long as I know it was approved and eventually will hear back from NVC right? Does NVC contact me (petitioner) by mail or by e-mail?
  16. Hi all, First of thanks to everyone who is working hard to keep us informed. It really felt hopeless there for us towards the end so I totally know what it feels like to wait while seeing others being approved. Know that your day will come. We had our NOA1June 7th 2021. We got our approval on July 29th 2022. The website said to contact USCIS if we didn't receive our NOA2 form by Aug 13th. Which we still haven't. I did the E-Request thing but it says it can take up to a month to hear back- is there something else I should be doing if I haven't gotten the NOA2 by mail? Also what comes in the form? Thanks!
  17. Hi all, Just recently found this forum and figured I'd reach out in order to better understand this process. A bit about us: My fiance is a Lithuanian citizen based in Dublin, Ireland. I, her petitioner, am a US citizen based in Los Angeles. We have been dating long distance for a few years and decided to move forward with our relationship. We went back and forth regarding who should move and ultimately decided she should move to me. We also decided to do the fiance visa as opposed to the spousal visa as she felt that rushing into a marriage for the sake of papers would freak both her and her parents out. To that point I agree it was the right move as it has given time for our relationship to grow as engaged partners as well as allowed me to bond with her parents. I submitted the I-129F paperwork on June 7th 2021 and shortly after received a notice in the mail mentioning that the application was received. Since then we have been playing the waiting game watching the processing time grow larger and larger. At this point we try not to look at it as seeing a delay in our relationship and our future is really starting to stress us out. As we wait I figured I would ask some questions (which I truly appreciate anyone who takes the time to answer): -Should we have just bit the bullet and gotten married and applied for the spousal visa instead of going through the fiance visa? Would it have been any faster? -To that point should we just continue to wait or if it is faster does it make any sense to apply through a different means at this point? -How long after my application is approved is it currently taking for her to get the interview? -Is it really taking 6-8 months to get approval for work/travel after AOS is submitted? Luckily she has been using this time to build up her savings but these delays are really gonna just make it so we go through all of that...
